About approval of regulations on specialized teaching and educational agencies
According to the Law of the Republic of Uzbekistan "About prevention of neglect and offenses among minors" and for the purpose of further enhancement of activities of the specialized Cabinet of Ministers teaching and educational agencies decides:
1. Approve provisions:
about specialized school for the children needing special conditions of keeping, education and education according to appendix No. 1;
about specialized professional college for the children needing special conditions of keeping, education and education according to appendix No. 2.
2. To the ministry of national education, Ministry of the higher and secondary vocational education of the Republic of Uzbekistan:
provide systematic control of activities of specialized teaching and educational agencies, render them every possible assistance in implementation of the tasks assigned to them;
together with the Ministry of Health of the Republic of Uzbekistan in coordination with the Ministry of Finance of the Republic of Uzbekistan to develop and approve in accordance with the established procedure regulations of providing with food, clothes, footwear, other objects of ware allowance and soft stock of pupils of specialized teaching and educational agencies in a month;
in two-month time to bring activities of the operating specialized teaching and educational agencies into accord with requirements of the provisions approved by this resolution;
in a month to bring departmental regulatory legal acts into accord with this resolution.
3. To impose control of execution of this resolution on the Deputy prime minister of the Republic of Uzbekistan Aripov A. N.

Appendix №1
to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of November 26, 2010 No. 268
1. This Provision according to the laws of the Republic of Uzbekistan "About education", "About guarantees of the rights of the child", "About prevention of neglect and offenses among minors" determines procedure for the organization of activities of specialized school for the children needing special conditions of keeping, education and education (further - specialized school).
2. The specialized school in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, this Provision, other normative legal acts, and also the charter.
3. The specialized school is the specialized teaching and educational agency performing training, professional training and social and pedagogical rehabilitation of the children needing special conditions of keeping, education and education.
4. The main objectives of specialized school are:
education comprehensively developed, physically and spiritually healthy personality, forming at children of diligence, sense of patriotism, responsibility, independence and aspiration to self-improvement;
implementation of measures, the children providing psychological, medical and social resettlement promoting their intellectual, emotional and physical development according to age psychophysiological tendencies, capabilities, interests, requirements of protection of life and health of children;
creation of conditions for receipt of general secondary education by children on the basis of the state educational standards;
implementation of measures for program implementation and the techniques directed to forming of law-abiding behavior of pupils, assistance in their social protection and versatile development.
5. At specialized school the special conditions of keeping of pupils providing are provided:
protection of the territory of specialized school;
personal security of pupils and their maximum security from negative impact;
restriction of free admission of strangers for the territory of specialized school;
restriction of free exit of the pupils containing in specialized school out of limits of its territory;
the round-the-clock control of pupils, including in time allowed for dream;
carrying out personal inspection of pupils, examination of their things and also received and the sending sent by them and other mailings.
6. The specialized school is created by the decision the Cabinet of Ministers of the Republic of Uzbekistan according to the procedure, established by the legislation.
7. The specialized school is created separately for boys and for girls.
8. The specialized school is legal entity in the form of public institution, has the charter, bank accounts, seal with the image of the State Emblem of the Republic of Uzbekistan and with indication of the name, stamp, forms, and also sign of the established sample.
9. The state accreditation of specialized school is performed by authorized state body on the basis of certification according to the procedure, established by the legislation.
10. The minors aged from eleven up to sixteen years (not completed receipt of general secondary education) needing special conditions of keeping, education and education in cases can be placed in specialized school if they:
made socially dangerous acts, but did not reach age from which criminal prosecution is possible, or owing to the essential lagging in age development which is not connected with painful mental disturbance were not capable to understand value of committed act fully;
continue to make offenses or other antisocial actions, despite the carried-out individual scheduled maintenance.
11. The basis for the placement of minors to specialized school is determination of court.
Acceptance of minors in specialized school is performed based on determination of court in the directions provided by the Ministry of national education of the Republic of Uzbekistan.
12. On each minor sent to specialized school, the inspector of prevention (in the Republic of Karakalpakstan and areas) and the inspector of prevention of offenses among minors and youth (in Tashkent) law-enforcement bodies with assistance of the employee of the center of social legal assistance the minor of law-enforcement bodies draws up the personal record.
The personal record of the minor contains the following documents:
determination of district (city) criminal court judge about the placement of the minor to specialized school;
certificate of birth;
education documents (in the presence);
the reference and the characteristic from the place of study;
act of inspection of living conditions and education of the minor;
the medical record with the corresponding references;
conclusion of healthcare institution about the state of health of the minor and possibility of its placement to specialized school.
13. For the orphan children and children without parental support sent to specialized school except the above-stated documents, in personal records also there shall be following documents:
copies of the solution of hokim of the area (city) on establishment of guardianship or determination in educational institution for orphan children and children without parental support;
information about the parents or persons replacing parents (passport copies or death certificates of parents, sentences or the judgments, the certificate of long-period illness of parents and other documents confirming absence of parents or impossibility of education of the children by them);
the belongings list of the minor who remained after parents (if it is available), with indication of where the property is what measures are taken to ensuring its safety and the information about persons who are responsible for its safety;
documents on fixing of living space to the minor (copies of the order, the house register, the plan of housing, the reference from branch of the state company of land management and the inventory of the real estate of the Republic of Karakalpakstan, areas and Tashkent in the respective district (city) of the area (city) about the owner and the fact of privatization of housing);
the pension book on the minor receiving pension, the copy of the judgment about collection of the alimony for benefit of the child, the savings book.
14. Pupils can contain in specialized school before achievement of sixteen years by them.
In exceptional cases stay of pupils in specialized school can be prolonged before achievement of seventeen-year age by them.
Minors are in specialized school before correction, but no more than three years.
The district (city) interdepartmental commission for minors in the location of specialized school can permit the pupil to remain in the specified organization and after three-year term before the termination of the corresponding class current academic year.
The pupils of specialized school who reached fifteen years (completed receipt of general secondary education), but did not correct the behavior can be sent by the district (city) commission for minors in the location of such schools to specialized professional colleges.
15. The question of feasibility of further stay of pupils at specialized school periodically, but at least once a year, is considered by the district (city) interdepartmental commissions for minors in the location of these organizations at the initiative of this commission, on representation of specialized school to administration or according to the petition of the parents or persons replacing parents.
16. Minors with the physical defects and diseases provided by the list of the diseases interfering the contents, education and education of minors in specialized teaching and educational agencies approved by the Ministry of Health of the Republic of Uzbekistan cannot be placed in specialized school.
17. Stay of the pupil in specialized school stops under the resolution of the district (city) interdepartmental commission for minors in the location of this organization, based on the decision of the faculty meeting approved by the head what at least a month before release of the pupil the interdepartmental commission for minors in the place of his residence which shall take measures to employment or the direction of the minor in educational institution and to creation to it necessary material living conditions is informed on.
18. In case of release of the pupil from specialized school the set of clothes and footwear which was in its use during education and training is issued to it free of charge.
In case of release from specialized school education documents of the established sample are issued to the pupils who underwent final state assessment.
The reference of the established sample is issued to the pupils who did not complete education.
19. Pupils aged up to sixteen years in case of release go to the place of their permanent residence accompanied by employees of specialized school, parents or persons replacing parents.
20. The procedure for content, education and training of pupils at specialized school is established taking into account their specific features, age, sex, mental and physical condition.
Living conditions of specialized school shall promote rehabilitation process, create conditions for removal at pupils of emotional pressure.
21. Training at specialized school is conducted on the basis of curricula and educational programs of general secondary education according to the procedure, established by the Ministry of national education of the Republic of Uzbekistan.
The beginning of academic year, duration of studies and vacation, and also carrying out final state assessment and procedure for issue of education documents are determined according to the legislation.
22. At specialized school the following main forms of studies are established:
lessons, practical and laboratory researches, open classrooms and consultations. The obligatory studies determined by curricula and educational programs are supplemented with independent work of pupils.
The fullness of groups and classes at specialized school makes 25 people.
23. Under the organization of educational process the specialized school interacts with healthcare institutions, cultures, sport and other organizations.
24. The day regimen providing reasonable combination of education, training, work and rest is constituted taking into account duration of stay of pupils at specialized school.
25. Labor education of children is performed on the basis of training combination to acquisition of labor skills taking into account medical indications and pedagogical recommendations.
26. For pupils at specialized school different circles, clubs on interests, section (including sports) and the studios intended for development of mental, physical and creative abilities of pupils are created.
27. During summer vacation the specialized school can organize for pupils of the camp of rest, and also use other forms of organized leisure.
28. At specialized school it is created психолого - the medico-pedagogical commission which procedure for functioning is established by the Ministry of national education of the Republic of Uzbekistan.
Психолого - the medico-pedagogical commission considers each six months dynamics of rehabilitation process and introduces amendments in the individual work plan with the pupil.
According to the decision of the faculty meeting accepted based on the conclusion психолого - the medico-pedagogical commission, the administration of specialized school brings in the interdepartmental commission for minors in the location of the specified organization of representation on questions:
transfer of the pupil in other specialized teaching and educational agency;
the termination of stay of the pupil in the specified organization before the expiration of the term established by court if it in view of correction does not need further application of this corrective action or for health reasons cannot be in it;
prolongation of term of stay of the pupil in the specified organization in case of need completion of its training.
29. Participants of educational process of specialized school are pupils and pedagogical workers.
30. Pupils have the right to free general secondary education according to the state educational standards, qualified medical attendance, participation in the different circles, clubs, sections and studios intended for development of their mental, physical and creative abilities.
31. The right is in accordance with the established procedure provided to pupils of specialized school on:
the notification of the parents or persons replacing parents on their delivery or the room in specified organizations;
appeal of decisions of the bodies and organizations performing prevention of neglect and offenses among minors and actions (failure to act) of officials in higher bodies, the interdepartmental commissions on cases of minors, bodies of prosecutor's office or court;
the humane, not degrading honor and human dignity address;
maintenance of communication with family by telephone negotiations, communication via other means of communication and appointments, receipts of sending, parcels post, transfers, obtaining and departure of letters and telegrams without restriction of their quantity;
receipt of free food, clothes, footwear and other objects of ware allowance of the approved regulations.
32. Content and training of pupils at specialized school is performed on the basis of the state providing according to the legislation.
Regulations of providing with food, clothes, footwear, other objects of ware allowance and soft stock of pupils of specialized school are established by the Ministry of national education and the Ministry of Health of the Republic of Uzbekistan in coordination with the Ministry of Finance of the Republic of Uzbekistan.
33. Medical care is provided to pupils with regular health workers of specialized school and healthcare institution for the location of specialized school according to the procedure, established by the legislation.
34. In case of deterioration in the state of health of the pupil or his death the administration of specialized school immediately notifies on it his parents or persons replacing parents, and in the absence of those - the interdepartmental commission for minors in the place of permanent residence of the pupil.
35. In case of the death of the parents or persons replacing parents, the pupil has the right to be present at their funeral, and in case of serious illness of the parents or persons replacing parents - to visit them. Expenses on journey are made at the expense of means of specialized school.
36. During stay of the pupil in specialized school according to the decision of administration of specialized school he can be released for vacation.
37. Pupils shall observe the charter, and also regulations of specialized school.
38. The pupil's exit out of limits of the territory of specialized school is performed only accompanied by employees of specialized school or parents or persons replacing parents (except as specified, specified in Items 35 and 36), with the written permission of management of specialized school.
39. In case of unauthorized leaving of the pupil out of limits of specialized school the administration informs on it his parents or persons replacing parents law-enforcement bodies in the location of the specified organization and at the place of residence or the place of stay of the pupil and together with law-enforcement bodies takes measures for its detection and return to specialized school.
40. For making of illegal actions, gross and numerous violations of the charter or regulations of specialized school the following measures of authority punishment can be applied to pupils:
prevention;
announcement of reprimand;
discussion at meeting of pupils, faculty meeting of specialized school;
deprivation of the right to go beyond specialized school in Sunday and holidays, vacation time;
the message to the parents or persons replacing parents about violation.
In relation to pupils it is not allowed: application
methods of physical and mental abuse, corrective actions degrading honor and advantage of the personality;
restriction or deprivation of pupils of contacts with the parents or persons replacing parents;
reduction of regulations of food, deprivation of pupils of walks.
41. For progress in study, good behavior, active participation in public life for pupils of specialized school the following measures of encouragement are established:
announcement of gratitude;
rewarding with the letter, valuable present;
removal of earlier imposed penalty;
the message to the parents or persons replacing parents about good behavior and progress in study;
trip for vacation to the parents or persons replacing parents;
provision of the right of exit out of limits of specialized school accompanied by employees of specialized school, parents or persons replacing parents.
42. Measures of encouragement and authority punishment are applied by the director of specialized school by the publication of the relevant order.
43. The procedure for completing of specialized school by pedagogical workers is regulated by its charter.
For pedagogical work persons having necessary professional and pedagogical qualification which conforms to requirements of the qualification characteristic for position and profession are accepted and it is supported by education documents.
44. Pedagogical employees of specialized school have the participation right in the management of organization according to the procedure determined by its charter to protection of professional honor and advantage.
Pedagogical employees of specialized school have the right on social the privilege and guarantees established by the legislation.
Pedagogical workers can have and other rights according to the legislation.
45. Pedagogical workers shall:
provide training and education of children at the high professional level, to constantly enhance the professional skills and pedagogical skill;
observe pedagogical ethics, respect advantage of the child, protect children from violence expressions, bring up them in the spirit of respect for work, parents, respect for the environment.
Pedagogical workers can perform also other duties according to the legislation.
46. The parents or persons replacing parents have the right to visit pupils without any limit, to get acquainted with teaching and educational activities of specialized school, the course of social and pedagogical rehabilitation of their children.
47. Direct management of specialized school is performed by the director appointed to position by the Ministry of national education of the Republic of Uzbekistan.
48. The director acts on behalf of specialized school, represents its interests, disposes се of property and signs agreements according to the procedure, established by the legislation.
49. Director:
makes decisions on the questions entering competence of specialized school and bears the personal responsibility for accomplishment of the tasks assigned to specialized school;
determines powers of the deputies, distributes obligations between workers;
within the competence issues orders and instructs, obligatory for pupils and all employees of specialized school;
signs employment contracts with pedagogical and other workers;
performs other powers according to the legislation.
50. The specialized school is created and councils which procedure for activities is established by the Ministry of national education of the Republic of Uzbekistan function pedagogical, methodical and the observation.
51. Financing of activities of specialized school is performed in the procedure established by the legislation for the account:
assignments from the Government budget of the Republic of Uzbekistan;
donations of physical persons and legal entities;
other sources which are not prohibited by the legislation.
52. The specialized school is financed based on the expense budget registered in the relevant financial bodies and approved according to the procedure, established by the legislation.
53. The staff list affirms in relation to the operating states of teaching and educational organizations taking into account specific features and specifics of organization.
54. The salary of employees of specialized school is established according to the legislation.
55. The specialized school keeps the financial and statistical reporting established by authorized state bodies.
56. Control of financial and economic activities of specialized school is exercised by the relevant financial bodies.
57. The specialized school has the right to perform international cooperation concerning enhancement of teaching and educational activities according to the legislation.
58. Reorganization and liquidation of specialized school are performed according to the procedure, established by the legislation.
59. In case of liquidation of specialized school money and its property, less payments on covering of its obligations, are used according to the legislation and its charter.
In case of liquidation of specialized school transfer of pupils in other educational institutions is provided.

creation of conditions for receipt of secondary vocational, professional education by children on the basis of the state educational standards;
implementation of measures for program implementation and the techniques directed to forming of law-abiding behavior of pupils, assistance in their social protection and versatile development.
5. In specialized professional college the special conditions of keeping of pupils providing are provided:
protection of the territory of specialized professional college;
personal security of pupils and their maximum security from negative impact;
restriction of free admission of strangers for the territory of specialized professional college;
restriction of free exit of the pupils containing in specialized professional college out of limits of its territory;
the round-the-clock control of pupils, including in time allowed for dream;
carrying out personal inspection of pupils, examination of their things and also received and the sending sent by them and other mailings.
6. The specialized professional college is created by the decision the Cabinet of Ministers of the Republic of Uzbekistan according to the procedure, established by the legislation.

10. The minors at the age of fifteen (completed receipt of general secondary education) up to eighteen years needing special conditions of keeping, education and education in cases can be placed in specialized professional college if they:
made socially dangerous acts, but did not reach age from which criminal prosecution is possible, or owing to the essential lagging in age development which is not connected with painful mental disturbance were not capable to understand value of committed act fully;
are exempted from criminal liability without solution of question of their guilt with transfer of materials for consideration of the interdepartmental commission on cases of minors;
are exempted from criminal penalty using enforcement power in the form of their placement to specialized teaching and educational agencies;
continue to make offenses or other antisocial actions, despite the carried-out individual scheduled maintenance.
11. The basis for the placement of minors to specialized professional college is determination of court.
Acceptance of minors in specialized professional college is performed based on determination of court in the directions provided by the Ministry of the higher and secondary vocational education of the Republic of Uzbekistan.
12. On each minor sent to specialized professional college, the inspector of prevention (in the Republic of Karakalpakstan and areas) and the inspector of prevention of offenses among minors and youth (in Tashkent) law-enforcement bodies with assistance of the employee of the center of social legal assistance the minor of law-enforcement bodies draws up the personal record.
The personal record of the minor contains the following documents:
determination of district (city) criminal court judge about the placement of the minor to specialized professional college;
certificate of birth, passport or other identity document;
education documents (in the presence);
the reference and the characteristic from the place of study;
act of inspection of living conditions and education of the minor;
the medical record with the corresponding references;
conclusion of healthcare institution about the state of health of the minor and possibility of its placement to specialized professional college.
13. For the orphan children and children without parental support sent to specialized professional college except above-stated, in personal records also there shall be following documents:

15. 16. Minors with the physical defects and diseases provided by the list of the diseases interfering the contents, education and education of minors in specialized teaching and educational agencies approved by the Ministry of Health of the Republic of Uzbekistan cannot be placed in specialized professional college.
17. Stay of the pupil in specialized professional college stops under the resolution of the district (city) interdepartmental commission for minors in the location of this organization based on the decision of the faculty meeting approved by the head what at least a month before release of the pupil the interdepartmental commission for minors in the place of his residence which shall take measures to employment or the direction of the minor in educational institution and to creation to it necessary material living conditions is informed on.
18. In case of release of the pupil from - specialized professional college the set of clothes and footwear which was in its use during education and training is issued to it free of charge.
In case of release from specialized professional college education documents of the established sample are issued to the pupils who underwent final state assessment.
The reference of the established sample is issued to the pupils who did not complete education.
19. Pupils aged up to sixteen years in case of release go to the place of their permanent residence accompanied by employees of specialized professional college, parents or persons replacing parents.
20. The procedure for content, education and training of pupils in specialized professional college is established taking into account their specific features, age, sex, mental and physical condition.
Living conditions of specialized professional college shall promote rehabilitation process, create conditions for removal at pupils of emotional pressure.
21. Training in specialized professional college is conducted based on curricula and educational programs of secondary vocational, professional education according to the procedure, established by the Ministry of the higher and secondary vocational education of the Republic of Uzbekistan.
The beginning of academic year, duration of studies and vacation, and also carrying out final state assessment and procedure for issue of education documents are determined according to the legislation.
22. In specialized professional college the following main forms of studies are established: lessons, practical and laboratory researches, open classrooms and consultations, theoretical and inservice training, work practice.
The obligatory studies determined by curricula and educational programs are supplemented with independent work of pupils.
Pupils are granted specialty option from among specialties, training in which is organized in specialized professional college.
The fullness of groups in specialized professional college makes 25 people. Inservice training by all professions is performed in groups till 10-15 of people.
The work practice is, as a rule, held in industrial practice workshops of specialized professional college.
23. Under the organization of educational process the specialized professional college interacts with healthcare institutions, cultures, sport and other organizations.
24. The day regimen providing reasonable combination of education, training, work and rest is constituted taking into account duration of stay of pupils in specialized professional college.
25. Labor education of children is performed on the basis of training combination to acquisition of labor skills taking into account medical indications and pedagogical recommendations.
26. For pupils in specialized professional college different circles, clubs on interests, section (including sports) and the studios intended for development of mental, physical and creative abilities of pupils are created.

28. In specialized professional college it is created психолого - the medico-pedagogical commission which procedure for functioning is established by the Ministry of the higher and secondary vocational education of the Republic of Uzbekistan.

According to the decision of the faculty meeting accepted based on the conclusion психолого - the medico-pedagogical commission, the administration of specialized professional college brings in the interdepartmental commissions for minors in the location of the specified organization of representation on questions:
the termination of stay of the pupil in the specified organization before the expiration of the term established by court if it in view of correction does not need further application of this corrective action or for health reasons cannot be in it;
prolongation of term of stay of the pupil in the specified organization in case of need completion of its training.
29. Participants of educational process of specialized professional college are pupils and pedagogical workers.
30. Pupils have the right to free secondary vocational, professional education according to the state educational standards, qualified medical attendance, participation in the different circles, clubs, sections and studios intended for development of their mental, physical and creative abilities.
31. The right is in accordance with the established procedure provided to pupils of specialized professional college on:

departure for vacation to the parents or persons replacing parents;
