1. Approve the enclosed Rules of registration, issue, prolongation, and also withdrawal of the passport of the seaman of the Republic of Kazakhstan.

2. Declare invalid the resolution of the Cabinet of Ministers of the Republic of Kazakhstan of September 1, 1994 No. 977 "About approval of the Regulations on the passport of the seaman" (SAPP of the Republic of Kazakhstan, 1994, No. 37, the Art. 401).

3. This resolution becomes effective from the date of its first official publication.

Rules of registration, issue, prolongation, and also withdrawal of the passport of the seaman of the Republic of Kazakhstan

1. General provisions

1. These rules of registration, issue, prolongation, and also withdrawal of the passport of the seaman of the Republic of Kazakhstan (further - Rules) regulate procedure for registration, issue, prolongation, and also withdrawal of the passport of the seaman of the Republic of Kazakhstan.

2. The passport of the seaman is drawn up and issued by the sea port administration which is territorial subdivision of authorized body (further - registering body).

3. The passport of the seaman is issued to citizens of the Republic of Kazakhstan:

1) working at the Kazakhstan courts of foreign swimming;

2) working at the courts floating under foreign flag;

3) to the cadets (pupils) of educational institutions included in structure of crew of the vessel that is confirmed by entry in the ship's papers containing data on quantity and structure of crew in case of receipt and withdrawal of the vessel (further - the muster roll).

2. Registration and issue of the passport of the seaman

4. Documents for registration and issue of the passport of the seaman are represented:

1) the Kazakhstan shipowners registered according to the legislation of the Republic of Kazakhstan, who are operating vessels under the Kazakhstan flag on its own behalf and having the right to appoint the captain and crew of the vessel irrespective of, they are owners of courts or use them on other legal cause;

2) foreign shipowners;

3) the citizens of the Republic of Kazakhstan who are seamen.

5. For execution of the passport of the seaman the Kazakhstan and foreign shipowners, and also the citizens of the Republic of Kazakhstan who are seamen submit the following documents to registering body:

the questionnaire statement on execution of the passport of the seaman in form according to appendix 1 to these rules;

the reference of bodies for defense at the place of residence, confirmatory that on the date of submission of the questionnaire statement on execution of the passport of the seaman the citizen of the Republic of Kazakhstan to whom the passport is drawn up is not called up for military service, or the military ID with mark about passing of military service;

notarized copies of the sea diplomas and the certificate confirming compliance of seamen to level of their professional training and the state of health to the requirements established by the legislation for members of crews of ocean ships;

representation of the Kazakhstan shipowner on issue of the passport of the seaman in form according to appendix 2 to these rules;

representation of the foreign shipowner in form according to appendix 2 to these rules together with the individual employment contract between the owner of the passport of the seaman and the foreign shipowner.

6. The questionnaire statement on execution of the passport of the seaman is presented in triplicate in the typewritten form or filled by hand with printing letters.

7. Documents for execution of the passport of the seaman are accepted in case of presentation of the identity document of the citizen.

8. For execution of the passport of the seaman the copy of the order on its sending in addition is submitted to person sent by the shipowner for work on the vessel under foreign flag.

9. For execution of the passport of the seaman according to the petition from the citizen of the Republic of Kazakhstan who is the seaman the application for issue of the passport of the seaman in form according to appendix 3 to these rules, in case of work on the foreign vessel - the individual employment contract is submitted.

10. Execution of the passport of the seaman to cadets (pupils) of sea educational institutions who did not reach age of majority is made in the presence of the notarized consent of parents (adoptive parents, guardians and custodians) to their departure from the Republic of Kazakhstan.

To the cadets (studying), who did not reach 16-year age, execution of the passport of the seaman is made in case of presentation of the certificate of birth.
