About approval of the Regulations on procedure for the organization and implementation of the state supervision in the field of civil protection
For the purpose of accomplishment of provisions of Item е) article 7 of the Law No. 271-XIII of November 9, 1994 on civil protection (The official monitor of the Republic of Moldova, 1994, No. 20, of the Art. 231), the Government DECIDES:
1. Approve Regulations on procedure for the organization and implementation of the state supervision in the field of civil protection it (is applied).
2. To service of civil protection and emergency situations of the Ministry of Internal Affairs to take necessary measures for ensuring proper fulfillment of requirements of the specified Provision.
3. To impose control over the implementation of this Resolution on the Ministry of Internal Affairs.

1. This Provision establishes procedure for the organization and implementation of the state supervision in the field of civil protection, power and obligation of inspectors of civil protection.
2. Inspectors of civil protection are the certified faces which are working in Service of civil protection and emergency situations of the Ministry of Internal Affairs having the official ID, the established dress code, seal with individual identification number which perform activities for the state supervision in the field of civil protection in strict accordance with requirements of this provision.
3. When implementing the functions on supervision and control state supervision bodies in the field of civil protection are guided by the Constitution of the Republic of Moldova, acting legislative and regulations, departmental instructions, and also requirements of this provision.
4. The state supervision in the field of civil protection provides the following specific types of activity:
1) control of observance legislative and regulations, regulations in the field of civil protection by the ministries, other central administrative authorities and bodies of local public authority, physical persons and legal entities (during the designing, construction, operation and use of buildings, installations and constructions);
2) identification and risks assessment of emergence of emergency situations on the objects and the territories belonging to the ministries, other central administrative authorities and bodies of local public authority, physical persons and legal entities;
3) check of the organization of activities for identification and risk assessment on the objects and the territories belonging to the ministries, other central administrative authorities of local public authority, physical persons and legal entities;
4) control of activities on objects where dangerous chemical and radiological substances and materials are used;
5) coordination of preparation and special training of bodies of public management, including employees, informing, training and familiarity of the population with problems in the field of civil protection, control of procedure for development of rules and specific measures, and also of actions in case of emergency situations;
6) management, control and coordination of actions of forming of civil protection;
7) consideration and permission of claims and statements.
5. The system of standardization, regulations and rules of civil protection is caused by requirements of engineering, radiation, chemical and medicobiological protection of the population and the territory. Standards, regulations and rules of civil protection shall be approved with state supervision bodies in the field of civil protection and are obligatory for execution.
6. The main forms of activities of the state supervision in the field of civil protection are:
1) regulation - setting standards, rules, instructions and provisions of civil protection;
2) conclusion/authorization - provision of the right to complete or partial implementation of the current activities or new type of activity on construction, installation of processing equipment and other constructions;
3) consent - establishment of conditions and, if necessary, actions in the field of civil protection which require observance in case of project implementation or action for prevention of emergency situations;
4) control - permanent or recurring inspection of type of activity for acquaintance and improvement of conditions, procedure for carrying out and results of these checks;
5) specialized technical assistance - the organization, designing and execution of investment tasks, and also development of regulations, rules and actions in the field of civil protection;
6) timely informing authorities, organizations, concerned parties and the population, and also their preparation for actions in emergency situations;
7) ascertaining - factual statement of violations of regulations, rules, instructions and orders of civil protection.
7. The procedure for planning of checks in the field of civil protection is established by the departmental regulation of Service of civil protection and emergency situations.
8. Checks of condition of civil protection (in the field of civil protection) are subdivided on planned, special (operational) and additional.
To scheduled inspections complex and detailed checks of condition of civil protection, and belong to additional checks - repeated checks.
9. Scheduled complex inspections (further - complex checks) provide check of condition of civil protection in the central and local authorities of public management and on objects subordinated to them, and also in settlements.
10. Complex checks are performed by the commission created for this purpose by the departmental act of Service of civil protection and emergency situations with inclusion in its list of specialists from other competent authorities of the central public management.
11. Detailed checks provide check of all package of measures for the purpose of ensuring civil protection of organizations, organizations and companies.
12. Special inspections (operational) are carried out as necessary, taking into account features of objects and administrative and territorial units, and also operational situation at the moment.
13. Additional checks provide control of accomplishment of the actions provided in instructions (acts of checks) and the previous instructions published by state supervision bodies in the field of civil protection. Additional checks are considered as part of complex, detailed and sudden operational check.
14. The inspector/inspector of civil protection performs the activities individually or as a part of the working groups created at the level of divisions of Service of civil protection and emergency situations or together with representatives of other monitoring bodies with observance of precepts of law and, in case of need, the existing protocols on cooperation.
15. For high-quality conducting checks the Service of civil protection and emergency situations provides inspectors of civil protection with clothes, the special equipment and other necessary appliances according to the Order of the Government No. 1107 of September 30, 2008. "About dress code and signs of distinction of Service of civil protection and emergency situations of the Ministry of Internal Affairs".
16. State supervision bodies in the field of civil protection will organize, store, record in writing and in electronic format of documents on registration.
17. Accounting of the violations of the law in the field of civil protection established by state supervision bodies in the specified area is conducted in the special internal document of Service of civil protection and emergency situations.
18. State supervision bodies in the field of civil protection keep single account (with individual registration number) standard forms of the accounting documents specified in appendices No. 1-4 to this Provision.
All standard forms are constituted in duplicate: the first is handed to the head of organization / public body or to the physical/legal entity, and the second is stored at the inspector.
19. Plans of checks in writing are brought to the attention of public body, physical person and legal entity at least in 30 calendar days prior to their carrying out.
20. The commission which should perform complex check develops the verification plan including all Sections which are subject to check.
21. Conducting special (operational) checks affirms chiefs of divisions of Service of civil protection and emergency situations.
22. Before beginning check, the inspector of civil protection represents to the subject's head the official ID and the instruction on check according to the sample provided in appendix No. 1 to this Provision.
23. Each check registers in the unified register of accounting of checks (if that is available) the checked organization or administrative and territorial unit.
24. During check of the inspector of civil protection at least one representative of the checked organization or administrative and territorial unit without fail shall accompany.
25. All revealed violations shall be specified in inspection statements and if it is possible, are photographed for storage in electronic format in checking case of organization.
26. Violations which can be eliminated or are eliminated during check, are reflected in the inspection statement with the mark "It Is Eliminated during Check, Date......".
