About enhancement of the state accreditation of institutions of health care
According to the resolution of the Cabinet of Ministers of Ukraine of 15.07.97 No. 765 "About approval of the Procedure for the state accreditation of institution of health care" I ORDER:
1. Approve:
1.1. The regulations on the Main accreditation commission under the Ministry of Health of Ukraine (are applied).
1.2. Criteria of the state accreditation of institutions of health care (are applied).
1.3. Standards of the state accreditation of treatment-and-prophylactic institutions (are attached).
2. In accordance with the established procedure to provide to department of management and quality control of medical services provision of this order on state registration in the Ministry of Justice of Ukraine.
3. To impose control over the implementation of the order on the First Deputy Minister Anishchenko O. V.
4. The order becomes effective from the date of its official publication.

1.1. The main accreditation commission under the Ministry of Health of Ukraine (further - SAC) is created according to the resolution of the Cabinet of Ministers of Ukraine of 15.07.97 No. 765 "About approval of the Procedure for the state accreditation of institution of health care" for carrying out the state accreditation of institutions of health care, except pharmaceutical (pharmaceutical) institutions (further - institutions).
1.2. SAC in the activities is guided by the Constitution of Ukraine, the laws of Ukraine, resolutions of the Cabinet of Ministers of Ukraine, other normative legal acts, including this Provision.
2.1. SAC carries out accreditation of institutions state, utility (including the institutions relating to the sphere of management of regional public administrations) and private patterns of ownership.
2.2. SAC carries out the analysis of the documents and expert opinions filed by institutions SAC (expert groups) and makes the decision concerning accreditation and reference of institution to the corresponding category (the second, the first, the highest) or on refusal in it.
2.3. SAC approves decisions of the accreditation commissions created in case of MZ of the Autonomous Republic of Crimea, managements (head departments) of health care of the regional, Kiev and Sevastopol city public administrations (further - the accreditation commissions), concerning accreditation of institutions of utility pattern of ownership (except for those which belong to the sphere of management of regional public administrations), and informs institution in 10dnevn_y term.
2.4. In case of decision making concerning reference of institution to the corresponding category SAC issues the accreditation certificate on the sample provided by appendix 2 to the Procedure for the state accreditation of institution of health care, approved by the resolution of the Cabinet of Ministers of Ukraine of 15.07.97 No. 765.
2.5. SAC carries out extraordinary accreditation of institutions, makes the decision on cancellation or decrease in category in accordance with the established procedure.
2.6. SAC keeps the State register of akcreditirovanny institutions.
2.7. SAC records, storage of forms of accreditation certificates, documents based on which accreditation of institution, in accordance with the established procedure was carried out.
3.1. SAC has the right to form expert groups at participation of specialists of research establishments, the highest medical educational institutions, including institutions (faculties) of post-qualifying education, MOZ of the Autonomous Republic, the Crimea, managements (head departments) of health care of the regional, Kiev and Sevastopol city public administrations, the companies, organizations and the organizations of health care, for the purpose of determination of compliance of institution to the approved standards of the state accreditation.
3.2. SAC has the right to request from MZ of the Autonomous Republic of Crimea, managements (head departments) of health care of the regional, Kiev and Sevastopol city public administrations, institutions, other companies, organizations and the organizations of health care, irrespective of pattern of ownership information (materials) on the questions which are within the competence SAC.
4.1. SAC consists of the chairman, the vice-chairman, members of the commission and the secretary.
4.2. SAC is the chairman the Minister of Health of Ukraine or his deputy. The members SAC affirm the order MZ.
4.3. SAC directs work the chairman together with deputies at joint meetings.
4.4. Activities SAC are performed according to the work plan which affirms the chairman SAC.
4.5. Meetings SAC take place if necessary, but at least once a month.
4.6. The decision SAC is made by a majority vote on condition of presence at meeting of two thirds of its structure, drawn up by the protocol which is signed presiding over meeting SAC and the secretary, and affirms the order MZ.
4.7. Secretaries of the accreditation commissions, experts SAC (chairmen of expert groups) can be invited to meeting SAC.
5.1. The expert SAC can be person having the higher medical education, length of service in at least 10 years, the highest qualification category on one of medical specialties and the certificate of the specialist doctor in "The organization and the management of health care" having the recommendation of the Ministry of Health of the Autonomous Republic of Crimea, managements (head departments) of health care of the regional, Kiev and Sevastopol city public administrations, which had special training and which based on the decision SAC is approved by the order MZ as the expert.
5.2. The expert in the work is guided by the legislation of Ukraine, including this Provision.
5.3. The expert in the order SAC and in time, certain SAC, carries out expertize of compliance to standards of the state accreditation (further - examination) institutions state, utility (including the institutions relating to the sphere of management of regional public administrations) and private patterns of ownership.
5.4. The expert is not entrusted with the examination of institution with which he is in employment or contractual relations.
5.5. The expert submits to MZ proposals concerning members of expert groups on conducting examination of institution with indication of date of its carrying out. MZ approves structure of expert group.
5.6. The expert provides in SAC the expert opinion on institution compliance to standards of the state accreditation in the form given in appendix to this Provision signed by members of expert group no later than within 14 days after examination completion.
5.7. The expert has the right:
get acquainted with originals and copies of the documents provided by standards of the state accreditation of institution;
refuse conducting examination till its beginning, having stated in writing motivated cause of failure which is provided SAC;
create expert group for conducting examination of institution taking into account organizational structure, type of the treatment-and-prophylactic help, profile and functions of institution.
5.8. The expert shall:
carry out expertize in the presence of the head of the institution undergoing the state accreditation, and/or person authorized by it;
carry out expertize of compliance of institution to the approved standards of the state accreditation objectively and impartially;
draw up the expert opinion on institution compliance to standards of the state accreditation and provide one its copy to institution management;
fulfill requirements of the current legislation concerning nondisclosure of obtained confidential information.
