Questions of import to customs area of Ukraine of goods in limits of the international treaties (agreements) of Ukraine ratified by the Verkhovna Rada of Ukraine concerning space activities for creation of the space equipment without payment of import duty and the value added tax
According to the subitem 4 of item 4 of the Section XXI of the Customs code of Ukraine, Item 3 of subsection 2 of the Section XX of the Tax code of Ukraine the Cabinet of Ministers of Ukraine decides:
1. Approve:
amounts of goods which are imported on customs area of Ukraine by subjects of space activities - residents in limits of the international treaties (agreements) of Ukraine ratified by the Verkhovna Rada of Ukraine concerning space activities for creation of the space equipment without payment of import duty and the value added tax till January 1, 2018, according to appendix 1.
limiting amounts of goods which are imported on customs area of Ukraine by subjects of space activities - residents within the international treaties (agreements) of Ukraine ratified by the Verkhovna Rada of Ukraine concerning space activities concerning creation of the space equipment without payment of import duty of the value added tax till January 1, 2023, according to appendix 2.
2. This resolution becomes effective since January 1, 2010.

1. This Procedure determines the mechanism of import to customs area of Ukraine by subjects of space activities - residents (further - subjects) in limits of the international treaties (agreements) of Ukraine ratified by the Verkhovna Rada of Ukraine concerning space activities for creation of the space equipment of goods (including aggregates, systems and their components for space complexes, space carrier rockets, spacecrafts and land segments of space systems) without payment of import duty till January 1, 2023 (further - goods).
2. Import by subjects to customs area of Ukraine of goods is performed in the procedure established by the legislation taking into account their amounts approved by the Cabinet of Ministers of Ukraine.
GKA in case of need prepares and submits to the Cabinet of Ministers of Ukraine proposals on change of the specified amounts of goods.
3. Agreements (contracts) for delivery of goods signed by subjects with foreign subjects of housekeeping are subject to registration in GKA according to Regulations on procedure for provision of permissions to subjects of space activities on negotiation with foreign business entities on research and use of space, production and operation of the space equipment and the conclusion of purchase and sale agreements of the space equipment and technologies, registration of agreements which subject are space activities, concluded by subjects of business activity of Ukraine with foreign business entities, the Cabinet of Ministers of Ukraine approved by the resolution of June 4, 1998 N 798 "About measures of state regulation of space activities" (The Official Bulletin of Ukraine, 1998, N 22, the Art. 810).
4. Subjects give monthly to the 10th of the next period of the body of the income and charges which performed customs clearance of goods, the report on use of goods on their appointment approved with DKA.
The report form affirms GFS.
5. Bodies of the income and charges, representation of the general customer of GKA exercise in accordance with the established procedure control of import and use of the goods imported by subjects on customs area of Ukraine to destination.
Alienation of such goods to the third parties, except alienation as a part of the space equipment created (made) at the time of approval of amounts of goods is considered use of goods not to destination.
In case of identification of the fact of use of goods not to destination bodies of the income and charges take measures, stipulated in Item 123.2 articles 123 of the Tax Code of Ukraine, and concerning collection of outstanding amounts of import duty according to the procedure and the sizes, stipulated by the legislation.
