About measures for strengthening of judicial protection of the rights and legitimate interests of subjects of business activity

In view of the value of work on timely and fair permission of the economic disputes arising in the field of entrepreneurship which increased in modern economic conditions, for the purpose of increase in efficiency of arbitral activities, and also considering that important guarantees of free development of the entrepreneurial circle, along with enhancement of economic and managerial regulators, are strengthening of the discipline of the civil agreement (the agreement, the contract) providing accomplishment by business entities of the assumed liabilities and real possibility of obtaining by participants of business activity of the immediate help of judicial authorities in recovery of the violated right, being guided by article 42 of the Constitution of the Kyrgyz Republic, I decide:

1. Consider priority in work on enhancement of arbitral rules and judicial processes the urgent solution of the following tasks:

- forming of the legal framework of development in the republic of the international commercial arbitration and reference tribunals resolving disputes in the field of contractual legal relationship;

- creation of conditions for receipt of the complete information by physical persons and legal entities about procedure for the appeal to judicial arbitral authorities behind protection of the violated right;

- the active implementation of insolvency proceedings under judicial supervision stimulating acceptance by owners of the companies of the preventive measures directed, first of all, to implementation of corporate management as one of the most effective forms of implementation of business activity;
