About approval of standards of rendering special social services in the field of social protection of the population

According to the subitem 2) of article 8 of the Law of the Republic of Kazakhstan of December 29, 2008 "About special social services" I ORDER:

1. Approve:

1) the standard of rendering special social services in the field of social protection of the population in the conditions of hospital according to appendix 1 to this order;

2) the standard of rendering special social services in the field of social protection of the population in the conditions of semi-hospital according to appendix 2 to this order;

3) the standard of rendering special social services in the field of social protection of the population in the conditions of rendering services at home according to appendix 3 to this order.

2. To department of the public assistance and social services (Manabayeva K. A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and official publication in the procedure established by the legislation;

2) finishing this order to regional, the cities of Astana and Almaty of managements of coordination of employment and social programs.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Nusupova A. B.

4. Declare invalid some orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 4 to this order.

5. This order becomes effective from the date of the first official publication and extends to the relations arising since January 1, 2011.

The standard of rendering special social services in the field of social protection of the population in the conditions of hospital

1. General provisions

1. The standard of rendering special social services in the field of social protection of the population in the conditions of hospital (further - the Standard) is developed according to the Laws of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" and of December 29, 2008 "About special social services".

2. This Standard establishes amount and requirements to conditions and procedure for provision of special social services in the organizations of stationary type of the state and non-state patterns of ownership intended for the round-the-clock permanent or temporary residence in the conditions of hospital are determined by procedure for activities of the medico-social organizations, conditions of acceptance, content, the statement (assignment), temporary disposal and transfer from MSO of handicapped children with psychoneurological pathologies (further - children), handicapped children with violations of the musculoskeletal device (daleedeta with violations the ODE), disabled people are more senior than eighteen years with psychoneurological diseases (further - persons 18 years of age or over), disabled people of the first and second groups (further - disabled people), persons not capable to independent servicing in connection with old age (further - aged). The categories stated above jointly hereinafter are referred to as receivers of services.

3. The organizations of stationary type medico-social organizations (organizations) intended for round-the-clock permanent or temporary (for up to three months) accommodation of receivers of services in the conditions of hospital are recognized (further - the organizations of stationary type).

4. This Standard is observed by all subjects providing special social services in the conditions of hospital irrespective of patterns of ownership.

5. The costs connected with provision of services are compensated by budget funds.

6. The organizations of stationary type are intended for round-the-clock permanent or temporary (for up to three months) accommodation:

1) children from 3 to 18 years needing rendering special social services in the conditions of hospital owing to:

intellectual backwardness of all degrees, including in the presence of gross violations of the motive functions complicating training in special (auxiliary) classes of the special correctional organizations of education (not moving without assistance, not servicing themselves in the gravity of motive violations, requiring individual care);

blindness (slabovideniye) or deafness of mentally retarded (slaboslyshaniye) of all degrees, including in the presence of gross violations of the motive functions complicating training at specialized boarding schools;

epilepsies (including symptomatic) with rare (is not more often than five times a month) attacks in the presence of weak-mindedness;

schizophrenia with the expressed defect without productive symptomatology;

weak-mindednesses after the postponed organic damages of brain.

Medical contraindications to accommodation of children in the organizations of stationary type are availability:

schizophrenia with productive symptomatology;

epilepsies with frequent (more than five times a month) attacks, tendency to serial attacks, the epileptic status, twilight conditions of consciousness, dysphoria;

psikhopatopodobny symptomatology within any nosological accessory;

the mental diseases which are followed by the gross violations of inclination and disorders of behavior dangerous to children and people around;

tuberculosis in active stage of process, quarantine infections, infectious diseases of skin and hair, venereal diseases, AIDS;

other diseases requiring hospitalization in the specialized medical organizations;

2) children with violations the ODE from 3 to 18 years with safe intelligence needing rendering special social services in the conditions of hospital.

Medical contraindications to accommodation of children with violations the ODE in the organizations of stationary type are availability:

mental diseases;

oligophrenias of all degrees;

frequent epileptiform attacks (more than five times a month);

psikhopatopodobny disorders of behavior;

noncompensated hydrocephaly;

drug addiction and alcoholism with sharp psychotic symptomatology;

psikhopatopodobny forms of behavior and (or) intellectual мнестическими frustration;

tuberculosis in active stage of process, quarantine infections, infectious diseases of skin and hair, venereal diseases, AIDS;

other diseases requiring hospitalization in the specialized medical organizations;

3) persons 18 years of age or over with psychoneurological diseases of the first, second groups needing rendering special social services in the conditions of hospital owing to:

intellectual backwardness of all degrees, including in the presence of gross violations of motive functions (not moving without assistance, not servicing themselves in the gravity of motive violations, requiring individual care);

blindness (slabovideniye) or deafness of mentally retarded (slaboslyshaniye) of all degrees, including in the presence of gross violations of motive functions;

long forms of the mental diseases which are characterized by lack of sharp psychotic symptomatology, availability of weak-mindedness or rough manifestations of mental defect;

schizophrenia with the expressed defect of the personality out of aggravation of psychotic symptomatology;

different forms of epilepsy with the phenomena of weak-mindedness and rare (no more than five times a month) convulsive attacks and equivalents;

effects of infectious and other organic diseases of brain (encephalitis, tubercular meningitis, meningoentsefalita, syphilis of brain and other infectious and organic diseases) with the weak-mindedness phenomena;

effects of chronic alcoholism with the phenomena of the expressed weak-mindedness;

vascular and senile diseases with the weak-mindedness phenomena without the expressed psychomotor concern and long or recidivous conditions of the changed consciousness.

Medical contraindications to accommodation of persons 18 years of age or over in the organizations of stationary type are availability:

tuberculosis in active stage of process, quarantine infections, infectious diseases of skin and hair, venereal diseases, AIDS;

other diseases requiring hospitalization in the specialized medical organizations;

mental diseases in sharp and subacute stage;

conditions of aggravation of chronic mental disease;

the mental diseases which are characterized by the expressed psychotic symptomatology, gross violations of inclination and the disorders of behavior dangerous to the most sponsored person and people around, namely any pristupoobrazny or progrediyentno the current mental diseases with tendency to frequent aggravations or recurrence of disease with frequent decompensations needing hospitalization in the specialized medical organizations;

epilepsy and convulsive syndrome of other etiology with frequent (more than five times a month) attacks, tendency to serial attacks, the epileptic status, twilight condition of consciousness, to dysphorias;

the chronic alcoholism, drug addiction, other mental diseases complicated by chronic alcoholism or any kinds of drug addiction;

the expressed depressive and maniacal conditions of different genesis, long reactive conditions;

the expressed psikhopatopodobny syndromes, psychopathia explosive, paranoid, paranoyalny, hysterical;

Medical contraindications to accommodation at the organizations of stationary type for disabled people and aged are tuberculosis availability in active stage of process, mental diseases (except for neurosises, nevrozopodobny conditions in case of somatic diseases, easy degree of moronity, convulsive syndromes of different etiology with rare (no more once in 2-3 months) attacks, without weak-mindedness and the expressed changes of the personality), quarantine infections, infectious diseases of skin and hair, venereal diseases, AIDS, and also the diseases requiring treatment in the specialized medical organizations.

7. The organization of stationary type is legal entity, is created by his founder and performs the activities according to the constituent documents existing with legislative and other regulatory legal acts of the Republic of Kazakhstan.

8. The organizations of stationary type are created in type:

1) medico-social organization (organization) for handicapped children with psychoneurological pathologies;

2) medico-social organization (organization) for disabled people with psychoneurological diseases;

3) medico-social organization (organization) for aged and disabled people;

4) medico-social organization (organization) for handicapped children with violations of the musculoskeletal device;

5) other organizations intended for rendering special social services in the conditions of the round-the-clock accommodation.

2. Tasks and functions of the organization of stationary type

9. The main objectives of the organization of stationary type are:

creation for receivers of services, the most adequate to age and the state of health of the conditions of life activity which are brought closer to house;

provision of special social services in the conditions of hospital according to the amounts established by this Standard;

rendering special social services taking into account individual needs of receivers of the services oriented to increase in level of their personal development, socialization and integration;

improvement of quality and efficiency of the provided special social services;

protection against all forms of discrimination, physical or mental abuse, insult, ill-treatment.

10. The main functions of the organization of stationary type are:

1) acceptance and accommodation of receivers of services taking into account their disease, weight of condition, age, holding actions for their adaptation to new situation;

2) ensuring integrity of human beings and safety of receivers of services;

3) creation of favorable moral and psychological climate in the organization of stationary type;

4) rendering the versatile help to receivers of services by provision of complex of the necessary special social services directed to holding improving and social and rehabilitation actions according to this Standard;

5) improvement of conditions of accommodation of receivers of services, providing conditions for acceptance of visitors;

6) ensuring safety of personal belongings and values of receivers of services;

7) informing receivers of services and members of their families on amounts and types of special social services, regulations of the organization of stationary type;

8) enhancement of labor organization and advanced training of personnel;

9) execution of the functions of guardians and custodians assigned to administration of the organization of stationary type concerning receivers of the services needing the guardianship or custody, according to the procedure, established by the Law of the Republic of Kazakhstan of December 17, 1998 "About scrap and family";

10) implementation of financial and economic organization activity of stationary type;

11) other functions according to constituent documents of the organization of stationary type.

3. Acceptance conditions in the organization of stationary type

11. The direction of receivers of services in the organization of stationary type for provision of special social services by it at the expense of budgetary funds is performed regional, the cities of Astana and Almaty by authorized bodies in the field of social protection of the population (daleeupolnomochenny body) through district (city) authorized bodies of employment and social programs for the residence of the receiver of services.

12. The organization of stationary type of non-state pattern of ownership performs acceptance of receivers of services on contractual basis.
