About approval of the Procedure for test of knowledge of nuclear and radiation safety at heads of the operating organizations, other companies which activities are connected with use of nuclear energy

On accomplishment of the resolution of the Cabinet of Ministers of Ukraine of 27.12.2008 N 1162 "About approval of qualification requirements to heads and deputy managers of state bodies in the field of use of nuclear energy, the treatment of radioactive waste and bodies of state regulation of nuclear and radiation safety" and for the purpose of enhancement of the procedure of holding examination of regulations, rules and standards on nuclear and radiation safety I ORDER:

1. Approve the Procedure for test of knowledge of nuclear and radiation safety at heads of the operating organizations, other companies which activities are connected with use of nuclear energy which is applied.

2. To the operating organizations, other companies which activities are connected with use of nuclear energy, irrespective of patterns of ownership to provide observance of this order.

3. The organization of training and examination of regulations, rules and standards for nuclear and radiation safety to assign to Department of physical protection, fire safety and health and safety (Ivanov P. A.).

4. Organizational support of work of the commissions on examination of regulations, rules and standards on nuclear and radiation safety to assign to Economic board (Dyachuk G. I.).

5. To department of physical protection, fire safety and health and safety (Ivanov P. A.):

5.1. Submit this order to the Ministry of Justice of Ukraine on state registration in accordance with the established procedure.

5.2. After state registration to bring this order to permission of the operating organizations, other companies which activities are connected with use of nuclear energy.

6. This order becomes effective from the date of its official publication.

7. To impose control over the implementation of this order on the deputy minister Shumkova N. Yu.

Procedure for test of knowledge of nuclear and radiation safety at heads of the operating organizations, other companies which activities are connected with use of nuclear energy

I. General provisions

1.1. This Procedure is developed according to the Law of Ukraine "About use of nuclear energy and radiation safety", the resolution of the Cabinet of Ministers of Ukraine of 27.12.2008 N 1162 "About approval of qualification requirements to heads and deputy managers of state bodies in the field of use of nuclear energy, the treatment of radioactive waste and bodies of state regulation of nuclear and radiation safety".

1.2. This Procedure establishes procedure of holding examination of regulations and rules for nuclear and radiation safety (dalsheproverka of knowledge) at heads of the operating organizations, other companies which activities are connected with use of nuclear energy (further - the companies).

II. Organization of work of the permanent commission of Mintoplivenergo for examination

2.1. For holding examination in Mintoplivenergo the permanent commission on examination (further - the Commission) in quantity to 15 persons is created.

2.2. The commission is headed by the deputy minister who according to distribution of functional obligations is responsible for public administration in the field of use of nuclear energy.

The commission chairman has three deputies.

2.3. Commission sessions are held under chairmanship of the chairman or one of vice-chairmen of the Commission with obligatory participation state inspector Gosatomregulirovaniya.

In commission sessions in case of examination of regulatory legal acts which development and enforcement belong to competence MZ participation of the representative of MZ is obligatory.

2.4. Commission session is competent if at it there are at least three members of the commission.

2.5. The decision of the Commission is made by a simple majority vote the members of the commission who are present at meeting. In case of equal distribution of voices the chairman's voice at such meeting is decisive.

2.6. If knowledge of the director who undergoes examination do not meet the requirements of item 4 of Criteria of success of examination of regulatory legal acts for nuclear and radiation safety (appendix 1), the Commission can make the decision on passing by such head of examination with clauses concerning need of extraordinary (additional) check of its knowledge in 1 year.

III. Organization of examination

3.1. The examination includes primary; periodic (next); extraordinary (additional) types of checks.

3.2. Primary examination is carried out in case of appointment of person to the head's position.

3.3. The periodic (another) examination is carried out at least once in three years.

3.4. Extraordinary (additional) examinations of heads are carried out:

3.4.1. In case of adoption of new regulatory legal acts concerning safety of nuclear power plants, rules of ustraivaniye and safe operation of the equipment and pipelines of atomic power stations, rules of nuclear safety of reactor installations of nuclear power plants with reactors with water under pressure or introduction of amendments to such acts.

In case of adoption of other new regulatory legal acts of Gosatomregulirovaniya and MZ on nuclear and radiation safety or modification of them the examination of these acts is combined with periodic (another) examination.

Such extraordinary (additional) examination does not change the term of periodic (another) examination.

3.4.2. Upon the demand of Gosatomregulirovaniya in cases:

identifications of unsatisfactory knowledge by heads of regulations and rules on nuclear and radiation safety;

recoveries on positions of heads which are discharged of work on Gosatomregulirovaniya's representation.

3.4.3. In case, stipulated in Item 2.6 this About.

3.5. The examination is carried out by the Commission by testing or/and oral poll according to Criteria of success of examination of regulatory legal acts on nuclear and radiation safety (appendix 1).

3.6. Knowledge of the regulatory legal acts of nuclear and radiation safety included in the list of regulations and rules on nuclear and radiation safety (further - the list) constituted and approved at the company according to the directions it activities determined in the charter is subject to check.

3.7. For the organization of periodic (another) examination till December 1 of the current year the companies send Mintoplivenergo of the request for forming of the schedule of examination the next year.

The schedule of examination can quarterly be adjusted, depending on receipt in the Commission of new requests for examination, including rather primary examination.

3.8. The schedules of examination approved by Mintoplivenergo till December 25 of the current year are sent to the companies which provided requests, Gosatomregulirovaniya and MZ.

The schedules of examination modified according to the paragraph to the second Item 3.7 of this Section are sent to the companies to the 5th day of the first month of quarter in which the examination will be carried out.

About holding extraordinary (additional) examination to the director it is reported not later than in 15 days prior to day of conducting such check.

3.9. A month before holding examination, except extraordinary (additional) check, the companies send to Mintoplivenergo:

the letter concerning confirmation of intention to undergo examination;

the list approved as the director and approved by Gosatomregulirovaniya.

3.10. Based on the provided documents the commission chairman or according to its order the vice-chairman of the Commission makes the decision on opportunity and term of holding examination what the companies are informed on.

Mintoplivenergo sends Gosatomregulirovaniya and MZ the message on commission session not later than in 5 days prior to day of check for the purpose of determination of the representative for participation in the robot of the Commission.

3.11. Results of examination the Commission are drawn up by the relevant protocol (appendix 2).

The list of regulations and rules which examination was undergone by the director is attached to the protocol.

Execution of the protocol behind signatures of the chairman and members of the commission and the state inspector Gosatomregulirovaniya and the representative of MZ which participated in examination is performed individually for each director who underwent examination.

3.12. Are issued to heads of the companies which underwent primary examination the certificate (appendix 3) and the copy of the protocol.

The copy of the protocol is provided to also state inspector Gosatomregulirovaniya and the representative of MZ.

3.13. To heads of the companies which passed periodic (another), extraordinary (additional) examination entry in the certificate is performed and the copy of the protocol is issued.

The copy of the protocol is provided to also state inspector Gosatomregulirovaniya and the representative of MZ.

Entries in the certificate are signed by the commission chairman and make sure Mintoplivenergo seal.

3.14. The copy of the protocol with recommendations concerning passing of additional check with indication of the term of its carrying out is issued to heads of the companies which did not undergo examination.

 

Appendix 1

Criteria of success of examination of regulatory legal acts on nuclear and radiation safety

1. The amount of knowledge is concretized to the level of knowledge of separate Sections or articles of acts of the legislation.

2. On each of regulatory legal acts during the examination members of the commission can set about 5 questions (depending on activity and position which is held by person whose knowledge is checked).

3. The total quantity of questions cannot be less than 25 and exceed 45 questions.

4. The examination is considered passed in case of provision by person which knowledge is checked:

4.1 at least 60% of the complete correct answers;

4.2 it is no more than 30% of partial/incomplete answers;

4.3 it is no more than 10% of unsatisfactory / absent answers.

5. On questions which concern knowledge of the main regulating documents: General provisions of safety of nuclear power plants (NP 306.2.141-2008); Rules of nuclear safety of reactor installations of nuclear power plants reactors with water under pressure (NP 306.2.145-2008); NRBU-97/D 2000 (DNAOP 0.03-3.24-97 (DGN 6.6.1-6.5.061-98)); Regulations of radiation safety of Ukraine (NRBU-97) (DGN 6.6.1-6.5.001-98)неудовлетворительные answers are not allowed.
