Article 1. The main characteristics of the budget of the Pension Fund of the Russian Federation for 2010 and for planning period of 2011 and 2012

1. Approve the main characteristics of the budget of the Pension Fund of the Russian Federation (further - Fund) for 2010:

1) the predicted total amount of budget receipts of Fund in the amount 4 688 859 069, 1 thousand rubles, from them 4 272 152 625, 5 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions including at the expense of the interbudget transfers received from the federal budget in the amount 2 538 867 597, of 4 thousand rubles and budgets of subjects of the Russian Federation in the amount 4 451 818, of 4 thousand rubles;

2) the total amount of expenses of the budget of Fund in the amount 4 406 858 555, 7 thousand rubles, from them 4 272 160 417, 3 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions, including the interbudget transfers transferred to budgets of subjects of the Russian Federation in the amount of the 79th 000, of 0 thousand rubles;

Limiting 3) amount of budget surplus of Fund in the amount 282 008 305, 2 thousand rubles in the part connected with forming of means for financing of funded portion of work pensions and limiting amount of budget deficit of Fund in the amount of the 7th 791, 8 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions.

2. Approve the main characteristics of the budget of Fund for planning period of 2011 and 2012:

1) the predicted total amount of budget receipts of Fund for 2011 in the amount 5 264 012 750, 4 thousand rubles, from them 4 778 816 648, 8 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions including at the expense of the interbudget transfers received from the federal budget in the amount 2 145 896 214, by 1 thousand rubles and budgets of subjects of the Russian Federation in the amount 5 005 961, of 2 thousand rubles and for 2012 in the amount 5 779 164 893, 4 thousand rubles, from them 5 215 468 969, 2 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions including at the expense of the interbudget transfers received from the federal budget in the amount 2 355 113 910, of 2 thousand rubles and budgets of subjects of the Russian Federation in the amount 5 483 145, of 4 thousand rubles;

2) the total amount of expenses of the budget of Fund for 2011 in the amount 4 894 370 349, 6 thousand rubles, from them 4 778 816 648, thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions, including the interbudget transfers transferred to budgets of subjects of the Russian Federation in the amount of the 85th 000, of 0 thousand rubles and for 2012 in the amount 5 360 297 548, 0 thousand rubles, from them 5 215 468 969, 2 thousand rubles in the part which is not connected with forming of means for financing of funded portion of work pensions including the interbudget transfers transferred to budgets of subjects of the Russian Federation in the amount of 81 000 thousand rubles;

Limiting 3) amount of budget surplus of Fund for 2011 in the amount 369 642 400, 8 thousand rubles in the part connected with forming of means for financing of funded portion of work pensions and limiting amount of budget surplus of Fund for 2012 in the amount 418 867 345, 4 thousand rubles in the part connected with forming of means for financing of funded portion of work pensions.

3. Determine that in 2010 source of financing of budget deficit of Fund in the part which is not connected with forming of means for financing of funded portion of work pensions is change of remaining balance of means on accounts on accounting of budget funds of Fund during 2009 as of January 1, 2010 in the part which is not connected with forming of means for financing of funded portion of work pensions.

Article 2. Chief managers of budget receipts of Fund and chief managers of sources of financing of budget deficit of Fund

1. Approve the list of chief managers of budget receipts of Fund according to appendix 1 to this Federal Law.

2. Approve the list of chief managers of sources of financing of budget deficit of Fund according to appendix 2 to this Federal Law.

3. Determine that in case of change in 2010 of structure and (or) functions of chief managers of budget receipts of Fund or chief managers of sources of financing of budget deficit of Fund, and also change of the principles of appointment and assignment, structure of codes of classification of the income of budgets of the Russian Federation and classification of sources of financing of deficits of budgets corresponding changes in the lists approved by parts 1 and 2 of this Article are reflected in the performance report of the budget of Fund for 2010 based on regulatory legal act of the Ministry of Finance of the Russian Federation.

4. Determine that the chief manager of budget receipts of Fund regarding the insurance premiums for mandatory pension insurance in the Russian Federation enlisted in Fund for settlement periods from 2002 to 2009 inclusive is the Federal Tax Service.

Article 3. Sources of internal financing of budget deficit of Fund

Approve sources of internal financing of budget deficit of Fund for 2010 and for planning period of 2011 and 2012 according to appendix 3 to this Federal Law.

Article 4. Budgetary appropriations of the budget of Fund for 2010

1. Approve distribution of budgetary appropriations of the budget of Fund for 2010 for Sections and subsections, target articles and expense types of classification of expenses of the budget according to appendix 4 to this Federal Law.

2. Approve the total amount of the budgetary appropriations directed by Fund to execution of public normative obligations, for 2010 in the amount 4 206 778 580, to 1 thousand rubles.

Article 5. Interbudget transfers to the budget of Fund and from the budget of Fund to other budgets of budget system of the Russian Federation

1. Approve distribution of the budgetary appropriations provided at the expense of interbudget transfers from the federal budget and budgets of subjects of the Russian Federation for 2010 according to appendix 5 to this Federal Law.

2. Approve distribution of interbudget transfers from the budget of Fund to other budgets of budget system of the Russian Federation for 2010 according to appendix 6 to this Federal Law.

3. Determine that I will eat around the budgetary appropriations provided at the expense of the interbudget transfers from the federal budget for 2010 provided by appendix 5 to this Federal Law on implementation of monthly money payments to veterans, disabled people, to the citizens who were affected by radiation owing to radiation accidents and nuclear testing is subject to reduction by amount of the means intended on monthly money payment to the citizens who are passing military and law-enforcement service in the Ministry of Defence of the Russian Federation, the Ministry of Internal Affairs of the Russian Federation, Federal Security Service of the Russian Federation, Russian Foreign Intelligence Service, Federal Guard Service of the Russian Federation, having the right to monthly money payment, and also to monthly money payment to the citizens who were passing military service in Federal Security Service of the Russian Federation, having the right to monthly money payment with the corresponding modification of indicators of summary budget list of the budget of Fund.

5. Determine that in 2010 financial provision of expenses on realization of item 4 of the Resolution of the Supreme Council of the Russian Federation of January 15, 1993 N 4302-I "About procedure for enforcement of the Law of the Russian Federation "About the status of Heroes of the Soviet Union, Geroyev of the Russian Federation and complete gentlemen of award of Glory" is performed within the interbudget transfers from the budget of Fund to other budgets of budget system of the Russian Federation provided by appendix 6 to this Federal Law on social support of Heroes of the Soviet Union, Heroes of the Russian Federation and complete gentlemen of award of Glory.

Determine that financial provision of payment of federal social pension supplement, provisions of the maternity (family) capital and other social payments in case of insufficiency in course of execution of the budget of Fund in 2010 of the budgetary appropriations provided at the expense of the interbudget transfers from the federal budget for 2010 provided by appendix 5 to this Federal Law, and also financial provision of additional payment commitments on implementation of measures for social security of the population and other measures of social protection are performed by Fund in 2010 at the expense of the interbudget transfers from the federal budget provided on the specified purposes with entering of corresponding changes into summary budget list of the budget of Fund.

7. Determine that financial provision of payment commitments on compensation of the losses which arose in case of investment by Fund of the amounts of the insurance premiums for financing of funded portion of work pension which arrived in Fund for 2008, considered in special part of individual personal accounts of insured persons and subjects to transfer to trust management to managing companies and to non-state pension funds, and costs for fee of bodies (organizations) with which the Fund signs agreements on mutual signature witnessing, on acceptance and transfer electronically to Fund of statements of insured persons for the voluntary introduction to legal relationship for mandatory pension insurance for the purpose of payment of additional insurance premiums for funded portion of work pension and copies of the payment documents confirming payment of additional insurance premiums for funded portion of work pension are performed by Fund in 2010 at the expense of the interbudget transfers from the federal budget provided on the specified purposes.

8. Permit Fund to perform in 2010 provision of subsidies to budgets of subjects of the Russian Federation on the social programs of subjects of the Russian Federation connected with strengthening of material and technical resources of organizations of social servicing of the population and rendering the address public assistance to the unemployed pensioners who are receivers of work old-age pensions and on disability, in the amount up to 1 000 000, 0 thousand rubles with entering of corresponding changes into summary budget list of the budget of Fund for 2010 and reflection of the specified expenses in the performance report of the budget of Fund for 2010.

Determine that financial provision of the actions specified in part 8 of this Article is performed according to the procedure, established by the Government of the Russian Federation, due to additional receipts of the amounts of shortage on fees in Fund formed for January 1, 2001, the amounts of penalty fee and other financial sanctions on the specified fees, the amounts of penalty fee and other financial sanctions on insurance premiums for insurance part of work pension, and also cash penalties (penalties) for violation of the law of the Russian Federation about state non-budgetary funds and about specific types of compulsory social insurance, the budget legislation (regarding the budget of the Pension Fund of the Russian Federation).

10. Determine that in case of origin in course of execution of the budget of Fund in 2010 the needs for the budgetary appropriations provided at the expense of interbudget transfers from the federal budget on covering of budget deficit of Fund for the part which is not connected with forming of means for financing of funded portion of work pensions over provided by appendix 5 to this Federal Law to Fund are transferred to the additional budgetary appropriations specified to the purpose provided at the expense of interbudget transfers from the federal budget.

The fund having the right in 2010 in case of incomplete use of the budgetary appropriations provided at the expense of the interbudget transfers from the federal budget on financial provision of valorization of size of the settlement pension capital provided by appendix 5 to this Federal Law to perform financial provision of expenses on compensation payments to persons performing care of disabled citizens in case of the insufficiency of budgetary appropriations on the specified purposes formed in course of execution of the budget of Fund in 2010 with entering of corresponding changes into summary budget list of the budget of Fund.
