About the tariff quotas on beef, pork and fowl in 2011

The government of the Russian Federation decides:

1. Approve distribution of amounts of the tariff quotas established for 2011 by the decision of the Commission of the Customs union of November 18, 2010 N 505 "About the Inventory concerning which since January 1, 2011 the tariff quotas, and also amounts of the tariff quotas for import of these goods in the territory of state members of the Customs union" concerning meat of cattle, fresh or cooled and refrigerated (the FEACN CU code 0201 and 0202), pork fresh are established, cooled or refrigerated and pork trimming (the FEACN CU code 0203), the refrigerated rolled meat of dunghill hens (the FEACN CU code 0207 14 100 1), the refrigerated not rolled half or quarter timbers of carcasses of dunghill hens (the FEACN CU code 0207 14 200 1), refrigerated not rolled legs of dunghill hens and pieces from them (the FEACN CU code 0207 14 600 1) and refrigerated the rolled meat of turkeys (the FEACN CU code 0207 27 100 1), between supplying countries according to appendix.

2. To the Ministry of Economic Development of the Russian Federation:

a) distribute:

till December 25, 2010 - 25 percent of amounts of the goods provided by appendix to this resolution, between the participants of foreign economic activity performing import to the territory of the Russian Federation of meat of cattle fresh or cooled and refrigerated (the FEACN CU code 0201 and 0202) (daleegovyadina), pork fresh, cooled or refrigerated and pork trimming (the FEACN CU code 0203) (further - pork) and fowl (the FEACN CU code 0207) (further - bird) in 2010 according to customs procedure of release for internal consumption with July 1, 2010 and customs regime of release for internal consumption till July 1, 2010 (further - customs procedure of release for internal consumption), in proportion to the amounts of beef, pork and bird imported according to customs procedure of release for internal consumption in 2008 - 2009 and from January 1 to September 30, 2010, except for beef the pork and bird occurring and imported by these participants from the State Parties of the CIS, and also the beef classified according to the Commodity Nomenclature of Foreign Economic Activity in 2008 - 2009 in subsubline items 0201 30 000 3, 0202 30 100 3, 0202 30 500 3, 0202 30 900 3 and in 2010 in subsubline items 0201 30 000 5, 0202 30 100 5, 0202 30 500 5, 0202 30 900 5;

till April 15, 2011 - 100 percent of the goods provided by appendix to this resolution less amounts of the goods distributed according to the paragraph third this Item between the participants of foreign economic activity performing import of beef, pork and bird in 2010 according to customs procedure of release for internal consumption in proportion to the amounts of beef, pork and bird imported by these participants according to customs procedure of release for internal consumption in 2008 - 2010, except for the beef, pork and the bird occurring and imported from the State Parties of the CIS, and also the beef classified according to the Commodity Nomenclature of Foreign Economic Activity in 2008 - 2009 in subsubline items 0201 30 000 3, 0202 30 100 3, 0202 30 500 3, 0202 30 900 3 and in 2010 in subsubline items 0201 30 000 5, 0202 30 100 5, 0202 30 500 5, 0202 30 900 5;

b) approve distribution technique between participants of foreign economic activity of amounts of the tariff quotas established concerning the goods provided by appendix to this resolution;

c) represent to the Ministry of Industry and Trade of the Russian Federation data on the amounts of the goods provided by appendix to this resolution distributed between participants of foreign economic activity according to the subitem "an" of this Item.

3. To the Ministry of Industry and Trade of the Russian Federation to perform from December 27, 2010 to December 31, 2011 inclusive issue of the licenses to participants of foreign economic activity for commodity importation provided by appendix to this resolution in the amounts distributed according to Item 2 of this resolution.

4. The decision on issue of the licenses for commodity importation provided by appendix to this resolution or on refusal in their issue is accepted by the Ministry of Industry and Trade of the Russian Federation in 5-day time from the date of submission in accordance with the established procedure of the corresponding statement.

Effective period of the specified licenses is established from January 1 to December 31, 2011 inclusive.

5. To the Ministry of Economic Development of the Russian Federation together with the Ministry of Agriculture of the Russian Federation:

a) perform monitoring of condition of the domestic market of meat products and deliveries of meat of cattle refrigerated (the FEACN CU code 0202) (further - the beef refrigerated) and pork on the territory of the Russian Federation taking into account prohibitions and (or) import restrictions of the beef refrigerated or pork from any state (the union of the states), and also requirements of the legislation of the Russian Federation in the field of the ensuring epizootic and sanitary and epidemiologic wellbeing, consumer protection leading to prohibition and (or) restriction of import of the beef refrigerated or pork from any state supplier (the union of the states), or lack of necessary amount of the beef refrigerated or pork in the markets of any state supplier (the union of the states);

b) represent to subcommittee on customs tariff and non-tariff regulation, protective measures in foreign trade of Government Commission on Economic Development and Integration (further - subcommittee) offers on supply rates of the beef refrigerated or pork on account of amounts (part of amounts) of the tariff quotas established for the state supplier (the union of the states), from any other state supplier (the union of the states) if the amount of import of the specified goods within the tariff quota of this state supplier (the union of the states) made within 2 months of less 11,5 of percent of amount of the annual tariff quota as a result of the circumstances specified in the subitem "an" of this Item.

6. To the Ministry of Industry and Trade of the Russian Federation taking into account the offers on supply rates of the beef refrigerated approved by subcommittee or pork on account of amounts (part of amounts) of the tariff quotas established for the state supplier (the union of the states) from any other state supplier (the union of the states) and based on the statement of the participant of foreign economic activity to draw up licenses for import of the beef refrigerated or pork from any other state supplier (the union of the states) within the total amount distributed to the participant of foreign economic activity according to the subitem "an" of Item 2 of this resolution.

7. To Federal Service for Veterinary and Phytosanitary Surveillance in 3-day time from the date of introduction or cancellation of the measures taken for the purpose of ensuring epizootic wellbeing leading to prohibition and (or) restriction of import of the beef refrigerated and pork from any state supplier (the union of the states) to inform the Ministry of Economic Development of the Russian Federation, the Ministry of Agriculture of the Russian Federation, the Ministry of Industry and Trade of the Russian Federation and the Federal Customs Service on such measures.

8. To Federal Service for the Oversight of Consumer Protection and Welfare in 3-day time from the date of introduction of the measures taken for the purpose of the ensuring sanitary and epidemiologic wellbeing and consumer protection and the consumer market leading to prohibition and (or) restriction of import of the beef refrigerated and pork from any state supplier (the union of the states) to inform the Ministry of Economic Development of the Russian Federation, the Ministry of Agriculture of the Russian Federation, the Ministry of Industry and Trade of the Russian Federation and the Federal Customs Service on such measures.

9. Represent to the Federal Customs Service to the Ministry of Economic Development of the Russian Federation:

a) till March 1, 2011 - the list of the participants of foreign economic activity importing beef, pork or bird according to customs procedure of release for internal consumption from January 1 to December 31, 2010, except for the beef, pork or the bird occurring and imported from the State Parties of the CIS;

b) since February, 2011, to the 15th following for reporting - data on the amounts of beef and pork imported on the territory of the Russian Federation in month under report on account of amounts of the tariff quotas and out of the established amounts of the tariff quotas.

10. Recognize voided since January 1, 2011:

the order of the Government of the Russian Federation of December 16, 2009 N 1021 "About import of beef, pork and fowl in 2010 - 2012" (The Russian Federation Code of the Russian Federation, 2009, N 51, the Art. 6323);
