About approval of the Procedure for control of observance by licensees of licensed conditions of implementation of economic activity on provision of services and performance of works of fire-proof appointment

According to articles 6 and 9 of the Law of Ukraine "About licensing of certain types of economic activity", the resolution of the Cabinet of Ministers of Ukraine of 14.11.2000 No. 1698 "About approval of the list of bodies of licensing" I ORDER:

1. Approve the Procedure for control of observance by licensees of licensed conditions of implementation of economic activity on provision of services and performance of works of fire-proof appointment (further - the Procedure for control) which is applied.

2. Declare invalid the order of the Ministry of Emergency Situations of 08.07.2010 No. 526 "About approval of the Procedure for control of observance by licensees of licensed conditions of implementation of economic activity on designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects and the Procedure for control of observance by licensees of licensed conditions of implementation of economic activity on carrying out testing for fire risk of substances, materials, building constructions, products and the equipment, and also fire fighting equipment, fire and technical arms, products of fire-proof appointment to compliance to the established requirements", registered in the Ministry of Justice of Ukraine 10.08.2010 for No. 658/17953.

3. (Ulinets) to provide to the state inspection of technogenic safety of Ukraine with E.M. provision of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

4. This order becomes effective from the date of its official publication.

Procedure for control of observance by licensees of licensed conditions of implementation of economic activity on provision of services and performance of works of fire-proof appointment

I. General provisions

1.1. This Procedure No. 1698 "About approval of the list of bodies of licensing", of 14.11.2007 No. 1324 "About approval of the Procedure for distribution of subjects of managing on risk degree of their economic activity for safety of life and health of the population, the surrounding environment, rather fire safety" is developed according to the Laws of Ukraine "About licensing of certain types of economic activity", "About the basic principles of the state supervision (control) in the field of economic activity", resolutions of the Cabinet of Ministers of Ukraine of 14.11.2000.

1.2. This Procedure determines the legal and organizational principles, the basic principles and procedure of control in the field of implementation of economic activity by provision of services and performance of works of fire-proof appointment (further - economic activity of fire-proof appointment), powers of body of licensing, his officials, and also the right and obligation of licensees during control.

1.3. Action of this Procedure extends to all subjects of managing who obtained the license of the State inspection of technogenic safety of Ukraine for the right of implementation of economic activity of fire-proof appointment (which is earlier granted by State department of fire safety the license for implementation of economic activity on designing, installation, maintenance of means of fire protection and systems of heating, assessment of fire-proof condition of objects or the license for implementation of economic activity for carrying out testing for fire risk of substances, materials, building constructions, products and the equipment, and also the fire fighting equipment, fire and technical arms, products of fire-proof appointment to compliance to the established requirements).

1.4. Control of observance by licensees of licensed conditions of implementation of economic activity of fire-proof appointment is exercised within the powers by carrying out scheduled and unscheduled inspections by such control facilities:

Gostekhnogenbezopasnosti of Ukraine who is body of licensing of activities of fire-proof appointment (further - body of licensing);

territorial authorities of Gostekhnogenbezopasnosti of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol (further - territorial authorities).
