ORDER OF THE MINISTRY OF DEFENCE OF UKRAINE MINISTRIES OF TRANSPORT AND COMMUNICATIONS OF UKRAINE

About approval of the Instruction for creation of requests for use of airspace during planning of carrying out the corresponding type of activity

(as amended of the Order of the Ministry of Defence of Ukraine of 09.07.2015 No. 324/259)

On accomplishment of Item 59 of the Regulations on use of the airspace of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 29, 2002 No. 401 (with changes), and for the purpose of implementation of single formats and procedure for submission of requests and automation of planning process of use of airspace we ORDER:

1. Approve the Instruction for creation of requests for use of airspace during planning of carrying out the corresponding type of activity which is attached.

2. Consider such which are not applied in the territory of Ukraine since January 1, 2010, the "Instruction for creation of the formalized requests for airfield, route and route flights of aircrafts" enacted by the order of the commander-in-chief of the Air Force of March 16, 1981 No. 54, the "Instruction for creation of the formalized requests for use of airspace of the USSR in case of starts of aerostats (sounding balloons), carrying out firing practice, missiles launches, explosive works" enacted by the order of the commander-in-chief of the Air Force of December 4, 1984 No. 288, and the order of the Minister of civil aviation of the USSR of April 28, 1978 No. 72 "About approval of the Instruction for scheduling of flight and the Preliminary plan of flight (the formalized request) for flights of aircrafts of all departments on inner-union and international airways and local air-lines".

3. To provide to the Ministry of Defence of Ukraine submission in accordance with the established procedure of this order on state registration in the Ministry of Justice of Ukraine.

4. Distribute the order according to mailing calculation.

5. This order becomes effective since January 1, 2010.

The instruction for creation of requests for use of airspace during planning of carrying out the corresponding type of activity

1. General provisions

1.1. The instruction for creation of requests for use of airspace during planning of carrying out the corresponding type of activity (further - the Instruction) determines rules of forming and submission due dates of requests for use of airspace of Ukraine, and also the international airspace which is under responsibility of Ukraine (further - airspace), during planning of carrying out the corresponding type of activity.

1.2. Requirements of this Instruction are obligatory for accomplishment by bodies which are part of divisions of the joint civil and military system of air traffic management of Ukraine (further - OGVS), legal entities and physical persons which use airspace during the corresponding type of activity.

1.3. This Instruction provides formalization of requests that provides their automatic processing with the automated system.

1.4. This Instruction determines form and procedure for creation of such types of requests for use of airspace (further - IVP):

the request for IVP during firing practice, missiles launches, explosive works on the schedule and during starts (rises) unmanned balloons (sounding balloons), aerostats;

the request for IVP during one-time carrying out firing practice, missiles launches, explosive works in the established zones out of the schedule, during firing practice and missiles launches for the purpose of implementation of active influence on meteorological processes and during planning of use of temporarily reserved airspace, including during execution of educational and training and test flights in the certain areas published in documents of aeronautical information of Ukraine and/or in instructions for accomplishment of flights (use of airspace) in areas of airfields, airfields (further - certain area);

the request for IVP during execution of educational and training and test flights, including along specially established routes published in documents of aeronautical information of Ukraine and/or in instructions for accomplishment of flights (use of airspace) in areas of airfields, airfields (further - certain route);

the request for IVP during execution of flights of aircrafts out of OPR routes;

the request for the runway during execution of aviation works.

1.5. Determination of terms and reducing

1.5.1. Determination of terms:

permission to IVP - the official report about provision to the user of airspace of permission for activities implementation according to the procedure who is determined by the relevant division of body of OGVS;

the operator - legal entity or physical person which operates aircrafts or provides services in this industry;

general air traffic (GAT) - flights of aircrafts and other aircraft which are carried out according to civil rules and/or standards and the recommended practice of IKAO;

the request for IVP - the message of the established form which is provided by the user of airspace in corresponding to division of OGVS for receipt of the appropriate rights to IVP;

zone of restriction of flights (R-zone) - part of airspace over the overland territory or territorial waters where flights of aircrafts are limited;

the user of airspace - legal entity or physical person which has the right to perform the activities connected with IVP;

the danger area (D-zone) - part of airspace within which during certain periods of time activities which are dangerous to flight of aircrafts can be performed;

operational air traffic (OAT) - flights to which the provisions established for general air traffic and which are carried out according to the rules and procedures determined by the relevant authorized bodies do not extend;

body of OGVS - the relevant division, powers and which activities are connected with air traffic management in airspace of Ukraine and in the international airspace which is under responsibility of Ukraine;

flight plan (FPL) - the established information on the planned flight or parts of flight of the aircraft which are provided to bodies of OPR;

the district dispatch center (DDC) - the body intended for ensuring dispatching servicing of controlled flights in dispatching areas which are under its control;

specially established route - the route intended for accomplishment of flights of aircrafts for the purpose of the solution of special tasks (flight of fighting aircraft, check of forces on duty of air defense of the Armed Forces of Ukraine, conducting exercises of military aircraft, accomplishment of experimental flights, flights according to international treaties and so forth), and also accomplishment of educational and training flights, flights on carrying out aviation works and so forth;

temporarily reserved airspace (TSA, TRA) part of airspace within which in certain time the activities constituting threat for accomplishment of flights of aircraft or for IVP in other purposes can be performed.

1.5.2. Reducings:

ANI - aeronautical information;

IVP - use of airspace;

IKAO - International Civil Aviation Organization;

Department of Internal Affairs - servicing of air traffic;

OGVS - Joint civil military system of air traffic management of Ukraine;

AF - the aircraft;

RDTs - district dispatch center;

RPI - the region of flight information;

Ukraerotsentr - the Ukrainian center of planning of use of airspace of Ukraine and regulation of air traffic;

TsDS of HECTARE - Central dispatching service of civil aviation (operational body of the state aviation power of Ukraine);

AFTN - the aviation fixed network of telecommunication (land cable network);

AIP - the collection of aeronautical information;

D-zone - the danger area;

GAT - general air traffic;

FPL - flight plan;

OAT - operational air traffic;

R-zone - zone of restriction of flights;

TSA - temporarily isolated area;

TRA - temporarily reserved area;

UTC - world-wide coordinate time.

2. General procedure for creation and submission of requests for IVP

2.1. The users of airspace interested in IVP during planning of carrying out the corresponding type of activity shall submit the application for IVP according to requirements of the Regulations on use of the airspace of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 29, 2002 No. 401 (with changes) (further - Regulations on use of airspace of Ukraine), and this Instruction.

Responsibility for creation and timely submission of requests for IVP is assigned to users of airspace.

2.2. Requests for IVP are cancelled if they are drawn up with gross blunders or are submitted after fixed term about what it is reported to the corresponding users of airspace.

Discrepancy of parameters of activities to the parameters published in documents ANI and incomprehensibility of the text belong to gross blunders.

2.3. The request is constituted by Latin letters and moves by means of AFTN, mail service, e-mail, phone, the telefax and so forth. Messages which are transferred by AFTN network shall be constituted with observance of format of cable messages.

2.4. Each type of the request is constituted with observance of accurately established form. The request consists of fields. Each field consists of two parts:

the syntactic word which is sign of this field;

information part of the field.

2.5. Each field of the request begins with the obligatory syntactic word to which one dash precedes ("-") (except for types of the requests specified in Items 3 and 6 of this Instruction). The dash symbol ("-") is indicator of the beginning of the field therefore in other cases it is forbidden to be applied.

Depending on field type the fields this to information part have one of three types:

digital (figure 0-9);

alphabetic (Latin letters A-Z);

alphanumeric (combination of the first two types).

Other special symbols are not applied.

Exception is the field COMMENT (additional information) where special symbols can be also applied: gap ()?:., "= +/.

2.6. The lower and upper borders of zone and/or route shall be in the limits published in documents ANI or determined by the instruction for accomplishment of flights (use of airspace) around airfield, the airfield.

2.7. For provision of data on the lower and upper borders of the amount of airspace of the established zone and/or route planned for use such rules of grouping of data are used:

"F" with the subsequent three decimal figures - for designation of number of echelon of flight, for example echelon of flight 330 is specified as "F330";

"A" with the subsequent three decimal figures - for designation of absolute height in hundreds of feet, for example height of 10000 feet is specified as "A100";

"M" with the subsequent four decimal figures - for designation of absolute height in tens of meters, for example absolute height of 1400 m is specified as "M0140";

"GND" is used for designation of the lower bound if activities are carried out from the level of the land surface;

"UNL" is used for designation of the upper bound if activities are not limited on height.
