About approval of the Regulations on the organization and functioning of the Ministry of Foreign Affairs and European Integration, structure and extreme number of its central office

(as amended on 21-09-2017)

Based on Item (2) Article 20 and article 24 of the Law on the Government No., 64-XII of May 31, 1990 (repeated publication: The official monitor of the Republic of Moldova, 2002, No. 131-133, of the Art. 1018), with subsequent changes and amendments, DECIDES: the Government

1. Approve:

Regulations on the organization and functioning of the Ministry of Foreign Affairs and European Integration according to appendix No. 1;

structure of central office of the Ministry of Foreign Affairs and European Integration according to appendix No. 2.

2. Establish the extreme number of central office of the Ministry of Foreign Affairs and European Integration in number of 178 units from which 20 units of personnel on servicing of buildings, with the annual salary fund according to the current legislation.

3. Three deputy ministers appointed and dismissed by the Government according to the proposal of the minister, and one secretary general (diplomatic position) appointed and dismissed by the order of the minister give help to the minister in activities for management of the Ministry.

4. Within the Ministry of Foreign Affairs and European Integration the board of the Ministry consisting of 13 members functions.

5. Recognize invalid some orders of the Government according to appendix No. 3.

Regulations on the organization and functioning of the Ministry of Foreign Affairs and European Integration

Chapter I. General provisions

1. This Provision establishes form of the organization and functioning of the Ministry of Foreign Affairs and European Integration.

2. The Ministry of Foreign Affairs and European Integration (further - the ministry) is body of the central public management with the right of the legal entity, in direct subordination to the Government, with the location in municipium of Chisinau on Ulitsa 31, Avgusta 1989 g., No. 80.

3. The ministry has the treasurer account, seal with the image of the State Emblem and the name in state language, and also other seals and forms of the established sample.

4. The ministry is organized and performs the activities based on the Constitution of the Republic of Moldova, the Law No. 64-XII of May 31 1990, year about the Government, the Law No. 761-XV of December 27 2001, year about diplomatic service, the Law No. 158-XVI of July 4 2008, year about public service and the status of the government employee, other laws and resolutions of Parliament, presidential decrees of the Republic of Moldova, resolutions, decisions and orders of the Government, other regulations, international treaties which party is the Republic of Moldova, and this provision.

Chapter II. Tasks, main functions, obligations and rights of the ministry

5. The ministry provides implementation of foreign policy of the Republic of Moldova according to national interests, including monitoring and coordination of process of the European integration of the country according to the current legislation and the program of activities of the Government.

6. Proceeding from the assigned tasks the ministry performs the following main functions:

1) develops documents of state policies and legislative regulations on their realization according to priorities of foreign policy, including the European integration of the country provided by the program of activities of the Government;

2) the politician participates in development, implementation, monitoring and assessment of documents state and sectoral;

3) is provided by representation on behalf of the state or the Government of the Republic of Moldova in the field of the activities in the country and abroad;

4) exercises monitoring and control of application and observance of the regulatory base in the field of the activities and regulations on the organization and functioning of the organizations performing the activities in its subordination or maintaining;

5) develops the normative legislation about the organization and functioning of organizations of diplomatic service of the Republic of Moldova, and also the offer on its change;

6) manages funds and property of the ministry.

7. For the purpose of realization of the main functions the ministry carries out the following tasks:

Protects 1) and advances national interests of the Republic of Moldova on the international scene, providing unity of foreign policy of the state;

Initiates 2) and holds the international events, promoting development of the diplomatic relations and the relations of cooperation with all countries based on the principles and rules of international law;

3) is provided by representation of the Republic of Moldova and advances national interests in the countries of the world in the international organizations, in the relations with the European Union, and also during the meetings, conferences and the international forums; participates in development of the mandate of official delegations of the Republic of Moldova at conferences, the international meetings, and also for the events held within dialogue with the European Union;

4) performs monitoring and coordination of activities of the central authorities in the course of the European integration of the country, including in the context of negotiations on the Agreement on association between the Republic of Moldova and the European Union and liberalization of visa regime with the European Union;

Considers 5) and the politician in compliance with the European standards makes offers on reduction national;

6) coordinates the operations performed at the national level as a result of accession of the Republic of Moldova to decisions or line items of the European Union;

Coordinates 7) within the competence at the national level, the line items of the Republic of Moldova provided at the international forums;

8) develops and represents in accordance with the established procedure to the President of the Republic of Moldova, Parliament and the Government of the offer on development of the relations of the Republic of Moldova with other states and the international organizations on the basis of information analysis about the bilateral and multilateral relations, development of the international relations and interests of the Republic of Moldova;

9) promotes by means of foreign policy actions to strengthening of the constitutional state and democratic institutes in society;

10) coordinates the line items of the Republic of Moldova provided on the international scene in the field of human rights;

11) promotes by means of diplomatic actions to attraction and strengthening of necessary international support for the solution of the Dnestr problem and withdrawal of foreign troops and arms from the territory of the Republic of Moldova, supporting intensive dialogue as with external partners and the international organizations, and in close cooperation with the national authorities involved in realization of policy of recovery of territorial integrity of the country;

12) provides the help and protection of legitimate rights and interests of the citizens of the Republic of Moldova who are located abroad, to physical persons and legal entities according to the legislation of the Republic of Moldova, the international practice, international treaties which participant is the Republic of Moldova, and according to regulations and the principles of international law;

13) promotes development of the relations with the Moldavian diaspora;

Will organize 14) and performs in the territory of the Republic of Moldova and abroad consular activities;

15) is provided by proper functioning of diplomatic missions and representative offices of the international organizations and foreign consular establishments in the Republic of Moldova for the purpose of ensuring accomplishment of foreign policy tasks;

16) is coordinated by activities of diplomatic missions of the Republic of Moldova abroad;

17) is provided by central office of the ministry and diplomatic missions of the Republic of Moldova abroad with qualified personnel, will organize rates on enhancement of level of staff of diplomatic service, and also guarantees observance of the rights and accomplishment of the employee obligations provided by the current legislation;

18) extends in mass media abroad topical issues of foreign and domestic policy of the Republic of Moldova, at the same time informing the international community on processes of democratic transformations in the country and on rapprochement with the European standards;

19) cooperates in area of development, reasons and realization of economic and trade policy of the Republic of Moldova according to the current legislation and the program of activities of the Government;

Initiates 20) and participates in negotiations with the purpose of the conclusion of international treaties;

21) exercises control of execution of the relevant legislation in case of the conclusion of international treaties;

22) develops drafts of international treaties, draws the conclusion according to draft agreements;

23) makes in the Government offers on initiation of negotiations, signing, ratification, approval or adoption of international treaties, accession or denouncing of these agreements; develops offers and coordinates the procedure of initialing of drafts of international treaties and implementation of exchange of instruments of ratification;

24) is coordinated by activities for submission of reports which are performed by the organizations of public management, for the purpose of implementation of international treaties in the field of human rights which party is the Republic of Moldova;

25) is performed by monitoring in cooperation with other central public bodies of process of application of provisions of international treaties which party is the Republic of Moldova, and provides to the Government information on application of the obligations undertaken during implementation of these agreements;

26) monitors observance of the obligations undertaken by the Republic of Moldova according to international treaties, reports on behalf of the state, and also coordinates and promotes activities for submission of reports by national institutions;

27) participates together with national competent authorities in the course of development and the embodiment in life of policy of homeland security and within the all-European efforts - in the field of the international security, including by ensuring coordination at the national level, the actions connected with development of the relations of cooperation with Euro-Atlantic structures;

28) is provided by proper accomplishment of the legislation in the field of the competence;

29) informs the organizations of the European Union on accomplishment of the annual national plan of harmonization of the legislation;

30) cooperates with bodies of public management of the country and with civil society for the purpose of realization of the tasks in the conditions of the maximum transparency and in the spirit of mutual support, guaranteeing participation of society;

31) is provided by the state protocol and ceremonial;

32) contains the Public diplomatic Records Offices and develops politicians in this area;

33) carries out other obligations according to the current legislation.

8. The ministry is allocated with the following rights:

Initiates 1) and represents to the Government projects on enhancement of the legislation in profile areas;

Develops 2), claims, changes or repeals according to the current legislation orders, orders, provisions, instructions, rules, regulations and other departmental regulations;

Specifies 3) to bodies of public management obligation of implementation of the measures connected with foreign policy and the European integration;

4) convenes meetings at the level of authorized persons and experts of the ministries and other central public bodies for the purpose of discussion, the decision and forming of single line item on topical issues of foreign policy and process of the European integration of the country;

5) offers creation, reorganization or liquidation according to the procedure, established by the legislation, subordinate divisions;

6) creates councils, the commissions, expert groups and other consultative organizations for accomplishment of obligations in the field of own competence;

7) is offered by creation or management (including by participation, as necessary) interdepartmental structures for the solution of some problems or implementation of the international obligations which require participation of other organizations;

8) accepts obligatory rules about procedure for provision of services of central office by the internal divisions or structures subordinated to the ministry according to the law, and also resolves the issues connected with the procedure of legalization of documents, according to the procedure, established by the Government;

9) uses the special means received from provision of consular services, except for the consular fees, for covering of the accompanying expenses incurred by diplomatic missions, including permanent missions under the international organizations and consular establishments of the Republic of Moldova owing to provision of consular services according to the procedure, established by the legislation.

Chapter III. Organization of activities of the ministry

9. The ministry will organize the activities on the basis of the principles of transparency in decision making process and the personal responsibility of heads for the made decisions within the competences.

10. The ministry is headed by the deputy prime minister, the Minister of Foreign Affairs and European Integration (further - the minister) appointed to position and dismissed according to the Constitution of the Republic of Moldova and the Law No. 64-XII of May 31, 1990 on the Government.

11. Minister:

1) manages activities of the ministry and organizations of diplomatic service of the Republic of Moldova abroad, approves decisions on organizations of diplomatic service;

2) determines tasks and functions and establishes obligations of deputy ministers, the secretary general, the special envoy and division managers subordinated to central office of the ministry, and the organizations subordinated to the ministry;

3) issues orders and obligatory instructions for internal divisions of central office of the ministry;

4) represents to the Government of the Republic of Moldova in accordance with the established procedure offers on creation, abolition or change of rank of diplomatic representations;

5) represents to the Government in accordance with the established procedure offers on creation, abolition or change of class of consular establishments of the Republic of Moldova;

6) advances bilateral and multilateral political, commercial, economic, cultural, scientific and other relations of the Republic of Moldova with the countries of the world, regulates possible political and legal problems which exist or can arise in the relations with these countries;

7) is represented by the ministry in the relations with foreign bodies of public management and in the relations with the international organizations;

8) within the competences claims or, if necessary, makes changes to the staff list of central office and divisions of the ministry within the salary fund and the number of staff approved by the Government;

9) approves provisions of internal divisions of central office of the ministry;

Represents 10) to the Government of the offer to destination or to dismissal of ambassadors extraordinary and plenipotentiary, permanent representatives, envoys and the chargê d'affaires of permanent envoys - heads of diplomatic representations;

Sends 11) to the Government of the offer to destination or to dismissal of the consul general;

11-1) appoints to position dismisses chargês d'affaires;

Appoints 12) and dismisses other heads of consular representations;

Appoints 13) and dismisses personnel of office of the deputy prime minister, the Minister of Foreign Affairs and European Integration;

14) appoints government employees to diplomatic positions, changes, stops and stops employment relationships according to the Law No. 761-XV of December 27, 2001 on diplomatic service;

15) appoints to position, changes, stops and stops employment relationships of government employees who do not hold diplomatic positions, according to the Law No. 158-XVI of July 4 2008, year about the state position the status of the government employee;

16) takes on as, changes, stops and stops employment relationships with administrative and technical and office personnel;

17) is performed by general monitoring of accomplishment of service duties by the staff of the ministry and internal divisions of central office of the ministry;

17-1) confers powers according to the decision on initiation of negotiations and according to the decision on approval of signing of the international treaty;

18) represents, in accordance with the established procedure, offers on assignment of the state awards and honorary titles of the Republic of Moldova to workers of this sphere who proved in a special way;

19) periodically represents to the President of the Republic of Moldova offers on provision of diplomatic ranks of the ambassador and the Minister Plenipotentiary by the government employee from diplomatic organizations;

19-1) according to the offer of estimative tender committee provides the order diplomatic ranks to government employees of the diplomatic organizations, except as specified, provided in the subitem 19);

20) is provided by accomplishment of the functions and powers of the ministry provided by this Provision and bears the personal responsibility for their exact accomplishment, compliance with laws and resolutions of Parliament, presidential decrees of the Republic of Moldova, ordinances, resolutions, decisions and orders of the Government, and also other regulations;

21) is coordinated by activities of diplomatic missions of the Republic of Moldova abroad;

22) carries out other obligations according to the current legislation of the Republic of Moldova.

12. With activities of management of the ministry the minister is helped by three deputy ministers appointed to position and dismissed by the Government according to the proposal of the minister.

13. In case of temporary absence, power of the minister one of deputy ministers performs.

14. Deputy ministers:

1) are coordinated, according to the obligations determined by the minister activities of internal divisions of central office of the ministry and the organizations of diplomatic service of the Republic of Moldova abroad which are under supervision of the ministry and provide operational and constructive cooperation;

2) are coordinated and control accomplishment of prerogatives of foreign policy of the Republic of Moldova; provide the corresponding accomplishment of powers of the ministry;

3) participate and coordinate, according to the obligations determined by the minister in activities for development of personnel policy and the directive directions in the field of personnel management in organizations of diplomatic service;

4) cooperate with divisions of the State office, with other ministries and the central administrative authorities of the questions which are of mutual interest;

5) are controlled and provide completion of draft documents public the politician and drafts of the normative legal acts submitted for review to the Government at the initiative of the ministry;

6) are accepted, considered, developed and transferred to the central public bodies for review, drafts of regulations;

7) perform monitoring of process of preparation of the periodic reports provided by relevant provisions;

8) carry out other obligations according to provisions of the current legislation, requirements of this provision or special orders of the minister.

15. Within the ministry the diplomatic position of the secretary general is established. The secretary general is appointed to position and exempted from position by the order of the minister, performs the powers established in this Provision, given by the minister to whom he directly submits.

16. In case of accomplishment of the service duties the minister is helped by the minister's office.

17. Under the ministry the board of the ministry consisting of 13 members is effective: minister, deputy ministers, secretary general, special envoy, division managers and representative of civil society. The staff of board affirms the Government according to the proposal of the minister.

18. The board holds meetings quarterly or as required.

19. The board considers matters of high priority in competences of the ministry, and also reports of organizations of diplomatic service of the Republic of Moldova.

20. The board performs activities according to the Provision approved by the order of the minister.

21. Decisions of board are carried out by the edition by the minister of the corresponding administrative acts.

22. The structure and extreme number of central office of the ministry, and also organizations of diplomatic service of the Republic of Moldova abroad affirm the Government according to the proposal of the minister.

23. The staff list of central office of the ministry and the structures subordinated to it consists of the diplomatic positions equated to positions of public service in the bodies of the central public management, positions of office of the deputy prime minister, minister leading and executive state positions, maintenance positions which provide functioning of the ministry and the structures subordinated to it.

24. The minister has the right of the first signature on all documents of the ministry.

25. In the absence of the minister, the right of the first signature passes to one of deputy ministers or the secretary general.

26. Deputy ministers, the secretary general, and also other responsible persons have the right to sign documents of the ministry based on the order of the minister or provision of special powers.

27. The signature on documents of the ministry can be in writing or according to the legislation can have other forms (digital).

28. Persons who are granted right to sign bear the personal liability for legality, reliability and accuracy of the signed document.

29. For development of specific projects or accomplishment of the obligations and singular problems the ministry as the central state body participates and controls work of the commissions, councils and working groups at the national level for realization of the purposes of foreign policy and the European integration.

30. Activities of the ministry are financed from the government budget according to the current legislation.

31. The structures subordinated to the ministry act on the basis of the provisions of the law on organization, and the Regulations about activities of diplomatic missions of the Republic of Moldova approved by the Government, the orders and orders published by the minister and also the internal regulations and instructions approved within the ministry.
