About approval of the Regulations on industry state archive Public institution "The state kartografo-geodetic fund of Ukraine" of the Ministry of protection of the surrounding environment of Ukraine

According to article 26 of the Law of Ukraine "About National Archive Fund and archive organizations", article 19 of the Law of Ukraine "About land and cartographic activities" and the resolution of the Cabinet of Ministers of Ukraine of 20.06.96 N 661 "About creation of the State kartografo-geodetic fund of Ukraine" we ORDER:

1. Approve Regulations on industry state arkhivegosudarstvenno "State Kartografo-geodetic Fund of Ukraine" organization of the Ministry of protection of the surrounding environment of Ukraine which is applied.

2. To department of forming of National Archive Fund of management of clerical work, forming and storage of National Archive Fund of the State committee of archives of Ukraine (Kuznetsova M. I.) and (Tkalich V. P.) to submit to Public service of geodesy, cartography and inventory this order in accordance with the established procedure on state registration to the Ministry of Justice of Ukraine.

3. To impose control over the implementation of this order on the vice-chairman of the State committee of archives of Ukraine Novokhatsky K. E. and deputy minister of protection of the surrounding environment of Ukraine Makarenko I. D.

4. This order becomes effective in 10 days after state registration in the Ministry of Justice of Ukraine.

Regulations on the industry Public Records Office - Public institution "State kartografo-geodetic fund of Ukraine" of the Ministry of protection of the surrounding environment of Ukraine

1. The industry Public Records Office - Public institution "State kartografo-geodetic fund of Ukraine" of the Ministry of protection of the surrounding environment of Ukraine (further - Ukrkartogeofond) is created according to article 26 of the Law of Ukraine "About National Archive Fund and archive organizations", article 19 of the Law of Ukraine "About land and cartographic activities" and the resolution of the Cabinet of Ministers of Ukraine of 20.06.96 N 661 "About creation of the State kartografo-geodetic fund of Ukraine".

2. In the activities Ukrkartogeofond is guided by the Constitution of Ukraine, the Laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, orders of Ministry for Protection of the Environment and Natural Resources, Public service of geodesy, cartography and inventory (daleeukrgeodezkartografiya), other regulatory legal acts and this Provision.

3. Concerning the organization and technique of conducting archiving Ukrkartogeofond is guided by orders of the State committee of archives of Ukraine.

4. Ukrkartogeofond is public institution which is founded on state-owned property.

5. Ukrkartogeofond is legal successor of the State company "State Kartografo-geodetic Fund of Ukraine".

6. Ukrkartogeofond works according to the annual plan which affirms Ukrgeodezkartografiya's chairman, and reports to it about carried out to work.

7. Ukrkartogeofond performs acceptance, the state accounting, storage, systematization of documents which were formed as a result of Ukrgeodezkartografiya's activities, the organizations, the companies, organizations of other industries and fields of activity (further - the organizations) which are carrying out in the territory of Ukraine the cartographic, geodetic, gravimetric, aero film-making and other works in this sphere referred by examination of value to National Archive Fund (further - NAF), and also creates conditions for their use.

8. Ukrkartogeofond stores the documents (further - profile documents) formed during execution of:

astronomo-geodetic, gravimetric, leveling works, and also inspection and recovery of Items of geodetic and leveling networks;

cartographic works on creation of all large-scale number of thematic cards and plans in any systems of coordinates, including the works connected with shooting of the continental shelf and water objects, frontier, etc.;

aero - and the kosmosjemochny works intended for creation of topographic maps and plans;

works on digital mapping;

works on creation and preparation for the edition and edition of topographic maps and plans of all large-scale row, and also nation-wide, thematic, help and other cards and atlases of both territory of Ukraine, and territories of other states.

9. The main objectives of Ukrkartogeofond are:

providing conditions of safety of documents NAF;

conducting the state accounting of documents NAF;

entering into NAF based on examination of value of profile documents and completing of the archive funds by them;

Ukrkartogeofond completing by foreign cartographic editions;

Ukrkartogeofond completing by normative, normative and technical acts and industry standards of Ukrgeodezkartografiya, their systematization and accounting;

maintaining databank of the standardized place names of the territory of Ukraine and foreign countries;

the organizational and methodical help with work with archive documents to regional kartografo-geodetic funds of the state kartografo-geodetic companies which belong to the sphere of management of Ministry for Protection of the Environment and Natural Resources;

creation of necessary conditions for use of documents on the conditions determined by Ukrgeodezkartografiya;

detection of the profile documents of historical and scientific heritage of Ukraine which are abroad, their return or reproduction in copies;

work concerning identification and reference of profile documents NAF to unique;

implementation of modern achievements of science, equipment, best practices in practice of activities of Ukrkartogeofond.

10. Ukrkartogeofond according to the tasks assigned to it:

performs centralized collection, accounting and preserving profile documents;

creates copies for insurance fund and fund of use of unique documents which are stored in Ukrkartogeofondi, and profile unique documents irrespective of the storage location and pattern of ownership for them;

carries out matching and creates copies of profile documents;

creates the help device to documents which are stored in Ukrkartogeofond, and provides automation of information retrieval processes;

keeps the state account of profile documents NAF irrespective of pattern of ownership for them, exercises control of their storage, accounting and use;

organizes the work connected with entering of documents into NAF or withdrawal of documents from it irrespective of pattern of ownership on them;

carries out work on completing as land and cartographic information which arrives from the state companies relating to the sphere of management of Ministry for Protection of the Environment and Natural Resources, and organizations of other industries and fields of activity;

determines profile sources of forming of NAF and Goskomarkhiva constitutes the corresponding lists according to technique;

constitutes the annotated lists of profile unique documents NAF, prepares offers on introduction them in the State register of national cultural property;

develops within the competence methodical documents on profile questions;

performs money value of documents NAF which are stored in Ukrkartogeofond, and on requests of customers - owners of documents NAF;

carries out work on studying of the existing state astronomo-geodetic basis in the territory of Ukraine and monitoring of cartographic study of the area;

carries out expertize of engineering designs and programs (design estimates) in pursuance of nation-wide land and cartographic works which are performed at the expense of means of the government budget by the land and cartographic companies which treat the sphere of management of Ministry for Protection of the Environment and Natural Resources;

performs editorial and control verification of publishing originals of topographic maps of all scales and cards of open use which are made at the expense of means of the government budget;

organizes maintaining the card on duty for providing the timely and exact image on the created cards of political and administrative and geographical elements, and also administrative and frontiers of Ukraine and foreign states;

provides protection of the data and document storage which are the state secret within the competence;

organizes studying, generalization and distribution of the best practices, implements scientific achievements and progressive methods of work in archiving.

11. Ukrkartogeofond has the right:

receive on storage from the state companies which treat the sphere of management of Ministry for Protection of the Environment and Natural Resources and organizations of other areas and fields of activity, profile documents;

provide within the powers to the state companies which treat the sphere of management of Ministry for Protection of the Environment and Natural Resources, explanation of rules and requirements concerning ensuring safety of profile documents;

demand from the owner of documents since which creation there passed more than 50 years or if owners of documents intend to perform their alienation or export out of limits of Ukraine, to report to Ukrkartogeofond for the purpose of permission of question of conducting examination of value of these documents;

put according to the procedure, established by the legislation, question of accountability of users by documents NAF and other persons guilty of violation of the law about NAF and archive organizations, and also about compensation of the losses caused to the owner of information of NAF or person authorized by it by them;

limit in accordance with the established procedure access to documents NAF which are stored in Ukrkartogeofond;

convene in accordance with the established procedure meetings on the questions which are within the competence of Ukrkartogeofond;

within the powers, on basis and in pursuance of acts of the legislation of Ukraine to issue orders, to provide and control their accomplishment.

12. Ukrkartogeofond obligations:

provide forming and maintaining the State kartografo-geodetic fund of Ukraine;

perform effective and rational use of state-owned property;

provide timeliness of tax payment, charges (other obligatory payments) according to the current legislation;

create the corresponding conditions for high-productive work, provide compliance with law about work, rules and regulations of labor protection and safe engineering;

provide accomplishment of regulatory legal acts concerning protection of the state secrets;

provide implementation of activities within the estimate on content of Ukrkartogeofond approved by Ukrgeodezkartografiya;

perform accounting, tax accounting and messages the financial and statistical reporting according to requirements of the current legislation;

the director of Ukrkartogeofond and the chief accountant bear the personal responsibility for observance of procedure for maintaining and reliability of accounting, the financial and statistical reporting.

13. Legal position of Ukrkartogeofond:

Ukrkartogeofond is legal entity and has the status of the public budget non-profitable institution with the state pattern of ownership. The rights and obligations of the legal entity Ukrkartogeofond acquires from the date of its state registration;

Ukrkartogeofond conducts separate balance, has accounts, seal with the name;

maintenance costs of Ukrkartogeofond are provided at the expense of the means provided in the Government budget for Ministry for Protection of the Environment and Natural Resources on accomplishment of land works;

maintenance costs of Ukrkartogeofond are performed within the estimate approved with Ukrgeodezkartografiya;

Ukrkartogeofond is liquidated according to the decision of the Cabinet of Ministers of Ukraine.

14. Control of Ukrkartogeofond is exercised by the director.

15. The director is appointed by Ministry for Protection of the Environment and Natural Resources on representation to Ukrgeodezkartografiya by the conclusion of the contract with it.

16. The director of Ukrkartogeofond has two deputies.

17. Director of Ukrkartogeofond:

performs management of Ukrkartogeofond activities, bears the personal responsibility for accomplishment of the tasks assigned to Ukrkartogeofond, determines functional obligations of the deputies and heads of structural divisions of Ukrkartogeofond;

bears the personal responsibility for Ukrkartogeofond activities;

exercises constant control on ensuring protection of the state secret;

independently resolves Ukrkartogeofond activities issue, except for those which are carried to competence of Ministry for Protection of the Environment and Natural Resources, Ukrgeodezkartografiya;

acts on behalf of Ukrkartogeofond, represents its interests in all organizations, at the companies, in the organizations, bank institutions and judicial authorities;

disposes of means of Ukrkartogeofond according to the current legislation;

signs agreements, issues powers of attorney, opens and closes accounts, has right to sign of settlement documents;

bears the personal responsibility for forming and accomplishment of the corresponding financial plans - estimates of organization;

bears the personal responsibility for creation of the estimate and plan of assignments of Ukrkartogeofond;

submits the estimate and the plan of assignments to Ukrkartogeofond on approval to the chairman Ukrgeodezkartografiya;

approves structure and the staff list of Ukrkartogeofond in coordination with Ukrgeodezkartografiya's chairman;

takes measures concerning enhancement of structure of Ukrkartogeofond;

in coordination with Ukrgeodezkartografiya's chairman determines forms and wages systems of other persons which are involved in Ukrkartogeofond;

appoints to positions and dismisses deputy directors of Ukrkartogeofond and the chief accountant in coordination with the chairman Ukrgeodezkartografiya;

appoints and exempts employees of Ukrkartogeofond;

according to the legislation issues the orders, orders obligatory for accomplishment by employees of Ukrkartogeofond, and controls their accomplishment.

18. Compensation of employees of Ukrkartogeofond is performed according to requirements of the current legislation.
