About mutual recognition of privileges and guarantees for participants and disabled people of the Great Patriotic War, combatants in the territory of other states, families of the died military personnel

The governments of the State Parties of this agreement, further - the Parties,

understanding special importance of social protection of disabled people and participants civil and the Great Patriotic War of wars, combatants in the territory of other states, families of the died military personnel,

being guided by need of mutual recognition in the territory of the states of privileges and guarantees for the above-stated categories of persons,

agreed as follows:

Article 1.

Action of this agreement extends to disabled people and participants civil and the Great Patriotic War of wars, combatants in the territory of other states, family of the died military personnel and to other categories of persons to which privileges by the legislation of the former USSR according to appendix 1 to this agreement are provided.

Article 2.

The categories of persons specified in Article 1 of this agreement irrespective of their nationality use privileges and guarantees according to the legislation of the State Party of this agreement in the territory of which they constantly live.

At the same time privileges and guarantees are provided the privileges and guarantees, in the natural form proceeding from the List, provided in appendix 2 to this agreement or in the form of money payments according to the legislation of the State Parties of the Agreement.

Article 3.

For the categories of the persons specified in Article 1 of this agreement, which are temporarily staying or temporarily living in the territories of the State Parties of this agreement the following privileges and guarantees are provided:

1. Free receipt of emergency medical service in the medical organizations (organizations) according to the legislation of the state of stay in case of the diseases, accidents, injuries, poisonings and other conditions posing threat of life of the patient without mutual compensation of costs by the governments of the State Parties of the CIS.

2. Extraordinary servicing by the companies and organizations of consumer services, trade, public catering, public transport, housing and communal services, organizations of communication, cultural and educational institutions according to the legislation of the state of temporary stay or temporary residence.

Article 4.

The rights of disabled people and participants of the Great Patriotic War to preferential journey on the corresponding modes of transport are determined by the Agreement on mutual recognition of the rights to preferential journey for disabled people and participants of the Great Patriotic War, and also persons equated to them signed by heads of governments of the Commonwealth of Independent States on March 12, 1993.

Article 5.

Financing of the costs connected with provision of privileges and guarantees to the categories of persons specified in Article 1 of this agreement is performed by the Parties according to the legislation of the State Parties of this agreement.

Article 6.

The parties will take measures for ensuring protection of graves, monuments to disabled people and participants of the Great Patriotic War, to combatants in the territory of other states and to other categories of persons specified in Article 1 of this agreement.

Article 7.

The parties inform each other on changes in the legislation existing in their states in the field of social protection of categories of persons specified in Article 1 of this agreement through the Advisory Board on work, migration and social protection of the population of the State Parties of the Commonwealth of Independent States.

Article 8.

The basis for provision of privileges are the documents issued by relevant organs of the former USSR or the Parties in the forms operating for January 1, 1992 goal at the permanent address of person having the right to privileges.

In case of issue according to the legislation of the State Parties of this agreement of the specified documents to persons which are not mentioned in appendix 1 to this agreement, authorized bodies of the Parties do in them mark about action of these documents only in the territory of this State Party of this agreement.

Article 9.

According to the mutual arrangement of the Party can make necessary changes in type of additional protocols to the Agreement to this agreement.

Article 10.

Control of observance of this agreement is exercised by authorized bodies of the Parties according to the legislation of the State Parties of this agreement. Matters of argument are resolved by the Parties by mutual consultations.
