1. Approve the enclosed Administrative regulations on provision by the Federal Migration Service of the state service in implementation of migration registration in the Russian Federation.

2. Declare invalid the order of FMS of Russia of July 7, 2008 N 181 "About approval of forms of the marks which are put down when implementing migration registration". ***

3. To impose control of execution of this order on the deputy director of FMS of Russia on the supervised activity.

Administrative regulations on provision by the Federal Migration Service of the state service in implementation of migration registration in the Russian Federation

I. General provisions

1. Administrative regulations on provision by the Federal Migration Service of the state service in implementation of migration registration in the Russian Federation * (1) determines terms and the sequence of actions (ministerial procedures) of the Federal Migration Service * (2), territorial authorities of FMS of Russia and their structural divisions, and also order of interaction of FMS of Russia, its territorial authorities and their structural divisions with federal executive bodies, executive bodies of subjects of the Russian Federation in case of statement of foreign citizens and stateless persons on migration registration in the Russian Federation and to removal of foreign citizens and stateless persons * (3) from migration registration in the Russian Federation * (4).

2. Provision of the state service in implementation of migration registration is performed according to:

The Federal Law of July 18, 2006 N 109-FZ "About migration registration of foreign citizens and stateless persons in the Russian Federation" * (6);

The regulations on the Federal Migration Service approved by the Presidential decree of the Russian Federation of July 19, 2004 N 928;

the order of the Government of the Russian Federation of January 15, 2007 N 9 "About procedure of migration registration of foreign citizens and stateless persons in the Russian Federation" * (7).

3. The FMS of Russia, territorial authorities of FMS of Russia and their structural divisions when implementing migration registration are also guided:

The Federal Law of August 15, 1996 N 114-FZ "About procedure for departure from the Russian Federation and entry into the Russian Federation" * (8);

The Federal Law of July 25, 2002 N 115-FZ "About legal status of foreign citizens in the Russian Federation" * (9);

Tax Code of the Russian Federation * (10).

4. In system of FMS of Russia the state service in implementation of migration registration is provided by territorial authorities of FMS of Russia and their structural divisions (departments, departments, groups).

Functions of acceptance, consideration of the applications about registration of the foreign citizen at the place of residence * (11), functions of acceptance of the notification on arrival of the foreign citizen in the place of stay * (12) territorial authorities of FMS of Russia and their structural divisions perform. - statement of the foreign citizen on accounting in the place of stay;

- removal of the foreign citizen from accounting in the place of stay.

Registration of the foreign citizen (removal from registration) is drawn up by putting down of mark about registration of the foreign citizen (removal from registration) at the place of residence in the Russian Federation (the appendix N 1 to Administrative regulations) on the residence permit or in permission to temporary residence, and also in the statement of the foreign citizen for registration at the place of residence.

Registration of the foreign citizen in the place of stay is drawn up by putting down of mark about confirmation of accomplishment by the host party and (or) foreign citizen or stateless person of the actions necessary for its registration in the place of stay * (16) (the appendix N 2 to Administrative regulations), put down in detachable part of the form of the notification on arrival.

9. Applicants (receivers of the state service) are:
