The government of the Republic of Belarus and the Cabinet of Ministers of Ukraine which further are referred to as with the Parties

being guided by regulations of the Agreement between the Government of Ukraine and the Government of the Republic of Belarus on free trade of December 17, 1992,

agreed as follows:

Article 1

This agreement is applied to the tires coming from the Republic of Belarus pneumatic rubber new to the cars (including passenger-and-freight vans and sports cars) classified in commodity subsubline item of 4011 10 000 0 Single commodity nomenclature of foreign economic activity of custom union and by code 4011 10 00 00 of the Ukrainian classification of goods of foreign economic activity which are hereinafter referred to as Sheena.

Article 2

1. The Belarusian Side undertakes the voluntary obligation that supply rate Shin, coming from the Republic of Belarus, on customs area of Ukraine will not exceed:

500 thousand pieces in 2010;

575 thousand pieces in 2011;

650 thousand pieces in 2012.

At the same time deliveries Shin, coming from the Republic of Belarus, on customs area of Ukraine will be performed at the prices which on comparable delivery conditions not of low prices on which Sheena are on sale to the first independent buyer in the domestic market of the Republic of Belarus.

Comparison of the prices is performed taking into account provisions of the Agreement on application of article VI of the General Agreement on Tariffs and Trade of 1994.

2. The supply rate specified in Item 1 of this Article Shin, coming from the Republic of Belarus, on customs area of Ukraine in 2010 considers supply rates Shin which were performed since January 1, 2010.
