1. Approve the Procedure for electronic submission of the open and public data containing in the Unified State Register of Legal Entities and in the Unified State Register of Private Entrepreneurs according to appendix to this order.
2. Determine that electronic submission of the open and public data containing in the Unified State Register of Legal Entities and the Unified State Register of Private Entrepreneurs exercise the Federal Tax Service and Offices of the Federal Tax Service in subjects of the Russian Federation according to the procedure approved by Item 1 of this order.
3. Determine that the Federal Tax Service, Offices of the Federal Tax Service in subjects of the Russian Federation provide placement on the Internet on the websites of the Federal Tax Service and Offices of the Federal Tax Service in subjects of the Russian Federation of the following information:
about procedure and conditions of provision of open and public data, and also lists of the data containing in the Unified State Register of Legal Entities and the Unified State Register of Private Entrepreneurs;
about details of the payment documents used in case of payment of receipt of the information provided according to the procedure approved by Item 1 of this order.
4. Declare invalid the order of FNS of Russia of 21.10.2004 of N SAE-3-09/7 @ "About approval of the Procedure for electronic submission of the data containing in the Unified State Register of Legal Entities and in the Unified State Register of Private Entrepreneurs" (it is registered in the Ministry of Justice of the Russian Federation 17.11.2004 N 6123; "The Russian newspaper", 2004, N 260) from the date of enforcement of this order.

1. The open and public data containing in the USRLE and the Unified State Register of Individual Entrepreneurs (further - Open data), in electronic form are provided according to the Federal Laws and regulatory legal acts of the Government of the Russian Federation to all interested persons:
to public authorities, local government bodies and the Bank of Russia - it is free;
to legal entities and physical persons - for a fee.
2. According to Item 24 of Rules of maintaining the USRLE and Item 32 of Rules of maintaining the Unified State Register of Individual Entrepreneurs the amount of payment for provision of open and public data from each state register constitutes:
for single provision open and public svedeniy50 thousands of rubles;
for single provision of updated data - 5 thousand rubles;
for annual subscriber services of one workplace - 150 thousand rubles.
3. The data containing in the USRLE/Unified State Register of Individual Entrepreneurs in electronic form are provided according to the lists established by the appendix N 2 to Rules of maintaining the USRLE and the appendix N 2 to Rules of maintaining the Unified State Register of Individual Entrepreneurs respectively taking into account Item 1 of article 6 of the Federal Law of 08.08.2001 N 129-FZ.
4. Methods of electronic submission of Open data.
Information is provided to public authorities, local government bodies and the Bank of Russia:
on electronic media (CD/DVD format compact disks) or in e-mail mode with use of means of the digital signature according to Chapter II of this Procedure. Data from the USRLE/Unified State Register of Individual Entrepreneurs on electronic media are provided to public authorities, local government bodies and the Bank of Russia by provision by the receiver of data (public authority, local government body, the Bank of Russia) of such carriers;
with use of Web technology by means of establishment of access to the Sections of the website of FNS of Russia on the Internet containing Open data according to Chapter III of this Procedure.
Information is provided to legal entities and physical persons with use of Web technology by means of establishment of access to the Sections of the website of FNS of Russia on the Internet containing Open data according to Chapter III of this Procedure.
5. The open information is provided to receivers in case of representation:
the request for electronic submission of the open and public data containing in the USRLE and (or) the Unified State Register of Individual Entrepreneurs, which is drawn up separately on each information resource according to the appendices N 1 and (or) N 2 to this Procedure (further - the Request).
The request can be submitted to FNS of Russia in electronic form using the digital signature (DS), at the same time the signature key certificate shall be issued by FNS of Russia certification center or one of certification centers which list is posted on the website by FNS of Russia on the Internet;
the original document confirming payment of provision of the data containing in the USRLE and (or) the Unified State Register of Individual Entrepreneurs (if provision of data is performed for a fee).
6. For receipt of Open data the documents specified in Item 5 of this Procedure are submitted:
in the Federal Tax Service (or in the territorial tax authority authorized in accordance with the established procedure by FNS of Russia on provision of the specified data) - for receipt of information about the legal entities and individual entrepreneurs registered in general across the Russian Federation:
legal entities and physical persons, public authorities, local government bodies and the Bank of Russia for receipt of data of the USRLE/Unified State Register of Individual Entrepreneurs with use of Web technology;
federal bodies of the government and the Bank of Russia (directly) for receipt of data on electronic media or in e-mail mode;
in Offices of the Federal Tax Service in subjects of the Russian Federation - for receipt of information about the legal entities and individual entrepreneurs registered in the corresponding territories:
public authorities of subjects of the Russian Federation, territorial authorities of federal bodies of the government, local government bodies and territorial offices of the Bank of Russia for receipt of data on electronic media or in e-mail mode.
7. FNS of Russia, the Department of FNS of Russia for the subject of the Russian Federation in time no more than five working days from the date of receipt of the documents specified in Item 5 of this Procedure makes the decision on provision of Open data, or the decision on refusal in provision of the specified data.
8. The decision on provision of Open data contains information on the name of the register which information is provided, on amount of the provided information, method of provision of data in electronic form. Start date of provision of data according to Chapter III of the Procedure is date of the first user login, but no later than in 6 months from decision date about provision of the specified data.
The specified decision made by provision of data according to Chapter II of the Procedure contains also information on period of time for which the information of the state register according to the submitted Request, frequency of provision of the specified data is provided.
9. In case of decision making about provision of Open data to the receiver of the specified data the Notification containing information on the made decision and also depending on method of provision of information other data determined by Chapters II, III of this Procedure goes. Besides, in case of provision of Open data on electronic media together with the notification data of the register on carriers, the information provided by the receiver go.
10. FNS of Russia, the Department of FNS of Russia for the subject of the Russian Federation directs specified in the Item 9 Notification no later than five working days from the date of decision making according to specified in the Request by method and the receiver's address.
11. In case of decision making about refusal in provision of Open data to person who addressed for provision of the specified data, the notification containing information on the made decision goes.
The decision on refusal in provision of Open data shall contain the refusal bases in provision of data.
In case of decision making about refusal in provision of Open data the submitted document confirming payment of provision of the specified data returns to the receiver together with the Notification on the made decision on refusal in provision of data.
12. FNS of Russia, the Department of FNS of Russia for the subject of the Russian Federation directs specified in the Item 11 Notification no later than five working days from the date of decision making.
13. The refusal in provision of Open data is allowed in the following cases:
representations of the incomplete document package determined by Item 5 of this Procedure, including the wrong execution of the payment document confirming payment of provision of data (the wrong specifying of the account and details of the receiver, purpose of payment, the amount of payment);
submission of the Request for provision of data which method of obtaining does not enter competence of the receiver;
non-presentations of electronic media by public authorities, local government bodies or the Bank of Russia in case of receipt of the data containing in the USRLE/Unified State Register of Individual Entrepreneurs on electronic media.
14. The refusal in provision of Open data for other reasons, or the untimely direction of Notifications to the receiver is not allowed.
15. Open data on electronic media or in the mode of e-mail are provided:
to federal bodies of the government, the Bank of Russia - FNS of Russia;
to territorial authorities of federal bodies of the government, territorial offices of the Bank of Russia, public authorities of subjects of the Russian Federation, local government bodies - the relevant Departments of FNS of Russia for subjects of the Russian Federation.
16. Provision of data on electronic media or in the mode of e-mail is performed in the form of the electronic document (file). Acceptance and processing of the specified files is performed with use of program technical means of the receiver.
17. The electronic document is signed by the EDS. Necessary details of the signature key certificate are specified in the notification on the made decision on the provision of data directed to the receiver.
The means of the EDS applied by receivers shall be compatible to the means of the EDS used by FNS of Russia.
18. Based on the made decision on provision of Open data of FNS of Russia, the Department of FNS of Russia for the subject of the Russian Federation creates the file containing the data of the corresponding state register for the period and for date determined in the decision on provision of data based on the submitted Request.
19. Periods of time for which the information in electronic form containing in the USRLE/Unified State Register of Individual Entrepreneurs is provided:
from the beginning of forming of the state registers (on July 1, 2002 for the Unified State Register of Legal Entities; On January 1, 2004 for the Unified State Register of Private Entrepreneurs) until decision making about provision of the specified data;
for the period, specified in the decision on provision of data. The specified period cannot constitute less than 14 days.
20. The electronic document created according to the decision on provision of data with the EDS is packed by the standard program packer into the archive file, at the same time the size of the archive file does not exceed 2 MB in case of sending in e-mail mode.
21. The direction of the data containing in the USRLE/Unified State Register of Individual Entrepreneurs is performed according to specified in the Request by method and the receiver's address.
22. In the mode of e-mail only provision of the updated data containing in the USRLE/Unified State Register of Individual Entrepreneurs is performed.
23 The open and public information is provided to legal entities and physical persons, federal bodies of the government, including territorial authorities of federal bodies of the government, public authorities of subjects of the Russian Federation, the Bank of Russia and its territorial offices, local government bodies.
24. Provision of open and public data is performed with use of Web technology by establishment of access to the Internet to the website of FNS of Russia on which weekly updated data of the USRLE and the Unified State Register of Individual Entrepreneurs are posted. These data do not contain information, access to which is limited in accordance with the legislation of the Russian Federation.
25. Based on the made decision on provision of data for the receiver of data the attributes of access (user name (login), the digital certificate for establishment of the protected connection with appropriate section of the website of FNS of Russia in the Internet, necessary passwords) providing its identification and authentication (access daleeatributa) are created.
26. Attributes of access are specified in the notification on the made decision on provision of data which goes to the receiver by the method specified in the Request.
Means of cryptographic information security of the receiver (in case of their application for protection of attributes of access by their transfer through open channels of communication) shall be compatible to the means of cryptographic information security (further - SKZI) used by FNS of Russia. Information on compatibility of SKZI is posted on the website of FNS of Russia on the Internet.
27. Access to the Open data posted on the website by FNS of Russia is performed by the receiver with use of the attributes of access provided to it.
28. By provision of the data containing in the USRLE/Unified State Register of Individual Entrepreneurs according to this Chapter the receiver is given opportunity of search of necessary information on the amount of data specified in the Request.
Data from the USRLE/Unified State Register of Individual Entrepreneurs according to the specific address of the receiver are provided in the form of records USRLE/Unified State Register of Individual Entrepreneurs. At the same time the number of the records provided to the receiver one-timely in browse mode in the web browser cannot exceed hundred. The number of addresses during one session of access is not limited.
Federal bodies of the government, including territorial authorities of federal bodies of the government, public authorities of subjects of the Russian Federation, the Bank of Russia and its territorial offices, local government bodies in coordination with FNS of Russia of the data can be provided in the mode of access to automatic web service which description is posted on the website of FNS of Russia on the Internet.
29. Use of the attributes of access provided to the receiver more than from one workplace at the same time (establishment of several sessions) is not allowed. Use of the attributes of access provided to the receiver more than from one workplace is allowed, at the same time sessions cannot be established at the same time and the interval between them shall constitute at least thirty minutes.
30. Use of the attributes of access for receipt of the data which are not determined in the Request provided to the receiver according to the specific Request is not allowed.

32. The receiver is given opportunity of access to Open data which condition is fixed for date of provision of access according to the last arrived Request, any number of times during the certain period (further - single provision of Open data).
33. Single provision of Open data is performed in the form of provision of Open data or provision of Open updated data.
34. Single provision of Open data is performed by establishment for the receiver of access to the data containing in the USRLE/Unified State Register of Individual Entrepreneurs since start date of forming of the corresponding register (01.07.2002 for the USRLE, 01.01.2004 for the Unified State Register of Individual Entrepreneurs) on date of provision of access inclusive.
Effective period of attributes of access according to the specific Request for provision of Open data constitutes one year from start date of provision of the specified data.
After effective period of the specified attributes of access provision of Open data is performed based on again provided document package, the stipulated in Item 5 presents About.
Provision of Open updated data is performed based on the decision on provision of data made according to the Request for provision of updated data, on condition of action for the receiver of the specified data of attributes of access to Open data.
35. Provision of Open updated data is performed based on earlier provided attributes of access according to the Request for provision of Open data, by provision to the receiver of access to the data containing in the USRLE/Unified State Register of Individual Entrepreneurs, fixed as of date of filling of the last Request which arrived from this receiver.
Provision of Open updated data according to the Request for provision of updated data is performed during effective period of the attributes of access to receipt of Open data provided to this receiver.
36. The receiver is given opportunity of access to weekly updated Open data in appropriate section of the website of FNS of Russia on the Internet any number of times during the certain period of time (further - subscriber services of one workplace).
Subscriber services of one workplace according to the specific Request constitute one year from start date of provision of the specified data.
Prolongation of subscriber services of the receiver for the next period is performed based on again provided document package, the stipulated in Item 5 presents About.
Open information is provided free of charge on permanent basis (without restriction of term) to federal bodies of the government (including to territorial authorities of federal bodies of the government), to public authorities of subjects of the Russian Federation, the Bank of Russia and its territorial offices, local government bodies, based on single submission of the corresponding Request.
