According to Articles 94-97, 101, 103 Codes of penal procedure of Ukraine, Articles 201, 305 Criminal codes of Ukraine, for the purpose of unconditional observance of regulations of the criminal procedure legislation of Ukraine by customs authorities concerning obligation of reception of applications and messages on crimes, procedure for their consideration, and also increase in overall performance of customs authorities in the direction of counteraction to violations of the customs legislation I ORDER:

1. Approve the Procedure for acceptance, registration, accounting and consideration in customs authorities of statements and messages on crimes which are committed or prepare (further - the Procedure) which is applied.

2. To heads of customs authorities to finish the order note of staff and to provide steady observance of requirements of the Procedure.

3. To development department of customs infrastructure and international cooperation (Timofeev I. V.) provide production of 35 copies of the Book of accounting of statements and messages on crimes which are committed or prepare which form is given in appendix 2 to the Procedure, and 35 copies of the Stamp of accounting of the statement and the message on crime which committed or prepares which form is given in appendix 5 to the Procedure.

4. To department of fight against smuggling, risk analysis and anti-corruption (Bald V.M.), to Legal support division (Black G.M.) to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

5. Determine that this order becomes effective in 45 days from the date of its official publication.

6. To impose control over the implementation of this order on the vice-chairman of the State Customs Service of Ukraine Derivolkov S. D.

Procedure for acceptance, registration, accounting and consideration in customs authorities of statements and messages on crimes which are committed or prepare

I. General provisions

1.1. This Procedure establishes the single mechanism of acceptance, registration, accounting and consideration in customs authorities of statements and messages on crimes which are committed or prepare, and also determines the mechanism of departmental control of its observance.

Action of this Procedure does not extend to the procedures connected with data acquisition within production on cases on customs offense.

1.2. Reasons and the bases for initiation of legal proceedings are determined by the Code of penal procedure of Ukraine (further - the Code of Criminal Procedure).

1.3. For explanation to persons of procedure for acceptance, registration, accounting and consideration of the applications and messages on crimes who are committed or prepare, in customs authorities at the stands located in customs control zones, in premises of customs authorities in the places convenient for the free overview and also on the departmental Website of State Customs Service of Ukraine Information on acceptance, registration, accounting and consideration in customs authorities of statements and messages on crimes which are committed is placed or prepare (appendix 1 to this Procedure).

1.4. Terms in this Procedure are used in the following values:
