I), Art. 29, N 24, Art. 2831, N 27, Art. 3213, N 31, Art. 4011, N 45, Art. 5417, N 50, Art. 6246; 2008, N 26, Art. 3022, N 48, Art. 5500, N 49, Art. 5748; 2009, N 1, the Art. 17, the Art. 22) and Item 5.2.9 of the Regulations on the Federal Customs Service approved by the order of the Government of the Russian Federation of July 26, 2006 N 459 (The Russian Federation Code, 2006, N 32, Art. 3569; 2008, N 17, Art. 1883, N 24, Art. 2867, N 46, Art. 5337; 2009, N 6, the Art. 738, N 12, the Art. 1429), for the purpose of enhancement of customs clearance and customs control of goods (the FEACN CU codes 2709 00 and 2710 11 110 02710 19 690 9), exported from customs area of the Russian Federation by transport, excellent from pipeline and air, including in case of bulk transportations, in case of their declaring to customs posts of the Central energy customs if the shipping place and (or) overloads (transfer) of goods does not match with the place of their declaring (further - the goods declared by TsET), I order:

1. Approve the enclosed Instruction about features of customs clearance and customs control of goods (the FEACN CU codes 2709 00 and 2710 11 110 0 - 2710 19 690 9), exported from customs area of the Russian Federation by transport, excellent from pipeline and air, in case of their declaring to customs posts of the Central energy customs if the shipping place and (or) overloads (transfer) of goods does not match with the place of their declaring (further - the Instruction).

2. GNIVTS of FCS of Russia (O. P. Puchkov) to provide access to the central database of electronic copies of cargo customs declarations (далееЦБД to GTD) by means of complex of software of data analysis of system of operating control behind processes of customs clearance and customs control (further - KPS "Monitoring-Analiz") to officials of customs authorities in which region of activities loading and (or) overload (transfer) of the goods declared by TsET at the level of viewing of the electronic copies of the cargo customs declaration (further - GTD) which are drawn up by customs posts of the Central energy customs is performed.

3. In a month from coming into force of this order to provide to chiefs of regional customs authorities execution of the generalized requests for provision of access for responsible officials of subordinate customs authorities in whose region of activities loading and (or) overload (transfer) of the goods declared by TsET to TsBD GTD by means of KRS "Monitoring-Analiz" at the level of viewing of electronic copies of GTD which are drawn up by customs posts of the Central energy customs is performed.

4. To impose control of execution of this order on the deputy manager of FCS of Russia S. O. Shokhin.

This order becomes effective after 90 days from the date of its official publication.

The instruction about features of customs clearance and customs control of goods (the FEACN CU codes 2709 00 and 2710 11 110 0 - 2710 19 690 9), exported from customs area of the Russian Federation by transport, excellent from pipeline and air, in case of their declaring to customs posts of the Central energy customs if the shipping place and (or) overloads (transfer) of goods does not match with the place of their declaring

I. General provisions

1. This Instruction about features of customs clearance and customs control of goods (the FEACN CU codes 2709 00 and 2710 11 110 02710 19 690 9), exported from customs area of the Russian Federation by transport, excellent from pipeline and air, in case of their declaring to customs posts of the Central energy customs if the shipping place and (or) overloads (transfer) of goods does not match with the place of their declaring (further - the goods declared by TsET) (further - the Instruction), determines features of actions of authorized officers of the Central energy customs and customs posts of the Central energy customs, and also authorized officers of customs authorities in which region of activities loading and (or) overload (transfer) of the goods declared by TsET when carrying out their customs clearance and customs control is performed, and also in case of execution of transport (transportation) documents, loading permits and (or) overload (transfer) on the vehicle, and also making of other customs transactions concerning the goods declared by TsET.

II. Actions of authorized officers of customs authorities in which region of activities loading and (or) overload (transfer) of the goods declared to customs posts of the Central energy customs is performed

2. The authorized officer of customs authority in which region of activities loading and (or) overload (transfer) of the goods declared by TsET is performed (further - the authorized officer of customs authority) checks:

a) availability of data on GTD which is drawn up by customs post of the Central energy customs in the central database of electronic copies of cargo customs declarations (further - TsBD GTD) with use of complex of software of data analysis of system of operating control behind processes of customs clearance and customs control (further - KPS "Monitoring-Analiz") based on the application of the customs applicant submitted to customs authority (the customs broker (representative) constituted according to the sample given in the appendix N 1 to the Instruction (further - the Statement), and the originals of sheets attached to it with the designation "2" of sets TD1, TD2 or "2/7" sets of TDZ, TD4 GTD which is drawn up by customs post of the Central energy customs or their copies certified by the authorized officer of customs post of the Central energy customs or the customs applicant (the customs broker (representative) who provided them;

b) powers of the customs applicant who submitted the Application (the customs broker (representative);

3. In the presence in TsBD GTD of data about the GTD Central energy customs which is drawn up by customs post the authorized officer of customs authority performs check of compliance of the data containing in TsBD GTD, to the data containing in the Statement.

4. In case of compliance of the data containing in the Statement, to the data containing in TsBD GTD the authorized officer of customs authority draws up loading permit and (or) overload (transfer) of the goods declared by TsET, transport (transportation) documents and also makes other customs transactions concerning the goods declared by TsET, and vehicles according to requirements of the customs legislation of the Russian Federation and also confirms the data containing in originals of sheets with the designation "2" of sets TD1, TD2 or "2/7" sets of TDZ, TD4 GTD which is drawn up by customs post of the Central energy customs, or their copies certified by the authorized officer of customs post of the Central energy customs or the customs applicant (the customs broker (representative) who provided them by putting down of personal number seal, the personal signature and date on necessary for transportation of goods, the declared TsET, number of copies of GTD.

5. In the absence of data on TsET GTD which is drawn up by customs post in TsBD GTD, and also in cases of impossibility of receipt of access to TsBD GTD with use of KPS "Monitoring-Analiz" owing to the technical reasons by operational communication channels the authorized officer of customs authority sends to the Central energy customs the inquiry constituted according to the sample given in the appendix N 2 to the Instruction (further - the Request).

6. When obtaining on operational communication channels from the Central energy customs or from customs post of the Central energy customs of the answer about confirmation of the fact of the release of goods prepared according to the sample given in the appendix N 3 to the Instruction, the authorized officer of customs authority makes actions, stipulated in Item 4 Instructions.

7. In case of discrepancy of the data containing in the Statement, to the data containing in TsBD GTD, or obtaining on operational communication channels from the Central energy customs or from customs post of the Central energy customs of the answer about non-confirmation of the fact of the release of goods which is drawn up according to the sample given in the appendix N 4 to the Instruction, the authorized officer of customs authority sends to the customs applicant (the letter on refusal in registration of loading permit and (or) overload (transfer) of goods prepared on the sample given in the appendix N 5 to the Instruction, and on operational communication channels sends to the customs broker (representative) its copy to the Central energy customs.

III. Actions of authorized officers of the Central energy customs

8. The authorized officer of the Central energy customs, when obtaining on operational communication channels of the Request, according to the decision of the chief of the Central energy customs or according to the decision of the representative the chief of the Central energy customs of the official of the Central energy customs by operational communication channels sends the Inquiry to customs post of the Central energy customs according to the code of customs authority containing in the registration number GTD specified in the Request or:

based on the Request checks availability of data on GTD which is drawn up by customs post of the Central energy customs in TsBD GTD with use of KPS "Monitoring-Analiz" and sends on operational communication channels to the customs authority which sent the Inquiry:

in case of confirmation of the fact of release of the goods declared by TsET on GTD and compliance of the data containing in the Request, to the data containing in GTD - the answer prepared according to the sample given in the appendix N 3 to the Instruction;

in case of non-confirmation of the fact of release of the goods declared by TsET on GTD and (or) discrepancies of the data containing in the Request, to the data containing in GTD - the answer prepared according to the sample given in the appendix N 4 to the Instruction.

IV. Actions of authorized officers of customs posts of the Central energy customs

9. The authorized officer of customs post of the Central energy customs when obtaining on operational communication channels from the Central energy customs of the Request sends on operational communication channels to the Central energy customs, and also to the customs authority which constituted the Request:

- in case of confirmation of the fact of release of the goods declared by TsET on GTD and compliance of the data containing in the Request, to the data containing in GTD - the answer prepared according to the sample given in the appendix N 3 to the Instruction;

- in case of non-confirmation of the fact of release of the goods declared by TsET on GTD and (or) discrepancies of the data containing in the Request, to the data containing in GTD - the answer prepared according to the sample given in the appendix N 4 to the Instruction.

V. Final provisions

10. The authorized officer of customs authority includes in set of the documents relating to loading and (or) overload (transfer) of the goods declared by TsET, the Statement, copies of the documents attached to it, and also copies of the documents processed according to the samples given in the appendices N 1-5 to the Instruction (if such documents were constituted), and organizes their storage according to the procedure, provided for the documents used for the customs purposes.
