About measures for the organization of construction of housing in the rural zone based on standard projects with participation of Kishlok Kurilish Investment engineering company

In pursuance of the Resolution of the President of the Republic of Uzbekistan from 3 August, 2009 No. PP-1167 "About additional measures for expansion of scales of construction of housing in the rural zone", for the purpose of the organization of construction in the rural zone of housing according to the approved standard projects with participation of the Cabinet of Ministers Kishlok Kurilish Investment engineering company decides:

1. Approve Regulations on procedure of individual housing construction with participation of Kishlok Kurilish Investment engineering company according to appendix No. 1.

2. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

3. To the ministries and departments to bring the departmental regulatory legal acts into accord with this resolution in a month.

4. To impose control of execution of this resolution on the First the deputy prime minister of the Republic of Uzbekistan Azimov R. S. and the Deputy prime minister of the Republic of Uzbekistan Hodzhayev B. A.

Regulations on procedure of individual housing construction with participation of Kishlok Kurilish Investment engineering company

I. General provisions

1. This Provision determines procedure for the organization and financing of complex individual housing construction by the approved standard projects with participation of Kishlok Kurilish Investment engineering company, and also JSB Kishlok kurilish bank, National Bank of foreign economic activity of the Republic of Uzbekistan, AKIB "Ipoteka bank", JSC People's Bank, JSB Usak bank and JSB Uzpromstroybank (further - bank) on the land arrays allocated for Kishlok Kurilish Investment engineering company.

If conditions of provision of the foreign credits and grants attracted to individual housing construction in the rural zone establish other rules, than those which are provided by this Provision then are applied the rules established in the relevant regulating documents of the international and foreign financial institutions.

2. In this Provision the following concepts are applied:

the individual builder - the citizen of the Republic of Uzbekistan who in accordance with the established procedure is drawing up (drawn-up) order for construction of individual housing in compliance the approved standard project;

engineering company - IK Kishlok kurilish invest LLC (further - engineering company), performing under the contract with the individual builder functions of the customer in case of construction of individual housing;

the contractor - the contract construction organization performing construction of the apartment house based on the works agreement signed with engineering company by results of the competitive biddings on order placement on construction of the apartment house on a turnkey basis;

land array - the parcels of land provided to engineering company for construction of standard apartment houses and objects of social, engineering and production infrastructures based on the master plan developed for the respective settlement;

target means - the means of the Ministry of Finance and Fund of reconstruction and development of the Republic of Uzbekistan provided on preferential basis for individual housing construction according to the approved standard projects including the funds allocated by them for forming of the authorized capital of bank, and also means of the international and foreign financial institutions;

the available apartment house - the one-storey 3-roomed (blocked) available apartment houses placed on the parcels of land by the 0,02 size of hectare and four-storeyed available apartment (2-and 3-roomed) houses;

the initial contribution - means of the borrower in the amount of at least 10 percent from the estimated cost of available apartment houses under construction in the form of own money of the borrower (co-borrowers) or the legal entity - the employer of the borrower or money of other persons, brought on the savings supplementary bank account opened addressed to the borrower;

mortgage based on the law - the mortgage type applied to providing obligations of the borrower according to the credit agreement in case of which the credit agreement involving emergence of mortgage based on the law is the basis for state registration of mortgage based on the law.

3. The construction of the apartment house or available apartment house is performed by the contractor based on orders of engineering company according to requests of individual builders.

4. Financing of individual housing construction is performed at the expense of the target means of bank, own means of engineering company and other sources which are not prohibited by the legislation.

Cost under construction is paid by the individual builder at the expense of soft mortgage loans of bank, own means of the individual builder, means of the legal entity who is the employer of the individual builder, and other sources which are not prohibited by the legislation for the approved standard project of the apartment house or available apartment house.

II. Procedure for selection and allocation of the parcel of land to individual builders for construction of individual housing

5. The engineering company together with Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas on the basis of marketing market research of housing and requests of the population annually till April 1 prepares by regions of the offer on the program of construction of apartment houses and objects of social infrastructure the next year.

6. The Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas annually till May 1, based on offers of engineering company and in coordination with Gosarkhitektstroy, Goskomzemgeodezkadastr of the Republic of Uzbekistan, perform the choice of the land arrays which are not entering category of lands of agricultural purpose and forest fund for construction of individual housing and objects of social infrastructure according to the approved standard projects.

At the same time annually till February 1 of the predicted year the cost of the standard apartment house is recalculated and passes in accordance with the established procedure the examination in state bodies of examination.

7. Gosarkhitektstroy of the Republic of Uzbekistan carries out complex expertize of the chosen land arrays regarding their security with engineering and transport communications, availability of the actual demand for the apartment house or the available apartment house and objects of social infrastructure.

After receipt of the positive conclusion of complex examination the right to lease of the parcel of land is exposed in accordance with the established procedure on electronic online auction.

The engineering company acquires the right to lease of the parcel of land through electronic online auction.

Expenses on acquisition of right to lease of the parcel of land join in the cost of housing which is under construction on the parcel of land and affordable housing, in proportion to the space occupied by them.

At the same time the expenses on acquisition of right to lease of the parcel of land included in the cost of affordable housing are compensated at the expense of the local budget of the respective area.

8. The parcel of land under individual housing construction according to the approved standard projects is provided on the property right without holding auctions and electronic online auctions in accordance with the established procedure to citizens of the Republic of Uzbekistan from the lands which are not entering category of lands of nonagricultural appointment and forest fund, in the amount of, established for standard projects of housing acquired by individual builders or affordable housing.

The contract between the individual builder and branch of engineering company is the basis on implementation of functions of the customer by engineering company on construction of housing or affordable housing on a turnkey basis for withdrawal of the parcel of land to the individual builder on the property right. The body for registration of the rights to real estate units registers the property right to the parcel of land based on this agreement.

At the same time agreement cancelation, this Item provided in the paragraph the second, attracts the termination also of the property right to the parcel of land allocated under individual housing construction according to standard projects. This condition needs to be specified in the agreement signed between the individual builder and branch of engineering company.

9. Information on the chosen land arrays engineering company for construction of individual housing annually till June 1 is brought to the attention of local population, entrepreneurs and the interested legal entities and physical persons through local mass media and self-government institutions of citizens.

III. Procedure and conditions of the conclusion of the agreement

10. The engineering company will organize all complex of works on construction of the apartment house or the available apartment house according to the approved standard project on a turnkey basis.

11. For the organization of construction of the apartment house or the available apartment house the individual builder addresses with the request to the relevant regional branch of engineering company at the place of residence.
