1. Management of legal examination and international treaties (further - Management) is the structural division of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan performing ensuring activities of the Cabinet of Ministers of the Republic of Uzbekistan, its Presidium, Executive office of the Cabinet of Ministers of the Republic of Uzbekistan concerning legal study of drafts of regulatory legal acts and international treaties, and also control and monitoring of accomplishment of international treaties.
2. Management in the activities is guided by the Constitution of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan "About the Cabinet of Ministers of the Republic of Uzbekistan" and other laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, Decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, and also this Provision.
3. Exercises control the activities under the direction of Premieres - the minister of the Republic of Uzbekistan.
Management is subordinated to the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan.
4. Exercises control the activities in interaction with the relevant services of counselors of state of the President of the Republic of Uzbekistan, committees of chambers of Oliy Majlis of the Republic of Uzbekistan, structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, bodies of the public and economic board, public authorities on places, other bodies and the organizations.
5. The main objectives of Management are:
the organization of comprehensive legal examination of drafts of the legal and other regulatory legal acts introduced in the Cabinet of Ministers of the Republic of Uzbekistan by bodies of the public and economic board, participation in preparation of drafts of legal acts, decrees, resolutions and orders of the President of the Republic of Uzbekistan, solutions of the Office by the Minister of the Republic of Uzbekistan;
the organization of development and implementation of plans of bill work of the Government of the Republic of Uzbekistan, ensuring interaction with chambers of Oliy Majlis of the Republic of Uzbekistan and their committees on the bills and other questions brought by the Government of the Republic of Uzbekistan;
organization of carrying out expert study of drafts of international treaties and offers on feasibility of signing, accession, ratification and approval of international treaties, participation in preparation of drafts of international treaties of the Republic of Uzbekistan;
ensuring compliance with economic interests and the external economic safety of the Republic of Uzbekistan by preparation of international treaties,
forming and maintaining the systematized databank and monitoring of implementation of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan.
6. For accomplishment of the tasks assigned to it exercises Control the following functions:
a) in the field of the organization of legal examination of drafts of legal and other regulatory legal acts, legal support of activities of the Cabinet of Ministers of the Republic of Uzbekistan:
carries out legal expertize of drafts of the laws of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, drafts of decisions of the Cabinet of Ministers of the Republic of Uzbekistan and performs preparation of the conclusions about compliance of their Constitution and the legislation of the Republic of Uzbekistan, and also requirements of rules of the legislative equipment;
participates in preparation and performs preparation of drafts of legal acts, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decisions of the Cabinet of Ministers of the Republic of Uzbekistan;
develops offers on reduction of the legislation in compliance with the Constitution and the laws of the Republic of Uzbekistan, about ensuring systemacity and integrity of legal regulation;
analyzes and generalizes suggestions for improvement of the legislation and submits them for consideration of the Prime Minister of the Republic of Uzbekistan, his deputies, Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
keeps systematic account of acts of the legislation, will organize help work on the legislation;
together with other structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, relevant organs of the public and economic board, others
the interested organizations in accordance with the established procedure performs preparation and participates also to preparation of interpretation and explanations on application of government decisions and submits them for consideration of Presidium of the Cabinet of Ministers of the Republic of Uzbekistan, the Prime Minister of the Republic of Uzbekistan, his deputies, Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
advises according to legal issues of the Prime Minister of the Republic of Uzbekistan, his deputies, Managing Executive office and structural divisions of Executive office of the Cabinet of Ministers by preparation of drafts of acts of the legislation, decisions of the government and interdepartmental commissions, councils and organizing committees headed by the Prime minister of the Republic of Uzbekistan and his deputies;
takes the measures directed to improvement of providing structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, his specialists by texts of regulatory legal acts, and also reference materials on the legislation;
participates in preparation of materials and execution of the decisions made at the meetings held by the President of the Republic of Uzbekistan, Premieres - the minister of the Republic of Uzbekistan and his deputies;
performs legal examination of drafts of orders of the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, participates in preparation of the legal documents connected with activities of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
together with General department of the Cabinet of Ministers of the Republic of Uzbekistan prepares for the Collection of the Orders of the Government of the Republic of Uzbekistan edition;
considers appeals of physical persons and legal entities and prepares offers on the solution of the questions raised in them, sends these appeals to relevant organs of the public and economic board, public authorities on places for consideration and taking measures, controls their timely consideration, performs acceptance of physical persons and representatives of legal entities;
b) in the field of the organization of bill work of the Government of the Republic of Uzbekistan:
together with the Ministry of Justice of the Republic of Uzbekistan, other bodies, structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan submits for consideration of the Prime Minister drafts of plans of bill work of the Government;
will organize monitoring of implementation of plans of bill work of the Government, systematic informing Presidium of the Cabinet of Ministers of the Republic of Uzbekistan on condition of implementation of the specified plans;
will organize development and submission in accordance with the established procedure to Oliy Majlis of the Republic of Uzbekistan of bills on the questions entering competence of Management;
interacts with committees of chambers of Oliy Majlis of the Republic of Uzbekistan, participates in discussion of the bills introduced by the Government of the Republic of Uzbekistan by them coordinates activities of representatives from the Cabinet of Ministers of the Republic of Uzbekistan for the relevant bills;
coordinates work of information analysis departments of the Cabinet of Ministers on discussion of bills in chambers of Oliy Majlis of the Republic of Uzbekistan;
c) in the field of the organization of carrying out expert study of drafts of international treaties and offers on feasibility of signing, accession, ratification and approval of international treaties:
together with the relevant structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan will organize in accordance with the established procedure expert study of drafts of international treaties and questions of feasibility of signing, accession, ratification and approval of international treaties;
interacts with the Ministry of Foreign Affairs, the Ministry of Foreign Economic Relations, Investments and Trades, the Ministry of Finance, the Ministry of Justice of the Republic of Uzbekistan and other ministries and departments in questions of preparation and approval of drafts of international treaties;
according to orders of the Cabinet of Ministers of the Republic of Uzbekistan, Presidium of the Cabinet of Ministers of the Republic of Uzbekistan, the Prime Minister of the Republic of Uzbekistan, Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan performs preparation, participates in preparation of drafts of the international treaties of the Republic of Uzbekistan which are subject to signing during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
at the request of the Prime Minister of the Republic of Uzbekistan or his deputies participates in meetings of the intergovernmental commissions and committees headed by the Prime Minister of the Republic of Uzbekistan and his deputies on the questions falling within the scope of conducting Management;
participates in negotiations with representatives of the governments of foreign states, the international organizations for preparation and the conclusion of international treaties of the Republic of Uzbekistan;
d) in the field of ensuring compliance with economic interests and the external economic safety of the Republic of Uzbekistan by preparation of international treaties:
together with the relevant structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan will organize in accordance with the established procedure expert study and preparation of the conclusions according to drafts of international treaties regarding providing
respect for economic interests and external economic safety of the Republic of Uzbekistan;
interacts with the relevant ministries and departments in questions of ensuring compliance with economic interests and the external economic safety of the Republic of Uzbekistan by preparation and approval of drafts of international treaties;
according to orders of the Cabinet of Ministers of the Republic of Uzbekistan, Presidium of the Cabinet of Ministers of the Republic of Uzbekistan, the Prime Minister of the Republic of Uzbekistan, Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan participates in preparation of drafts of the international treaties which are subject to signing during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
participates in negotiations with representatives of the governments of foreign states, firms, the companies and non-governmental organizations, international organizations for preparation and the conclusion of agreements;
e) in the field of forming and maintaining the systematized databank and monitoring of implementation of international treaties of the Republic of Uzbekistan:
performs collection, generalization and analytical information processing concerning implementation of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
provides forming, maintaining and regular updating of the systematized databank of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
interacts with the Ministry of Foreign Affairs, the Ministry of Foreign Economic Relations, Investments and Trades, the Ministry of Finance, the Ministry of Justice of the Republic of Uzbekistan and other ministries and departments in questions of forming of the systematized databank and analytical base of condition of accomplishment of obligations according to the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
according to the Law of the Republic of Uzbekistan "About international treaties of the Republic of Uzbekistan" together with the Ministry of Foreign Affairs and other ministries and departments will organize monitoring of the course of implementation of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
prepares analytical and reference materials concerning implementation of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan.
Exercises control also other functions assigned to it in accordance with the established procedure.
7. For accomplishment of the assigned tasks and the Management functions has the right;
in accordance with the established procedure to receive and request from other structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, bodies of the public and economic board, public authorities on places, other bodies and the organizations required materials and data;
carry out, for the purpose of study and preparation of the corresponding materials and draft documents, meeting with participation of heads and representatives of bodies of the public and economic board, public authorities on places, other bodies and the organizations;
at the request of the Prime Minister of the Republic of Uzbekistan, Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan to participate in meetings and meetings of state bodies, bodies of economic board, non-state non-profit and other organizations;
attract in need of established procedure to study of the questions considered in the Cabinet of Ministers of the Republic of Uzbekistan, heads and representatives of bodies of the public and economic board, scientific institutions and other organizations, to create working groups for these purposes;
return, if necessary, the documents which arrived in defiance of requirements of the Law of the Republic of Uzbekistan "About the Cabinet of Ministers of the Republic of Uzbekistan" and Regulations of the Cabinet of Ministers of the Republic of Uzbekistan.
8. The management bears responsibility:
for proper and effective implementation of the tasks and functions assigned to it;
for complexity and quality of legal examination of the drafts of the legal and other regulatory legal acts prepared and submitted by the Government for consideration of the President of the Republic of Uzbekistan and chambers of Oliy Majlis of the Republic of Uzbekistan, and also accepted by the Cabinet of Ministers of the Republic of Uzbekistan;
for ensuring monitoring of the course of implementation of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
for ensuring performing discipline according to the resolution of the Cabinet of Ministers of January 12, 1999 N 12 "About measures for strengthening of performing discipline".
9. The department of legal examination and department of examination and monitoring of implementation of international treaties are part of Management.
The management structure includes the head of department, the head of department of legal examination, the head of department of examination and monitoring of implementation of international treaties, the chief and leading experts on appropriate questions, and also two inspectors.
The management structure affirms the President of the Republic of Uzbekistan.
10. The chief directs work of Management.
11. The chief, managers of departments and specialists of Management are appointed and dismissed in accordance with the established procedure.
For employees of Management length-of-service allowances and surcharges to official pay rates, the class ranks appropriated still to place of employment remain. Operating time in Management joins in the length of service necessary for receipt of class ranks and length-of-service allowances.
At the same time the covering of the expenses directed to payment of length-of-service allowances and surcharges to official pay rates is performed at the expense of means of the Government budget of the Republic of Uzbekistan.
12. Work of Management will be organized according to the Constitution of the Republic of Uzbekistan and the Law of the Republic of Uzbekistan "About the Cabinet of Ministers of the Republic of Uzbekistan", Regulations of the Cabinet of Ministers of the Republic of Uzbekistan, this Provision, the Instruction but to clerical work in Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, orders of the President of the Republic of Uzbekistan, the Prime minister of the Republic of Uzbekistan, orders and orders of Managing Executive office of the Cabinet of Ministers, and also on the basis of work plans of the Cabinet of Ministers, work plans of Management, individual work plans of the chief, managers of departments and specialists.
Work plans of Management and the individual work plan of the head of department affirm the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan.
Individual work plans of managers of departments and specialists affirm the head of department.
Activities of Management for ensuring system monitoring of the course of implementation of the laws of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, government decisions in bodies of the public and economic board, the organizations, executive bodies on places will be organized by carrying out complex studying according to the work plan of the Cabinet of Ministers, and also according to orders of the Prime Minister of the Republic of Uzbekistan and his deputies, with hearing of reports at cabinet meetings, Presidium of the Cabinet of Ministers, Management and maintaining the corresponding databank.
13. Head of department:
performs direct management of Management, will organize work of managers of departments, specialists and bears the personal responsibility for accomplishment of the tasks and functions assigned to Management, condition of performing discipline;
provides the organization of comprehensive legal examination of drafts of the legal and other regulatory legal acts introduced in the Cabinet of Ministers of the Republic of Uzbekistan by bodies of the public and economic board and also preparation of drafts of legal acts, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decisions of the Cabinet of Ministers of the Republic of Uzbekistan for the questions falling within the scope of conducting Management;
will organize development and implementation of plans of bill work of the Government of the Republic of Uzbekistan, interaction with chambers of Oliy Majlis of the Republic of Uzbekistan and their committees on the bills and other questions brought by the Government of the Republic of Uzbekistan;
provides carrying out expert study of drafts of international treaties and offers on feasibility of signing, accession, ratification and approval of international treaties, participates in preparation of drafts of international treaties of the Republic of Uzbekistan;
will organize forming and maintaining the systematized databank and monitoring of implementation of the international treaties of the Republic of Uzbekistan signed during the visits of the President of the Republic of Uzbekistan to foreign states, and also visits of Chapters of foreign states and the governments, the international organizations to the Republic of Uzbekistan;
participates in cabinet meetings of the Republic of Uzbekistan and its Presidium, meetings with the Prime Minister of the Republic of Uzbekistan, his deputies, meetings of the government and interdepartmental commissions, councils and organizing committees, meetings at Managing Executive office held on the questions falling within the scope of conducting Management;
sends for consideration in relevant organs of the public and economic board the documents which arrived in the Cabinet of Ministers of the Republic of Uzbekistan and on which it is not required the solution of the Government of the republic;
submits for consideration of Managing Executive office and the Prime Minister of the Republic of Uzbekistan of the offer on the candidates recommended for positions according to the approved structure and the staff list performs measures for increase in professional level and business qualification of heads of structural divisions and specialists, and also makes offers on their encouragement or collection;
submits for approval of Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan distribution of obligations between managers of departments and specialists of Management;
provides record keeping according to the Instruction existing in Executive office of the Cabinet of Ministers;
signs outgoing correspondence.
14. In case of temporary absence of the head of department of its obligation one of managers of departments determined by the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan performs.
15. The head of department regarding the questions assigned to him: performs direct management of department and bears personal
responsibility for accomplishment of the tasks and functions assigned to Management and condition of performing discipline in department;
will organize high-quality and timely legal examination and preparation of materials and draft documents, vises the specified projects and signs expert opinions on them;
is directly involved in preparation and examination of drafts of regulatory legal acts, international treaties, provides preparation on them the corresponding analytical and reference materials, expert opinions;
exercises control of creation and maintaining the systematized databases on appropriate questions, their regular updating;
reports materials on the head of department, and also, in accordance with the established procedure, the Prime Minister of the Republic of Uzbekistan, his deputies and the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
will organize development and represents to the head of department of the offer on further enhancement of the legislation of the republic, and also elimination of the available shortcomings of the respective spheres of the legislation;
participates in accordance with the established procedure in cabinet meetings and its Presidium, meetings with the Prime Minister of the Republic of Uzbekistan, his deputies, meetings of the government and interdepartmental commissions, councils and organizing committees, meetings at Managing Executive office of the Cabinet of Ministers held on the questions falling within the scope of its maintaining;
carries out with heads and representatives of bodies of the public and economic board, other bodies and organizations of meeting;
at the request of the head of department signs outgoing correspondence;
makes to the head of department offers on distribution of obligations between the corresponding specialists;
represents to the head of department of the offer on position assignment and about dismissal, about advanced training, encouragement of specialists and imposing of penalties on them.
In case of temporary absence of the head of department of its obligation one of chief specialists of department determined by the head of department performs.
16. The chief specialist of Management regarding the questions assigned to it:
performs preparation of materials and draft documents, accomplishment of orders of the head of department, head of department, bears the personal responsibility for timely preparation, quality of study of materials and ensuring control over the implementation of orders;
studies the drafts of regulatory legal acts, international treaties and other materials provided by bodies of the public and economic board, other organizations and structural divisions of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan, performs their expert study, prepares on them the corresponding analytical and reference materials, expert opinions;
conducts monitoring of implementation of international treaties;
conducts the systematized databank of international treaties, performs their regular updating;
reports materials on the head of department, the head of department, and also, in accordance with the established procedure, the Prime Minister of the Republic of Uzbekistan, his deputies and the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
develops and represents to the head of department, the head of department of the offer but enhancement of the legislation and law-enforcement practice, on interpretation and explanation of decisions of the Cabinet of Ministers of the Republic of Uzbekistan;
is present in accordance with the established procedure at the cabinet meetings of the Republic of Uzbekistan and its Presidium, meetings with the Prime Minister of the Republic of Uzbekistan and his deputies, meetings of the government and interdepartmental commissions, councils and organizing committees, meetings held on the questions assigned to it at Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
carries out with representatives of bodies of the public and economic board, other bodies and organizations, scientists and specialists of meeting for preparation of materials for consideration at cabinet meetings of the Republic of Uzbekistan and its Presidium, meetings with the President of the Republic of Uzbekistan, the Prime Minister of the Republic of Uzbekistan and his deputies, and also discussions of the drafts of the laws of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decisions of the Government which are on execution for the purpose of their preparation.
17. The leading expert of Management regarding the questions assigned to it:
performs preparation of materials and draft documents, accomplishment of orders of the head of department, head of department, bears the personal responsibility for timely preparation, quality of study of materials and ensuring control over the implementation of orders;
performs expert study of drafts of regulatory legal acts, preparation on them expert opinions;
represents materials to the head of department, the head of department, the corresponding chief specialist, and also, in accordance with the established procedure, the Prime Minister of the Republic of Uzbekistan, his deputies and the Managing director of Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
participates in preparation of the corresponding reference and analytical materials on the supervised questions;
there is in accordance with the established procedure pas cabinet meetings of the Republic of Uzbekistan and its Presidium, meetings with the Prime Minister of the Republic of Uzbekistan and his deputies, meetings of the government and interdepartmental commissions and councils, meetings at Managing Executive office of the Cabinet of Ministers of the Republic of Uzbekistan;
in coordination with the head of department, the head of department or the corresponding chief specialist carries out with representatives of bodies of the public and economic board, other bodies and organizations, scientists and specialists of discussion of the drafts of the laws of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decisions of the Government which are on execution, for the purpose of their preparation.
18. Inspectors provide record keeping, exercise control of passing of documents in Management and departments, provide preparation and timely transfer of cases on archive storage, perform other functions assigned to them.
