The Russian Federation and the Republic of Kazakhstan which are hereinafter referred to as with the Parties

being guided by the conventional principles and rules of international law,

for the purpose of forming of custom union within Eurasian economic community and ensuring customs regulation on single customs area of custom union,

in view of obligations of state members of custom union on application and observance of provisions of the international treaties signed within forming of custom union

agreed as follows:

Article 1

For the purposes of implementation of this agreement:

1) the single customs area of custom union is understood as the territories of the Parties, and also artificial islands which are outside the territories of the Parties, installations, constructions and other objects concerning which the Parties have the exclusive jurisdiction;

2) goods of custom union are understood as the goods which are on customs area of custom union:

completely made in the territories of the Parties,

imported on customs area of custom union and acquired the status of goods of custom union according to the Customs Code of the Customs Union and other international treaties of the Parties as state members of custom union,

made in the territories of the Parties of the goods specified in paragraphs second and third this subitem, and (or) foreign goods, and acquired the status of goods of the Customs union according to the Customs Code of the Customs Union and other international treaties of the Parties as state members of custom union;

3) the third countries are understood as the states which are not the Parties of this Agreement;

4) the customs legislation of custom union is understood as the Customs Code of the Customs Union, and also the international agreements of the Parties regulating customs legal relationship as state members of custom union, decision of the Commission of custom union and the decisions made by agents of the parties in the Commission of custom union according to Article 4 of this Agreement.
