About approval of the technical regulation about safety of machines and the equipment

According to the Federal Law "About Technical Regulation" Government of the Russian Federation decides:

1. Approve enclosed:

the technical regulation about safety of machines and the equipment (further - the technical regulation);

the list of machines and the equipment, subjects of obligatory certification for confirmation of conformity to requirements of the technical regulation about safety of machines and the equipment;

the list of the machines and the equipment which are subject to declaring of compliance to requirements of the technical regulation about safety of machines and the equipment.

2. To the Ministry of Industry and Trade of the Russian Federation together with the interested federal executive bodies in 3-month time to prepare the draft of the list of machines and the equipment which are subject to assessment of conformity to requirements of the technical regulation in case of release on customs area of the Russian Federation and to provide it in accordance with the established procedure to the Government of the Russian Federation.

3. The technical regulation becomes effective after one year from the date of official publication of this resolution.

4. The declarations of conformity and certificates of conformity issued before entry into force of the technical regulation affect the machines made and not put into operation and (or) the equipment before the termination of the term established in them.

The technical regulation about safety of machines and the equipment

I. General provisions

1. This technical regulation establishes minimum necessary requirements to safety of machines and the equipment during the designing, production, installation, adjustment, operation, storage, transportation, realization and utilization for the purpose of protection of life or health of citizens, property of physical persons or legal entities, the state-owned or municipal property, environmental protection, life and health of animals and plants, and also the prevention of the actions misleading acquirers.

2. This technical regulation extends to machines and the equipment, including household purpose for which types of danger are revealed and identified, requirements to elimination or reduction of which are established according to the appendix N 1.

3. This technical regulation does not extend to the following types of machines and the equipment:

a) the machines and the equipment connected with ensuring integrity and stability of functioning of single communication network of the Russian Federation and use of radio-frequency range;

b) the machines and the equipment used in the medical purposes and used in direct contact with the patient (the x-ray, diagnostic, therapeutic, orthopedic, dental, surgical equipment);

c) the machines and the equipment which are specially designed for application in the field of use of atomic energy. Extends to the machines and the equipment of common industrial appointment used in the field of use of atomic energy, action of this technical regulation in the part which is not contradicting requirements for ensuring nuclear and radiation safety;

d) vehicles;

e) sea and river vehicles (vessels and watercrafts, drilling platforms) and machines used on them and the equipment;

e) flying and spacecrafts;

g) the railway rolling stock and technical means which are specially designed for application on rail transport;

h) attractions;

i) arms and military equipment.

4. Action of this technical regulation extends to the machines and the equipment used on hazardous production facilities and also to processes of their operation and utilization in the part which is not contradicting requirements for ensuring industrial safety.

5. Identification of machines and the equipment is understood as establishment of compliance of specific machines and the equipment to sample or their description as which national standards, specifications and drawings, specifications, operational documentation can be used.

6. The concepts used in this technical regulation mean the following:

a) "accident" - destruction or damage of the machine and (or) equipment, origin in use machines and (or) the equipment of uncontrollable explosion and (or) emission of dangerous substances;

b) "admissible risk" - value of risk from use of the machine and (or) the equipment, proceeding from technical and economic capabilities of the producer corresponding to the safety level which shall be provided at all stages of product lifecycle;

c) "lifecycle" - the period of time from the beginning of designing of the machine and (or) the equipment before utilization completion including the interconnected stages (designing, production, storage, installation, adjustment, operation, including upgrade, repair, technical and field service);

d) "incident" - failure of the machine and (or) equipment, variation of the mode of engineering procedure, operation abuse of regulations;

e) "critical refusal" - failure of the machine and (or) equipment which possible effects is damnification of life or to health of citizens, property of physical persons or legal entities, the state-owned or municipal property, the environment, life or health of animals and plants;

e) "machine" - number of the interconnected parts or nodes from which at least one part or one node moves by means of the corresponding drives, chains of management, power sources combined together for specific application (processing, conversion, movement or packaging of material);

g) "the appointed resource" - total operating time in case of which achievement operation of the machine and (or) equipment shall be stopped irrespective of their technical condition;

h) "operating time" - duration or amount of operation of the machine and (or) equipment;

i) "the appointed service life" - the calendar duration of operation of the machine and (or) equipment in case of which achievement operation shall be stopped irrespective of their technical condition;

j) "the appointed storage duration" - calendar storage life of the machine and (or) equipment in case of which achievement their storage shall be stopped irrespective of their technical condition;

k) "inadmissible operation" - operation of the machine and (or) equipment not to destination;

l) "reasons for safety" - the document containing the risk analysis, and also data from design, operational, technological documentation on minimum necessary measures for safety accompanying machines and (or) the equipment at all stages of lifecycle and supplemented by data on results of risks assessment at operation stage after carrying out repair;

m) "equipment" - the technical device necessary for accomplishment of its main and (or) additional functions used independently or established on the machine, and also for combination of several machines in single complex;

o) "danger area" - zone in the machine and (or) the equipment or around them in which the personnel are exposed to risk of getting injured or causing other harm to health connected with operation of the machine and (or) equipment;

o) "refusal" - the event consisting in violation of operating state of the machine and (or) equipment owing to constructive violations when designing, non-compliance with the established production process or repair, failure to carry out of rules or maintenance instructions;

p) "the limiting condition" - condition of the machine and (or) equipment in case of which their further operation is inadmissible or inexpedient or recovery of their operating state is impossible or inexpedient;

c) "designer" - the legal entity or the individual entrepreneur developing the project documentation on the machine and (or) the equipment;
