About approval of Rules of search and rescue ensuring flights in civil aviation of Ukraine
In pursuance of articles 7, of 76-81 Air code of Ukraine and for the purpose of the organization of search and rescue ensuring flights in civil aviation of Ukraine I ORDER:
1. Approve Rules of search and rescue ensuring flights in civil aviation of Ukraine (further - Rules) (are applied).
2. Public aviation administration (Ovchinnikov O. V.):
2.1. Provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.
2.2. Bring Rules to the attention of heads of structural divisions of State aviaadministration, the companies and educational institutions of civil aviation of Ukraine.
3. Declare invalid the order of the Ministry of transport of Ukraine of 16.08.99 No. 404 "About approval of Rules on search and rescuing in civil aviation of Ukraine", registered in the Ministry of Justice of Ukraine 07.10.99 for No. 684/3977.
4. This order becomes effective from the date of official publication.
5. To impose control over the implementation of this order on the deputy minister - the head of Public aviation administration of Davydov O. M.

1.1. In these Rules terms are used in the following value:
emergency - situation which is characterized by variation from normal living conditions and activities of people which brought (can bring) to threat of life and human health, destruction of buildings, constructions, the equipment and vehicles;
emergency stage - the general term which means uncertainty stage, stage of alarm or stage of disaster in different circumstances;
emergency servicing - servicing which is provided with the notice of the relevant organizations on aircrafts which needs the search and rescue help, and assistance to such organizations for their request;
the emergency notice - transfer of the message on emergency to body which can give help or coordinate its provision;
the emergency drive transmitter (further - ELT) - the equipment which transmits characteristic signals at the set frequencies and depending on type of application can work automatically as a result of blow or be put in action manually.
ELT happens the following types:
automatic stationary ELT(AF) - ELT which works automatically and stationary established onboard the aircraft;
automatic portable ELT - ELT which works automatically not movably is fixed onboard the aircraft and easily is removed;
ELT(AD) which automatically is developed - ELT which not movably is fixed onboard the aircraft is automatically developed and works as a result of blow, and in certain cases can be put in action by hydrostatic sensors. Also its deployment manually is provided;
rescue ELT - ELT which is removed from aircraft board so that it was it is possible to use easily in emergency, and it is put in action manually by persons who survived;
the rescue crew - emergency forming which is created and functions as a part of the airport (airfield), has special preparation and is equipped with means, devices and the equipment for bystry and effective carrying out search and wrecking;
rescue means - technical means of special purpose, scientific and technical products and other objects of intellectual property right (means of communication, the equipment, the equipment, equipment, materials, video, film, photographic materials on technologies of carrying out wrecking, software products and databases and other means) which are used during wrecking;
wrecking - the works sent to search, rescuing and protection of people (including provision of emergency medical service by it) which need employees engagement, having special preparation, individual protection equipment and equipment;
airline - any company which provides aviaservices or operates aircrafts;
aviation incident - the incident connected with use of the aircraft, taking place since the moment when any face is raised aboard with intention to perform flight till the moment when all persons which were onboard left the aircraft and during which any face sustains bodily harms from the death or serious bodily harms or the aircraft sustains damage or destruction of design.
Aviation incidents are divided into catastrophic crashes and accidents:
catastrophic crash - aviation incident which led to death or disappearance without message of someone from passengers or crew members, and also in case of receipt of bodily harms by them from the death in time:
a) stay on this aircraft;
b) direct collision with any part of the aircraft, including the parts separated this aircraft;
c) direct action of stream of gases of the jet engine;
d) disappearances without aircraft message. The aircraft is considered disappeared without message if official search was stopped and the location of elements of its design was not established. The decision on the termination of search of the aircraft, missing, accepts authority of the state on investigation of aviation incident in the territory of which there was aviation incident;
also cases of death someone from persons which were onboard in the course of their emergency evacuation from the aircraft belong to catastrophic crashes;
accident - aviation incident without the human victims which led to damage or destruction of the aircraft or serious bodily harm of passengers or crew members and the third parties, owing to which:
a) aircraft glider design durability because of destruction of power elements is broken;
b) technical or flight characteristics of the aircraft worsen and for their recovery repair is necessary or is excluded to recover its flight suitability. Do not treat accidents: for airplanes - cases of refusal or damage of the engine when are damaged only the engine, its cowls or auxiliary aggregates or when only air screws, okontsovka of wing, antennas, pneumatics, brake mechanisms, fairing or when in covering there are small dents or holes are damaged; for helicopters - destruction or damage of elements of the bearing and steering screws, ventilatory installation, reducer, covering, destruction or separation of transmission if they did not lead to damage or destruction of power elements of the fuselage or beams;
c) the aircraft appears in such place where there is no access to it and its evacuation from the scene is impossible;
d) any face sustains serious bodily harms;
airfield - the land area or surface of the water (including any buildings placed on it, constructions and the equipment) intended fully or partially for arrival, departure and movement of aircrafts;
the airport - complex which includes airfield, air terminal complex and other constructions intended for acceptance and departure of aircrafts, land servicing of aircrafts, passengers, crews, baggage, mail, load and implementation of all types of airport activities;
certification - determination of qualification of the specialist, amount of its knowledge, experience, capabilities necessary for accomplishment of specific obligations;
onboard rescue means - the technical means which are functionally connected with aircraft design, removable means and equipment which are used for rescuing of people in case of origin and development of emergencies onboard the aircraft;
"Release" - notification signal for the termination of actions during emergencies with the aircraft, operations of rescue crew which were performed on signal "Readiness" or "Alarm", or completion of wrecking;
"Readiness" - notification signal for rescue crew when before the expected landing of the aircraft, in distress, there are more than 30 minutes;
the operator of the aircraft - the legal entity or physical person which operates aircrafts and is certified according to the current legislation;
the runway platform - the land (water) site, specially prepared platform or the design lifted over terrestrial or surface of the water which is suitable and is used for take-off, landing, movement and the parking of light aircrafts which maximum take-off mass does not exceed 5700 kg;
emergency - the incident connected with use of the aircraft, which is not falling under determination of aviation incident, and also connected with maintenance, repair, storage and transportation during which there came one of such effects:
death or serious bodily harm of any person during its stay onboard the aircraft owing to reckless or intentional acts of the most injured person or other persons who are not connected with violation of functioning of the aircraft and its systems;
death or serious bodily harm of any person who without good causes or documents self-willedally got out of limits of zones on the aircraft where access to passengers and crew members is prohibited;
death or serious bodily harm of any person which was onboard the aircraft as a result of influence of external environment after emergency landing of the aircraft outside airfield;
death or serious bodily harm of any person which was outside the aircraft owing to direct contact with the aircraft or with its elements;
destruction or serious damage of the aircraft on the earth that led to violation of durability of its design or deterioration in flight technical characteristics as a result of influence of external environment or violation of technology of servicing, storage precautions and transportation;
hijacking of the aircraft which was on the earth or in flight or attempts to seize such vessel and other acts of illegal intervention in activities of civil aviation;
emergency situation - violations of normal living conditions and activities of people in the territory or object which occurred owing to aviation or other emergency that brought (can lead) to death of people and/or to considerable material losses;
land search and rescue group - group which is staffed by the prepared personnel and is equipped with the equipment suitable for carrying out search and wrecking within responsibility of the operator of airfield for carrying out search and wrecking;
the coordination center of search and rescuing - body which bears responsibility for coordination of carrying out search and rescue transactions within the area of search and rescuing, and also assistance of work of search and rescue service to the effective organization;
the aircraft - any device which is supported in the atmosphere due to its interaction with air, distinctive from interaction with the air reflected from the land surface;
the aircraft which is in distress or suffered, situation with the aircraft when to the vessel, the crew and persons who are on its board are threatened by danger or with which touch and its location is lost it is unknown;
