About approval of the Procedure for control of observance by licensees of licensed conditions of conducting economic activity on designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects and the Procedure for control of observance by licensees of licensed conditions of conducting economic activity on carrying out testing for fire risk of substances, materials, building constructions, products and the equipment, and also fire fighting equipment, fire and technical arms, products of fire-proof appointment to compliance to the established requirements

According to article 6 of the Law of Ukraine "About licensing of certain types of economic activity", the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 N 1698 "About approval of the list of bodies of licensing" I ORDER:

1. Approve the Procedure for control of observance by licensees of licensed conditions of conducting economic activity on designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects which is applied.

2. Approve the Procedure for control of observance by licensees of licensed conditions of conducting economic activity on carrying out testing for fire risk of substances, materials, building constructions, products and the equipment, and also the fire fighting equipment, fire and technical arms, products of fire-proof appointment to compliance to the established requirements which is applied.

3. Confer powers to territorial authorities of the state supervision in the field of fire safety in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol to perform checks of observance by licensees of licensed conditions, by results of checks to publish orders about elimination of violations of licensed conditions and to accept from licensees of the data on changes of the data specified in documents which were enclosed to the application for licensing.

4. To provide to State department of fire safety and Management of legal providing submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

5. This order becomes effective from the date of its official publication.

6. To impose control over the implementation of this order on the chief of State department of fire safety Andriyenko V. M.

Procedure for control of observance by licensees of licensed conditions of conducting economic activity on designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects

I. General provisions

1.1. This Procedure is developed according to the Laws of Ukraine "About licensing of certain types of economic activity", "About the basic principles of the state supervision (control) in the field of economic activity", resolutions of the Cabinet of Ministers of Ukraine of 14.11.2000 N 1698 "About approval of the list of bodies of licensing", of 14.11.2007 N 1324 "About approval of the Procedure for distribution of subjects of managing on risk degrees of their economic activity for safety of life and health of the population, the surrounding environment concerning fire safety", and also the Licensed conditions of conducting economic activity on designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects approved by the order of the Ministry of Emergency Situations of 25.12.2009 of N 886, registered in Ministry of Justice 21.01.2010 for N 60/17355 (further - Licensed conditions).

1.2. This Procedure determines the legal and organizational basis, the basic principles and procedure of control in the field of conducting economic activity by designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects (dalshekhozyaystvenny activities of fire-proof appointment), powers of body of licensing, his officials, and also the right, obligation and responsibility of licensees during control.

1.3. Action of this Procedure extends to all subjects of economy who obtained the license of State department of fire safety for the right of conducting economic activity of fire-proof appointment.

1.4. Control of observance by licensees of licensed conditions of conducting economic activity of fire-proof appointment is exercised within the powers by carrying out scheduled and unscheduled inspections by such control facilities:

State department of fire safety which is body of licensing of activities of fire-proof appointment (further - body of licensing);

territorial authorities of the state supervision in the field of fire safety in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol (further - territorial authorities of licensing).
