For the purpose of execution of provisions of the Law No. 64-XII of May 31, 1990 on the Government, with subsequent changes and amendments (repeated publication: The official monitor of the Republic of Moldova, 2002, Art. No. 131-133, 1018), DECIDES: the Government
1. Approve:
Regulations on the organization and functioning of the Ministry of Health according to appendix No. 1;
structure of central office of the Ministry of Health according to appendix No. 2;
the list of the organizations subordinated to the Ministry of Health, according to appendix No. 3;
the list of organizations under the Ministry of Health according to appendix No. 4;
the list of the companies which are in administration of the Ministry of Health, and shares (shares) of the commercial societies administered by the Ministry of Health according to appendix No. 5;
units and personnel on servicing of the building in number of 12 units with the annual salary fund according to the current legislation.
2. Establish the extreme number of central office of the Ministry of Health in number of 85 units and personnel on servicing of the building in number of 12 units with the annual salary fund according to the current legislation.
3. The Ministry of Health has 3 deputy ministers and the board consisting of 15 members which staff affirm the Government.

1. This Provision regulates tasks, functions, obligations and the rights of the Ministry of Health, and also the organization of its activities.
2. The Ministry of Health (further - the Ministry) is the central industry body of public management in the field of health protection, the legal entity and submits to the Government. The ministry has seal with the State Emblem of the Republic of Moldova and the name, and also treasurer accounts.
3. Financing of activities of the Ministry is performed at the expense of the government budget according to the legislation.
4. Tasks of the Ministry consist in preserving and permanent improvement of health of the population by ensuring equal access to high-quality and profitable medical services by support and encouragement of actions for the prevention of diseases, to protection and promotion of health.
5. The ministry performs the following main functions:
1) develops state policies and strategies in the field of health care for the short, medium-term and long-term period, mid-term budgetary forecasts and provides their accomplishment;
2) provides integration of priorities of public health in industry politicians and strategy, exercises supervision of health of the population and determines priorities in the field of public health;
3) provides legal regulation of health care system, in limits and according to the competences established by the legislation;
4) develops offers on the program of activities of the Government and projects legislative and regulations in the field of health care, draws the conclusions on projects legislative and regulations according to the legislation;
5) represents the interests of the state in the relations with the international structures and the organizations in the field of health care, develops the relations of cooperation with similar structures of other states and with the international organizations in the field of health care according to international treaties which party the Republic of Moldova is;
Initiates 6) and conducts negotiations, according to the authority given the Government, according to the conclusion of agreements or offers it new forms of accession to existing;
7) takes measures for implementation of international treaties in the field of health care, to creation of conditions on integration into the European structures or in other international organizations;
8) develops offers on the budget of health care and represents them in accordance with the established procedure, provides proper execution of the budget of the Ministry and subordinated organizations, systematizes and will promulgate information on budget implementation and on the achieved results;
9) performs other functions established by the law.
6. The ministry has the following obligations:
Analyzes 1), performs monitoring and estimates developed politicians, comprehensively researches their social, economic, financial and other impact, and also estimates risks for health depending on the relevant social, economic, behavioural, biological and ecological factors causing the state of health;
Analyzes 2) developed politicians for the purpose of ensuring their compliance to national strategy and programs and connects the existing politicians with priorities and needs of the European integration;
Estimates 3) and monitorizirut the state of health of the population with taking measures to its improvement and informs the Government on key indicators of health, on the tendency of development and measures necessary for their improvement;
4) is provided by supervision of accomplishment legislative and regulations the organizations, the companies and the organizations allocated with responsibility in the field of health care, health care insurance, public and private medical and sanitary institutions, cooperating for this purpose with other central and local authorities of public management, other authorized organizations and organizations, and also with professional associations;
5) the politician coordinates implementation, strategy and programs of public health at the national and local levels and the politician and strategy in public health for the purpose of the prevention of diseases, protection and promotion of health cooperates with representatives of the central and local authorities of public management, civil society, and also with mass media on realization;
6) provides by means of subordinated organizations identification, assessment and the message of risks for health, provides management of these risks, forecasting and decrease in negative impact of the identified risks on public health;
Coordinates 7), according to the legislation, the recovery medical care and medical care provided by sanatorium organizations and will be organized by control of medical care in sanatorium organizations;
8) develops national programs of public health, coordinates and monitorizirut their implementation, provides their realization, reasons and calculates financial requirements and determines procedure for their financing;
Approves 9):
the list of the diseases which are subject to the main specific treatment for which medicines, the consumable and other materials for medical appointment acquired at the expense of centralized means are used;
the list of socially caused diseases and diseases exerting negative impact on public health, the specific medical services rendered to some categories of uninsured patients including with life-threatening urgentny medico-surgical conditions at the levels of medical care, stipulated by the legislation, within means of the government budget for the corresponding year;
10) manages, according to the legislation, activities of Service of the state supervision of public health;
11) approves regulations of providing conditions of hygiene and control of intrahospital infections for medical and sanitary organizations;
12) provides state registration of substances and products according to the legislation;
Approves 13):
the list of professions, harmful production factors and works for which accomplishment medical examinations in case of revenues to work and periodic surveys are performed;
the list of the transmitted diseases which are subject to registration and notification;
14) is established by procedure for the organization of supervision of not transmitted diseases;
Approves 15):
the list of infectious diseases against which systematic preventive vaccination, and the list of risk groups is performed;
the list of especially dangerous diseases and other urgent situations in public health with possibility of the international distribution;
Provides 16):
laboratory support in investigation of the biological, chemical, physical and radiological factors influencing public health;
by means of subordinated organizations readiness for urgent situations of public health;
Represents 17) to the National extraordinary commission on public health and the Government of the offer on prevention and control of urgent situations of public health;
18) will be organized by use of Republican epidemiological fund;
19) is developed by intersectoral partnership for inclusion of the analysis of impact on health in all relevant national politicians according to recommendations of the European commission "Accounting of interests of health in all politicians" (Health in All Policies) for maximization of results in the field of health care;
20) will organize carrying out the analysis and periodic assessment of indicators of health of the population, activities of health care system and achievements of public medical and sanitary organizations, provides distribution of information which is of public interest;
21) is proved by the need for medical services, and also financial resources for functioning of health care system, using for this purpose official statistical data, reports and information provided by National medical insurance company, results of the researches conducted in the field for the purpose of reasons for the budget of health care and funds of compulsory medical insurance and also other relevant information;
Develops 22), in case of need, within the available financial resources of the amendment to the Single program of compulsory medical insurance and submits to the Government;
Annually develops 23) and approves together with National medical insurance company methodological regulations on application of the Single program;
24) is provided by monitoring of finance in the field of health care, including by means of accounts satellites in health care;
25) administers, according to the legislation, the international programs of financial aid for support of reform of health care system and improvement of quality of the medical care provided to the population;
Provides 26) within the means provided in the budget, purchase of the necessary medical equipment and vehicles for medical and sanitary healthcare institutions provides material and technical support and exercises control of effective and rational use of budgetary funds and the state-owned property which is in economic board of subordinated public medical and sanitary organizations;
27) will organize quality assurance of medical services and safety of the patient, assessment and accreditation of medical and sanitary and pharmaceutical organizations and applies measures for improvement of quality of the medical care provided to the population;
Develops 28) and approves, according to the legislation, standards of assessment and accreditation in health care;
Develops 29) and provides realization of policy of the state in the field of drugs;
30) takes measures for process improvement of public procurements of drugs, the equipment, consumable and other materials of medical appointment for needs of public medical and sanitary organizations;
31) the practician in the field of drugs at the level provides development and deployment of Rules proper: laboratories (Good Laboratory Practice), clinic (Good Clinical Practice), production (Good Manufacturing Practice), distribution (Good Distribution Practice), drugstores (Good Pharmaceutical Practice);
Approves 32):
compulsory provisions for scope of medical products also coordinates quality infrastructure in the field;
standards in scope of medical products according to requirements of the European Union;
prices of the producer of drugs;
National price catalog of the producer on drugs;
Provides 33):
the organization of assessment of conformity and market monitoring of medical products in the country;
registration of the prices of the producer for drugs in the National price catalog of the producer on drugs;
34) approves technical requirements to the medical products necessary at the different levels of delivery of health care by public medical and sanitary organizations;
35) also the procedure for data presentation by public and private medical and sanitary institutions for assessment of the state of health of the population will organize information system in the field of health care;
Estimates 36) and plans the needs for training of doctors, druggists and average medical personnel and makes necessary offers to the central industry body of public management;
37) develops strategies of preparation and professional development of medical and pharmaceutical personnel;
38) is provided by balance in formation of resources by rationalization of investments into preparation and uniform distribution of medical personnel and will organize together with bodies of local public authority and heads of organizations of action for providing with necessary human resources for activities of healthcare institutions;
Approves 39):
programs for continuous professional medical enhancement;
the list of specializations and narrow specializations for post-university medical and pharmaceutical education;
the annual plan of post-university study in residency, clinical internship and continuous professional medical enhancement of doctors, druggists and average medical personnel;
40) is confirmed by the right to activities of medical and pharmaceutical personnel and equates documents of post-university medical and pharmaceutical education;
41) approves methodology of employment of doctors, druggists and administrative board of public health care system;
Will organize 42):
according to the legislation, tenders on substitution of vacant positions of heads of medical and sanitary organizations; certification and assignment of categories to heads, doctors, druggists, average medical personnel and other employee categories of health care system;
43) is provided by informing and documentation of medical personnel on professional questions and supports the edition of publications in the specialty and on professional informing;
44) is supported by activities of professional associations in the field of health care and promote their development;
45) develops the framework methodology of cooperation between public medical and sanitary organization and university clinic;
46) participates in development by medical department of Academy of Sciences of Moldova of strategic scientific research in the field of medicine and pharmacy;
Approves 47):
standard regulations on the organization and functioning of medical and sanitary organizations;
the list of medical and sanitary organizations, irrespective of type of property and form of business;
to organigramm of public health services on places;
organigramma, regulations on the organization and functioning of subordinated organizations if other is not established by the law;
staff list of subordinated budgetary institutions;
reorganization, change of the location and name of subordinated public medical and sanitary organizations;
according to the legislation, standard rates of personnel of public medical and sanitary organizations;
48) approves organizational structure of the medical and sanitary organizations subordinated to the central industry bodies of public management with autonomous medical network;
49) develops offers on methodological regulations of designing of the income and expenditure budget of public medical and sanitary organizations;
50) approves incomes and expenditure budgets of the subordinated organizations financed from own income;
Approves 51) and approves, as necessary, designing and development of investments in the field of health care in subordinated medical and sanitary organizations;
52) will be organized by activities for internal public audit according to the current legislation;
53) fulfills the rights and duties of the state from the shareholder's line items in joint-stock companies;
Considers 54), according to competence, the petition of citizens, takes adequate measures, will organize reception of citizens on the questions relating to health care system;
55) cooperates with the central industry bodies of public management, bodies of local public authority, industry public organizations, structures of civil society and business community of the country and from abroad for the purpose of accomplishment of functions and execution of the powers connected with planning and enforcement of some cross-industry actions and realization of public and private partnership;
56) carries out also other powers established by regulations in the field of the activities.
7. The ministry has the following rights:
1) to require and receive, according to the legislation, information from the central industry bodies of public management, bodies of local public authority, public organizations and private legal entities;
2) to centralize money from the overall appropriations provided in the government budget for the corresponding year for health sector including by delegation in accordance with the established procedure to subordinated organizations, for the purpose of implementation of national programs and target industry programs;
3) to demand from National medical insurance company information on the list and number of the contracted suppliers, amount of the contracted services depending on level and profile of medical care, results of assessment and performed and about the amounts which are actually translated to suppliers;
4) to confer, as necessary, powers to subordinated organizations for accomplishment of some actions for achievement of effective objectives;
5) to cooperate with specialized agencies on preparation and advanced training of staff of central office of the Ministry;
To publish 6), as necessary, information publications in the field of health care.
8. The Minister of Health directs the ministry.
1) Minister:
a) manages all activities of the Ministry, resolves the issues entering competence of the Ministry, bears the personal responsibility for accomplishment of the Program of activities of the Government, orders of the Prime Minister, according to functional competences of the Ministry;
b) provides accomplishment of the laws, presidential decrees of the Republic of Moldova, ordinances and orders of the Government, as well as other regulations, international treaties which party the Republic of Moldova is;
c) is primary contractor of the budget and, according to the legislation, it is given responsibility and the right to make expenses according to the approved assignments;
d) issues orders, orders, instructions and other regulations and will organize control of their accomplishment according to the legislation;
e) submits to the Government activities reports of the Ministry of accomplishment of the Program of activities of the Government and about measures for its realization, and also upon the demand of the Prime Minister submits reports on the activities;
f) constantly promotes increase in efficiency of activities of the Ministry and the politician coordinates activities for the analysis, monitoring and assessment;
g) claims or, as necessary, makes changes to manpower ceiling of central office of the Ministry, and also to the staff list of its personnel within salary fund and the extreme number of staff;
h) represents to the Government, according to the legislation, offers on appointment or dismissal of deputy ministers, and also on application to them disciplinary and incentive actions;
i) represents the Ministry in the relations with other public bodies of the country and from abroad, and also with other persons;
j) appoints to position, changes, stops and stops employment relationships, according to the legislation, government employees, employs and dismisses other personnel of central office of the Ministry;
k) employs and dismisses heads of subordinated organizations, heads of the state companies which are in administration of the Ministry and signs with them agreements on management;
l) distributes tasks and powers, determines obligations of deputy ministers, heads of internal divisions of central office of the Ministry and subordinated organizations, except for those which are established by legal acts;
m) approves regulations on internal divisions of central office of the Ministry and subordinated organizations if the law does not provide other;
n) carries out other powers according to the legislation.
In the absence of the minister its functions are performed by the deputy minister appointed the minister.
With activities for management of the Ministry the minister is helped by three deputy ministers.
2) Deputy ministers:
a) coordinate, it agrees to the obligations established by the minister, activities of divisions of central office of the Ministry, the deconcentrated public services and organizations subordinated to the Ministry provide operational cooperation between the minister and their heads;
b) cooperate with divisions of the State office, deputy ministers from other ministries of questions, of common interest;
c) watch and provide completion of draft documents of state policies and projects legislative and the regulations represented to the Government at the initiative of the Ministry;
d) coordinate, it agrees to the obligations established by the minister, activities for development of personnel policy and the principles of management of personnel of structural divisions of the Ministry;
e) can carry out also other powers provided by Regulations on the Ministry or assigned by the minister.
9. The office which part are helps to perform the powers to the minister: the chief of office, advisers and other personnel which services activities of the minister.
10. In the Ministry the board into which the minister (the chairman of board), deputy ministers, other heads of internal divisions of central office of the Ministry, and also prominent scientists and specialists in the field of public health enter is created. The staff of board affirms the Government. The board is convoked upon the demand of the Minister of Health for discussion of questions of activities of the Ministry.
The board considers at the meetings questions of the organization of activities of the Ministry of promotion of state policy in the field of health care, structural transformations of health care system, according to the problem resolution of public health, discusses the questions concerning activities of the organizations subordinated to the Ministry, exercises control over the implementation of decisions, matching and use of personnel, considers projects legislative and regulations, discusses reports and reports of heads of internal divisions of central office of the Ministry and organizations subordinated to it.
In the activities the board is guided by provision which affirms the order of the Minister of Health. Decisions of board are made by a simple majority vote his members of attendees at meeting of board, and its decision realized, the order of the minister.
11. The right of the first signature on all documents of the Ministry belongs to the Minister of Health.
In the absence of the minister the right of the first signature is allocated for one of his deputies appointed by the order of the minister.
According to the current legislation, some documents of the Ministry can be signed by other responsible persons of health care system.
Deputy ministers of health care, heads of internal divisions of central office of the Ministry and other persons have the right to sign documents of the Ministry on the basis of the order of the minister or with special powers.
The signature on documents of the Ministry is appended in writing or, according to the legislation, can have also other forms (electronic, etc.).
12. For development of some specific projects or accomplishment of special functions, the Ministry can create the ad hoc commissions, working groups, advisory councils consisting of specialists for certain terms.
