1. Approve the Instruction for registration of veterinary medicine by state bodies, divisions of veterinary militia for holding quarantine veterinary actions of materials about administrative offenses (further - the Instruction) which is attached.

2. To chiefs of territorial authorities of the State committee of veterinary medicine of Ukraine, regional services of the state veterinary health control and supervision on frontier and transport to accept the Instruction in management and application when implementing the state veterinary health control and supervision.

3. To management of veterinary militia on holding quarantine veterinary actions of the Ministry of Internal Affairs of Ukraine (Oksyuta S. I.) provide the organization of accomplishment of the Instruction by subordinated divisions of veterinary militia.

4. To management of the state inspection of veterinary medicine of the State committee of veterinary medicine of Ukraine (Bilous M. V.) in accordance with the established procedure:

4.1. Submit this order on state registration to the Ministry of Justice of Ukraine.

4.2. Bring the order to permission of chiefs of territorial authorities of the State committee of veterinary medicine of Ukraine, regional services of the state veterinary health control and supervision on frontier and transport.

5. To impose control over the implementation of the order on the vice-chairman of the State committee of veterinary medicine of Ukraine Sadvari Yu. Yu.

6. This order becomes effective from the date of its official publication.

Instruction for registration of veterinary medicine by state bodies, divisions of veterinary militia for holding quarantine veterinary actions of materials about administrative offenses

1. General provisions

1.1. This Instruction is developed according to the Code of Ukraine about administrative offenses (further - КУоАП), the Law of Ukraine "About veterinary medicine".

1.2. The instruction establishes procedure for registration of materials about administrative offenses by officials of state bodies of veterinary medicine, divisions of veterinary militia on holding quarantine veterinary actions (further - officials of the state inspection of veterinary medicine) in case of identification of abuses of regulations of quarantine of animal and other veterinary health requirements, and also appeal and control of production on cases on administrative offenses.

1.3. In this Instruction terms and concepts are used in the values determined КУоАП, the Law of Ukraine "About veterinary medicine", by other regulatory legal acts concerning veterinary medicine.

1.4. According to Articles 107 and 238 КУоАП state bodies of veterinary medicine, division of veterinary militia on holding quarantine veterinary actions of the Ministry of Internal Affairs of Ukraine consider cases on the administrative offenses connected with abuses of regulations concerning quarantine of animal and other veterinary health requirements.

2. Creation of the protocol on administrative offense

2.1. According to article 254 КУоАП about making of administrative offense by the official of the state inspection of veterinary medicine the protocol on administrative offense is constituted (further - the protocol) (appendix 1).

2.2. The protocol is constituted in duplicate, one of which on receipt is handed to person who is brought to the administrative responsibility.

2.3. Officials of the state inspection of veterinary medicine constitute the protocols provided by Articles 42-1 - 42-3 and 188-22, and their consideration according to Article 221 КУоАП is referred to district, district in the cities, to city or gorrayonny courts (judges).
