For the purpose of execution of Item 1.3 of the Presidential decree of the Azerbaijan Republic of October 30, 2009 No. 168 "About application of the Law of the Azerbaijan Republic "About modification and amendments in the Law of the Azerbaijan Republic "About power industry", "About gas supply" and the Law of the Azerbaijan Republic "About water supply and sewage" the Cabinet of Ministers of the Azerbaijan Republic decides the Law of the Azerbaijan Republic:

1. Approve Instructions for use by gas (are applied).

1-1. No. 159 is excluded according to the Resolution of the Cabinet of Ministers of the Azerbaijan Republic of 14.03.2024

2. This resolution becomes effective from the date of its signing.

Instructions for use gas

1. General provisions

1.1. The these rules developed according to the Law of the Azerbaijan Republic "About gas supply" govern the relations on gas supply between distributors of gas and the consumer (on the basis of the purchase and sale agreement), conditions of connection to network and shutdowns, qualities of gas (pressure and reliability of supply), payment terms for gas and other questions.

1.2. The main determinations used in these rules mean the following:

the gas distributor - Azerigaz Production association of the State Oil Company of Azerbaijan Republic and Gas operational service of the Nakhchivan Autonomous Republic in the territory of the Nakhchivan Autonomous Republic which on the basis of the purchase and sale agreement, by means of gas distribution network performs distribution, gas sale to consumers and provides services in connection with these activities;

the consumer - legal entity or physical person which buys gas on the basis of the purchase and sale agreement and uses it in fuel quality or raw materials;

the gas device - the household and industrial gas device (devices) which meets the requirements of state standards and has the certificate of conformity, is used in the course of gas consumption as fuel raw materials for production of different types of products;

the household gas appliance - the gas device (devices) with general consumption of gas to 10 cubic meters an hour which meets the requirements of state standards and has the certificate of conformity, is used in process for domestic needs;

the industrial gas device - the gas device (devices) with general consumption of gas over 10 cubic meters an hour which meets the requirements of state standards and has the certificate of conformity, is used in process or for not domestic needs;

gas distribution network - the economic complex (pipelines and lines in point of connection, security system and control and measuring systems, the gas equipment) created for supply of consumers with gas and interconnected from organizational, technological and technical aspect;

the border of balance sheet accessory - point undressed in gas delivery point to the consumer the distributor under the contract between the distributor and the consumer, determining balance sheet accessory of gas distribution network;

commissioning - the complex of works including preparation for start-up and start-up of gas installation, bringing operational load of gas installation to the level approved with the owner of installation;

regime and adjustment works - the complex of works including adjustment of gas installations for the purpose of achievement of project (passport) efficiency in the range of operational loads, adjustment of means of automatic control of processes of combustion of fuel;

construction objects - the buildings or constructions created or created in the course of construction activities;

specifications - the technical document which is the basis for designing of construction objects with gas supply and reflecting in itself technical parameters in connection with gas supply;

inspection" - the activities which are carried out for the purpose of determination of technical condition of gas installations and gas pipelines, chimneys, and also ventilating and airexchange lines of the consumer and compliance to their requirements of technical safety including detection of defects and (or) violations;

maintenance - the repair and other accompanying service work which is carried out for elimination of the defects and (or) violations revealed in the inspection report for the purpose of ensuring safe and reliable operation of the gas installations and gas pipelines of the consumer which are on border of balance sheet accessory (further - gas installations and gas pipelines), chimneys, and also lines of ventilation and air exchange;

flue - the pipe providing withdrawal of products of combustion (combustion gases) from gas devices and their emission in the atmosphere;

the household subscriber - the physical person using gas for domestic needs in apartment houses and apartments, including in special premises, the stipulated in Article 91 Housing code of the Azerbaijan Republic;

the specialized contractor - the legal entity whose workers received the qualification certificate according to the procedure, established by the Law of the Azerbaijan Republic "About gas supply", rendering technical services, or the physical person who is engaged in business activity without creation of the legal entity".

1.3. Gas supply to the consumer of gas is performed by the gas distributor on the basis of the purchase and sale agreement. The act establishing limit of the Section of balance sheet accessory of gas distribution network between the distributor of gas and the consumer is attached to this agreement (Appendix 1).

According to these rules, in the sale and purchase agreement obligations and the rights of the distributor of gas and the consumer, including quality of the gas (pressure and reliability of gas supply) supplied to consumers, its amount, payment terms, etc. are specified.

The purchase and sale agreement is signed according to the form attached to these rules (Appendices 2 or 3).

In case of use of industrial gas plants by physical person, the contract with it is signed according to Appendix 3.

When using by the legal entity or physical person who is engaged in business activity, household installations, the contract with it is signed according to Appendix 3. In the signed agreement non-use to agreement parties of the Items relating to industrial gas plants is noted.

1.4. The amount of the gas necessary for the consumer is determined on the basis of the maximum consumption of gas in hour by indicators of technical data sheet of the operated gas installations.

The consumers using industrial gas plants for increase or reducing the gas amounts specified in the sale and purchase agreement, shall address the gas distributor in writing.

1.5. Indicators of quality of the gas realized to the consumer - structure, density, humidity, heat generation and other indicators shall meet the requirements of the operating state standards. Violation of requirements of state standards attracts the responsibility established by the law. Qualitative indexes of gas shall be checked by supervisory authority - the Department of Energy of the Azerbaijan Republic in vitro or special technical means, and results are told consumers and the distributor of gas. If as a result of check qualitative indexes of gas do not conform to requirements of state standards, requirements concerning accomplishment of measures for reduction of gas in compliance with these standards shall be imposed on the distributor of gas.

1.6. The state control over fulfillment of requirements of these rules in the field of effective use of gas and reliable operation of gas installations is performed by the Department of Energy of the Azerbaijan Republic (further - ME), in the field of technical safety the Ministry of Emergency Situations of the Azerbaijan Republic (further - the Ministry of Emergency Situations) within the powers.
