According to the Law of Ukraine "About labor protection" I ORDER:

1. Approve Industrial safety rules during development of mineral deposits by open method (dalshepravil) which are applied.

2. Repeal the order of the State committee of Ukraine on supervision of labor protection of 31.05.94 No. 54 "About approval of Safety rules in case of development of mineral deposits by open method".

3. The order becomes effective from the date of its official publication.

4. To the head of department of the organization of the state supervision in the mining industry and on explosive to works to Zakharenkov E. I. in accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

5. To the head of department of normative and legal and legal providing Kalinovskaya I. G. enter changes in the State register of regulatory legal acts concerning labor protection and post this order on the website of Gosgorpromnadzor.

6. To the assistant department head of personnel, clerical work and special work Kravtsu V. Yu. provide the publication of the order in mass media.

Industrial safety rules during development of mineral deposits by open method

I. Scope

1. These Rules extend to subjects of managing irrespective of patterns of ownership (further - the mountain company) which activities are connected with development of ore and nonmetallic minerals by open method.

2. Requirements of these Rules are obligatory for all subjects of managing which perform designing, construction and operation of pits (cuts), buildings, constructions, machines, the equipment, remedies and control, devices and materials, and also for all workers at whom accomplishment of obligations is connected with stay on subjects to open mining operations.

II. Designations and reducings

1. NAPB - the regulation of fire safety;

2. NPAOP - the regulatory legal act on labor protection;

3. The power transmission line - power line;

4. STsB - system of centralization and blocking.

III. Terms and determinations of concepts

1. In these Rules terms and concepts: the face, open-cast mining of fields, explosive materials (substances), the mining (mining) industry, the mountain company, mountain object, mining operations, mine-rescue service (forming), the massif, pit, preservation, the mine, minerals, demolition work are used in values which are given in the Mountain Law of Ukraine.

2. Other terms are used in such value:

the working platform of ledge - the platform of ledge intended for placement of the main working equipment;

the technological instruction (the process chart, the passport) the description of control methods of engineering procedure, procedure for installation and instructions for use the equipment, working methods and security measures in operating time on it and so forth;

ledge slope - sloping or vertical surface between the upper and lower platforms of ledge, along it;

pit ledge - part of thickness of rocks in career which have the form of ledge (step).

IV. General requirements of safety

1. Basic provisions

1.1. The employer shall create on workplace in each structural division safe working conditions according to requirements of the Law of Ukraine "About labor protection".

1.2. The mountain company when carrying out mining operations according to the Mountain Law of Ukraine shall have:

special permission to use of natural resources;

act of provision of mountain branch;

the engineering design of mining of minerals approved and approved in accordance with the established procedure;

geological and surveying, technical and accounting and control documentation (schedules of development of mining operations, projects, passports, schemes).

In case of change of mining-and-geological conditions the engineering design of mining of minerals needs to be reviewed, but every time it shall cover the entire period until the end of mining up to the project depth and project contour of the field.

Variations from the project need to be approved with the project organization.

1.3. The project documentation on construction (reconstruction and technical retrofitting) of subjects to mining operations is subject to examination according to requirements of the Mountain law of Ukraine and the Approval procedure of construction projects and the conducting their examination approved by the resolution of the Cabinet of Ministers of Ukraine of May 11, 2011 No. 560.

Factory buildings, constructions, machines, mechanisms, the equipment, vehicles which become effective after construction (production) or reconstruction, capital repairs and engineering procedures shall meet the requirements of regulatory legal acts for labor protection.

1.4. Examination of projects, registration, surveys, testing of production facilities are performed by the Technique of conducting state examination (check) of the project documentation on construction (reconstruction, technical retrofitting) of production facilities and production of means of production on compliance to their regulations about the labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of 30.09.94 No. 95, of Ukraine registered in the Ministry of Justice 20.02.95 for No. 44/580 (NPAOP 0.00-7.03-94).

1.5. The structure of the project documentation on new construction, reconstruction, capital repairs and technical retrofitting of mountain objects is established by the State construction regulations of Ukraine "Structure and contents of the project documentation on construction" (GSN A.2.2-3:2014) approved by the order of the Ministry of Regional Development, Construction and Housing of Ukraine of June 4, 2014 No. 163.

1.6. Acceptance in operation of the mountain objects finished with construction, and also industrial facilities and constructions is performed according to requirements of the Mountain law of Ukraine and the Procedure for acceptance in operation finished with construction of facilities, the Cabinet of Ministers of Ukraine approved by the resolution of April 13, 2011 No. 461 (in edition of the resolution of the Cabinet of Ministers of Ukraine of September 08, 2015 No. 750).

On the subject to production appointment completed by construction all works provided by the project documentation shall be performed, the equipment is mounted and tested, and also safe conditions for work of workers and stay of people are created.

Operation completed by construction of facilities which do not answer the project documentation, the state construction regulations and rules is forbidden.

1.7. Survey, inspection and certification of construction objects of the mountain company shall be performed according to requirements of article 39-2 of the Law of Ukraine "On regulation of town-planning activities".

1.8. The employer shall have permission of the central executive body which realizes state policy in the field of labor protection, and its territorial authorities (further - Gostruda) on performance of works of the increased danger and on operation (application) of machines, mechanisms, the equipment of the increased danger according to the Procedure for issue of permissions to performance of works of the increased danger and on operation (application) of machines, mechanisms, the equipment of the increased danger, to No. 1107 approved by the resolution of the Cabinet of Ministers of Ukraine of October 26, 2011 (further - the Procedure for issue of permissions).

1.9. All mountain companies irrespective of patterns of ownership in the period of their construction, reconstruction, operation, liquidation or preservation are serviced by the public militarized rescue services (forming) in compliance requirements from the Mountain Law of Ukraine.

1.10. On each pit on production of iron, manganese and sulfuric ores, salts of potash fertilizers, flyuso-dolomite, nonmetallic construction materials with a productivity over 50 thousand CBM of mountain weight in year, on the tailings dam, the sludge collector, drag, the dredge, and also the mountain company which carries out demolition work the liquidation plan of accidents shall be constituted.

1.11. At the mountain company the liquidation plan of accidents according to requirements of the Instruction for creation of liquidation plans of accidents for pits (cuts) and enrichment (briquette) factories approved by the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash No. 87, of Ukraine registered in the Ministry of Justice 22.04.2003 for No. 321/7642 is developed of 31.03.2003.

1.12. Demolition work on subjects to open mining operations needs to be carried out according to requirements of the legislation in the field of the treatment of blasting materials of industrial function.

1.13. Investigation and accounting of accidents, occupational diseases and accidents which happened to workers at the mountain company in case of development of mineral deposits by open method perform according to the Procedure for conducting investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 No. 1232.

1.14. According to the List of works with the increased danger approved by the order of the State committee of Ukraine on supervision of labor protection of 26.01.2005 No. 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for No. 232/10512 (further - NPAOP 0.00-2.01-05), taking into account specifics of production by the employer is developed and affirms the corresponding list of works with the increased danger for which carrying out special training of workers and annual examination concerning labor protection are necessary. All works with the increased danger are carried out only according to the written job specification.

2. Requirements to workers

2.1. Heads and chief specialists of the mountain company designate persons with the higher education corresponding to profile of this company according to the Mountain law of Ukraine.

2.2. Performing medical examinations of workers is performed according to requirements of the Procedure for the performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of 21.05.2007 No. 246, registered in the Ministry of Justice of Ukraine 23.07.2007 for No. 846/14113.

Passing at the company of pretrip medical examination for drivers of technological vehicles is performed according to the Regulations on medical examination of candidates for drivers and transport drivers approved by the order of the Ministry of Health of Ukraine, the Ministry of Internal Affairs of Ukraine of January 31, 2013 No. 65/80, registered in the Ministry of Justice of Ukraine on February 22, 2013 for No. 308/22840.

2.3. Training and examination concerning labor protection of workers are performed according to requirements of the Standard regulations on procedure for carrying out the training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of 26.01.2005 No. 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for No. 231/10511 (further - NPAOP 0.00-4.12-05).

Workers and officials who did not undergo training instructing and examination concerning labor protection in accordance with the established procedure, are not allowed to performance of works.

2.4. Instructions of the company for labor protection are developed according to requirements of the Regulations on development of instructions for labor protection approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of 29.01.98 No. 9, registered in the Ministry of Justice of Ukraine 07.04.98 for No. 226/2666 (further - NPAOP 0.00-4.15-98).

2.5. Technological instructions (process charts, passports) are developed at the company according to Procedure for study and approval of regulations by the employer about labor protection which act on the company, the approved order of the State committee of Ukraine on supervision of labor protection of 21.12.93 No. 132, registered in the Ministry of Justice of Ukraine 07.02.94 for No. 20/229 (NPAOP 0.00-6.03-93). They shall contain requirements which observance will provide safe for workers of conducting engineering procedures and works.

2.6. Providing workers with special clothes, special footwear and other individual protection equipment is performed according to requirements of the Regulations on procedure for the providing workers with special clothes, special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 24.03.2008 No. 53, registered in the Ministry of Justice of Ukraine 21.05.2008 for No. 446/15137 (NPAOP 0.00-4.01-08).

2.7. Issue of special clothes, special footwear and other individual protection equipment to workers is performed according to requirements of Regulations of free issue of special clothes, special footwear and other means of special protection to workers of the mining industry approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of 21.08.2008 No. 184, registered in the Ministry of Justice of Ukraine 10.09.2008 for No. 832/15523 (NPAOP 0.00-3.10-08).

2.8. workers who have the corresponding qualification are allowed to management and servicing of mining and transport vehicles, were trained concerning labor protection according to NPAOP 0.00-4.12-05 and received the corresponding certificate on the right of control of the mining or transport vehicle.

2.9. On work of the increased danger, specified in NPAOP 0.00-2.01-05, it is necessary to issue written job specifications.

2.10. Each workplace before work or during change shall be inspected by the official in whose obligation control of safe operation is necessary, or according to its order the authorized worker, and for days - to one of heads who not allow work in case of identification of violations of requirements for protection and labor safety, except works which are performed on the job specification concerning elimination of these violations.

2.11. Each worker prior to work shall be convinced of safe condition of the workplace, check operability of the safety devices, tools, mechanisms necessary for performance of work.

In case of identification of violations of safe condition of workplace which he cannot liquidate, the worker, without beginning work, shall report about them to the official in whose obligation control of safe performance of works is necessary.

It is not allowed to have a rest directly in faces and about slopes, in the danger area of the working mechanisms, on the transport ways, the equipment.

2.12. Before launch of mechanisms and start of motion of machines, railway trains (cars) or cars the driver (driver) shall be convinced of safety of members of crew and persons who are nearby, lack of obstacles and the equipment on the way of traffic circulation, it is obligatory to give sound and light signals which purpose all workers shall know. At the same time it is necessary to provide the audibility (visibility) of signals for all workers within the danger area of operation of machines, mechanisms.

The driver (driver) shall perceive each signal, incorrectly given or unclear for it, as signal "Stop".

The table of signals shall be hung out on the working mechanism or near it.

2.13. Each worker at the mountain company, having noticed danger which threatens workers or the company (defect of railway tracks, machines, mechanisms, power supply networks, sign of possible landslides, collapses of ledges, emergence of the fires), shall report along with the use of measures for its elimination about it to the official in whose obligation control of safe operation is necessary, and also to warn workers to whom danger threatens.

 

3. Requirements to technologies, equipment and materials

3.1. Engineering procedures, machines, mechanisms, the equipment, vehicles, chemicals and their connections, other dangerous products acquired abroad are allowed in operation (to application) only on condition of conducting examination on compliance to their regulatory legal acts on labor protection existing in the territory of Ukraine.
