About approval of the Instruction for representation of the second level by banks, Development bank of Kazakhstan and the mortgage organizations in National Bank of the Republic of Kazakhstan of data for forming of the overview of the financial sector
According to the Law of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan" and for the purpose of creation of the overview of the financial sector of the Republic of Kazakhstan, the Board of National Bank of the Republic of Kazakhstan DECIDES:
2. This resolution becomes effective from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan and extends to the relations which arose since January 1, 2011.
3. From the date of enforcement of this resolution to recognize invalid:
1) the resolution of Board of National Bank of the Republic of Kazakhstan of December 6, 2003 No. 438 "About approval of the Instruction about the list, forms and terms of submission of the reporting by banks of the second level and the mortgage companies in National Bank of the Republic of Kazakhstan for creation of monetary and financial review" (registered in the Register of state registration of regulatory legal acts at No. 2636);
2) the resolution of Board of National Bank of the Republic of Kazakhstan of May 13, 2005 No. 59 "About modification and amendments in the resolution of Board of National Bank of the Republic of Kazakhstan of December 6, 2003 No. 438 "About approval of the Instruction about the list, forms and terms of submission of the reporting by banks of the second level, credit partnerships and the mortgage companies in National Bank of the Republic of Kazakhstan for creation of monetary and financial review" (registered in the Register of state registration of regulatory legal acts at No. 3688);
3) the resolution of Board of National Bank of the Republic of Kazakhstan of June 5, 2006 No. 51 "About modification and amendments in the resolution of Board of National Bank of the Republic of Kazakhstan of December 6, 2003 No. 438 "About approval of the Instruction about the list, forms and terms of submission of the reporting by banks of the second level, credit partnerships and the mortgage companies in National Bank of the Republic of Kazakhstan for creation of monetary and financial review" (registered in the Register of state registration of regulatory legal acts at No. 4269).
4. To department of researches and statistics (Shaykakova G. Zh.):
1) together with Legal department (Urtembayev A. K.) take measures to state registration in the Ministry of Justice of the Republic of Kazakhstan of this resolution;
2) in ten-day time from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan of this resolution to bring it to the attention of the interested divisions of central office and territorial branches of National Bank of the Republic of Kazakhstan, Agency of the Republic of Kazakhstan on regulation and supervision of the financial market and the financial organizations, Consolidation of legal entities "The association of financiers of Kazakhstan", "Kazakhstan Fund of Guaranteeing Deposits" joint-stock company, banks of the second level, Development Bank of Kazakhstan joint-stock company.
5. To territorial branches of National Bank of the Republic of Kazakhstan in three-day time from the date of receipt of this resolution to bring it to the attention of the mortgage organizations.

1. The instruction for representation of the second level by banks, Development bank of Kazakhstan and the mortgage organizations in National Bank of the Republic of Kazakhstan of data (further - the Instruction) is developed for forming of the overview of the financial sector according to the laws of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan", of August 31, 1995 "About banks and banking activity in the Republic of Kazakhstan" (further - the Law on banks) and disaggregates procedure for submission to National Bank of the Republic of Kazakhstan (further - National Bank) the data for forming of the overview of the financial sector (further - data) banks of the second level, Development bank of Kazakhstan and the mortgage organizations.
2. Data are constituted based on accounting data according to the Instruction.
3. In the Instruction the following concepts are used:
1) the affiliated organizations of special purpose - the affiliated organizations created by the Kazakhstan companies abroad for the purpose of attraction of financial resources in the international markets of the capital;
2) institutional units - the economic units owning assets, assuming liabilities which are engaged in economic activity and transactions with other institutional units;
3) the financial organizations - institutional units which main function is the financial intermediation and/or the related auxiliary financial activities;
4) the non-financial organizations - institutional units which core activity is production of market goods and non-financial services;
5) state bodies are the legal subjects formed as a result of political processes, having the legislative, judicial or executive authority which extends to the institutional units located within the established territory;
6) non-profit organizations - the legal or public organizations created for the purpose of production of goods and services whose status does not allow them to be source of the income, profit or other pecuniary benefit for the units creating, controlling or financing these organizations;
7) households - the institutional units consisting of physical persons, and also of small groups of the physical persons (family) living jointly, combining (fully or partially) the income and property, and jointly consuming certain types of goods and services (housing, food and another);
8) the international interbank system of continuous connected calculations (further - the international interbank CLS system) - the payment service provider specializing in calculations for currency transactions through which the largest world banks trade in the international foreign exchange market in real time and which allows to exclude credit risk when calculating for currency transactions;
9) the sector of economy - division of economy which includes group of the institutional units combined on main type of their activities and form of business.
3-1. The concept "the organization performing separate types of banking activities" is used in the value determined in article 5 of the Law on banks.
4. The concepts "resident" and "nonresident" are used in the values determined by the Law of the Republic of Kazakhstan of June 13, 2005 "About currency control and currency exchange control".
5. Data include the list of indicators for creation of the overview of the financial sector in the form established by appendix 1 to the Instruction, and data on transactions with branches and representative offices of the foreign companies in the form established by appendix 2 to the Instruction.
6. Data in the form established by appendix 1 to the Instruction are represented on daily and monthly basis. Data in the form established by appendix 2 to the Instruction are represented monthly.
7. The institutional units constituting economy in general are grouped to the following five mutually exclusive institutional sectors:
1) sector of state bodies;
2) sector of the financial organizations;
3) sector of the non-financial organizations;
4) the sector of the non-profit organizations servicing households;
5) sector of households.
8. The sector of state bodies includes the following splits:
1) the Government of the Republic of Kazakhstan or the Government of foreign state - the code "1";
2) regional and local authorities of management - the code "2".
The code "1" includes the ministries, departments and the agencies financed from means of the republican budget, research institutions, institutional units - agents of the Government of the Republic of Kazakhstan, the funds controlled by state bodies and financed from means of the republican budget and also other organizations which are under control of the state, performing the functions inherent to state bodies and not engaged in market production.
The code "2" includes the institutional units performing management functions at the level of the area, the city and the area and the organizations financed from means of local budgets.
9. The sector of the financial organizations includes the following splits:
1) the Central (national) Bank - the code "3";
2) other deposit organizations (further - banks of the second level) the code "4";
3) other financial organizations (further - the financial organizations) - the code "5".
The code "3" includes institutional units which exercise control over key aspects of financial system. The Central (national) Banks to which such activities as issue of national currency, management of the international reserves of the country, transaction with the IMF and other international financial institutions, loan granting are inherent to other deposit corporations treat this split.
The code "4" includes institutional units which core activity is the financial intermediation and which obligations have the form of deposits or their analogs (close substitutes of deposits which join in national determination of wide money).
The code "5" includes all other institutional units of this sector which perform intermediary or auxiliary financial activities, or combine these functions. Such organizations as the credit partnerships, microcredit institutions, the insurance (reinsurance) organizations, the accumulation pension funds, pawnshops, the mortgage organizations, financial leasing companies, factoring companies, the affiliated organizations of special purpose, investment funds, other organizations performing separate types of banking activities, and also currency and stock exchanges, dealers, brokers and agents, different intermediaries in receipt of the credit, insurance brokers, funds of guaranteeing, exchange points and other financial organizations treat this group.
10. The sector of the non-financial organizations includes the following splits:
1) the state non-financial organizations - the code "6";
2) the non-state non-financial organizations - the code "7".
The code "6" includes the institutional units which are engaged mainly in market production and controlled by state bodies.
Control of state bodies is exercised:
by acquisition of the controlling stake of voting shares or establishment of other forms of control over more than half of voices of shareholders;
as a result of the adoption of the special legislation, the decree or provision granting to state bodies the right to determine policy of corporation or to appoint her directors.
This subgroup does not join those non-profit organizations which are controlled and financed by state bodies as they treat the sector of state bodies.
11. The sector of the non-profit organizations servicing households - the code "8" - includes institutional units:
1) which are created by associations of persons to provide with goods or services of members of these associations. Such services are usually provided free of charge or financed by the regular membership fees. Public associations, including religious associations, political parties, labor unions, the national cultural centers and others treat them;
2) core activity of which is rendering the charitable help. Charitable organizations and agencies on assistance to victims or persons in need who are created for charitable purposes for servicing of interests of members of society treat them. These non-profit organizations servicing households are engaged on non-market basis in provision of goods or services to the households needing them. Means of such non-profit organizations servicing households are formed at the expense of the donations in cash or natural form arriving from the public, state bodies and transfers from nonresidents.
12. The sector of households - the code "9" - includes the institutional units consisting of physical persons, and also of the small groups of the physical persons (family) living jointly, combining (fully or partially) the income and property, and jointly consuming certain types of goods and services (housing, food and another). In this group the physical persons who are engaged in business activity without formation of legal entity also belong.
13. For the coding of the indicators specified in appendices 1 and 2 to the Instruction the following currency types are used:
1) the Kazakhstani tenge - national currency of the Republic of Kazakhstan (further - tenge) - the code "1";
2) freely convertible currency (further - hard currency) - the code "2".
Types of the foreign currencies accepted for calculations in the international interbank CLS system and for which there are no restrictions on payments in this currency concern to the hard currency group.

3) other currency types (further - DVV) - the code "3".
The currencies which are not tenge and not entering into the hard currency group concern to the DVV group.
14. Data in appendices 1 and 2 to the Instruction are represented according to numbers of indicators which are disaggregated further on signs of residence, the sector of economy and currency type.
The structure of measure codes in appendices 1 and 2 to the Instruction represents system of digital symbols: AAAA X U Z (further - code), where:
AAAA - number of indicator;
X - residence sign ("1" - resident of the Republic of Kazakhstan, "2" - the nonresident of the Republic of Kazakhstan);
Y - sign of the sector of economy (the description of sectors of economy is provided in Items 7 - 12 Instructions);
Z - currency type sign ("1" - tenge, "2" - hard currency, "3" - DVV).
15. Zero designation of data in X, Y and Z symbols means lack of disaggregation on this line item.
16. Disaggregation of assets on X and Y symbols is made on residence and the sector of economy of the debtor (issuer), disaggregation of obligations on the same line items - on residence and the sector of economy of the creditor.
17. According to numbers of indicators 1405, of 1406, of 1425, of 1752, 1864 the sector of economy of the drawer is put down.
17-1. According to numbers of indicators 1401, of 1411, of 1417, of 1420, of 1421, of 1424, of 1740, 1741 on the sector of economy "5" data on those financial organizations which have no license of authorized body and which are not considered in indicators of group 1320 and in numbers of indicators 1733, 1734 are represented.
18. According to numbers of indicators 2301, of 2303, of 2306, of 2401, of 2402, of 2405, 2406 in case of lack of opportunity to authentically determine residence and the sector of economy of the security holder the residence and the sector of economy of the nominee holder (incorporated trustee) is specified.
19. If transaction on placement of deposits of banks of the second level and the mortgage organizations in the organizations performing separate types of banking activities or in Kazpochta joint-stock company takes place, this transaction is reflected in accounts of group 1250 "The deposits placed in other banks" with indication of the relevant sector of economy.
20. In appendices 1 and 2 to the Instruction the following classification of assets and liabilities by terms is accepted:
1) short-term - up to one year inclusive;
2) long-term - over one year.
21. In appendix 2 to the Instruction data on transactions only with the branches and representative offices of the foreign companies performing the activities in the territory of the Republic of Kazakhstan and belonging to nonresidents are represented.
Data are represented with disaggregation by the following sectors of economy:
1) other financial organizations - the code "5";
2) the state non-financial organizations - the code "6";
3) the non-state non-financial organizations - the code "7";
4) the non-profit organizations servicing house хозяйствакод "8".
Sectors of economy of branches and representative offices of the foreign companies performing the activities in the territory of the Republic of Kazakhstan correspond to sectors of economy of their head companies.
22. Banks of the second level, except for case, the stipulated in Item 22-1 Instruction, represent to National Bank:
1) the having no more than ten branches:
daily data - no later than two working days following behind reporting day (except for data for the first reporting days of month which are represented along with monthly data);
monthly data - no later than three working days following behind the last day of month under report;
2) the having ten and more branches:
daily data - no later than three working days following behind reporting day (except for data for the first reporting days of month which are represented along with monthly data);
monthly data - no later than five working days following behind the last day of month under report.
22-1. No. 73 is not effective according to the Resolution of Board of National Bank of the Republic of Kazakhstan of 08.05.2015.
23. Development bank of Kazakhstan represents data monthly - no later than three working days following behind the last day of month under report.
24. The mortgage organizations represent data to territorial branches of National Bank in the place of the stay monthly, no later than the eighth following reporting.
25. Banks of the second level and Development bank of Kazakhstan represent data to National Bank in electronic form with use of transport system of the guaranteed delivery of information with cryptographic remedies providing confidentiality and not adjustability of the represented data.
26. The mortgage organizations represent data to territorial branches of National Bank in electronic form in the place of the stay.
27. No later than the fifteenth following the accounting period, the territorial branch of National Bank sends to National Bank of the data in electronic form with use of transport system of the guaranteed delivery of information with cryptographic remedies providing confidentiality and not adjustability of the represented data.
28. Data are constituted in tenge.
29. The unit of measure used in case of creation of data is established in thousands of tenges. The amount less than five hundred tenges is rounded to zero, and the amount, equal five hundred tenges and above, is rounded to one thousand tenges.
