About approval of Rules of sanitary protection of the territory of Ukraine

According to article 28 of the Law of Ukraine "About protection of the population against infectious diseases" the Cabinet of Ministers of Ukraine decides:

1. Approve Rules of sanitary protection of the territory of Ukraine which are attached.

2. To provide to the ministry of infrastructure, the Ministry of Agricultural Policy and Food, the State Customs Service, Administration of the State Border Service, the Ministry of environment protection and natural resources together with Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations creation at the companies, in the organizations and the organizations belonging to the sphere of their management and which property is placed at check points through frontier, proper conditions for implementation of activities by sanitary and quarantine divisions.

3. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of April 24, 1999 No. 696 "About approval of Rules of sanitary protection of the territory of Ukraine" (The Official Bulletin of Ukraine, 1999, No. 17, the Art. 740);

the resolution of the Cabinet of Ministers of Ukraine of January 12, 2001 No. 5 "About introduction of amendments to the resolution of the Cabinet of Ministers of Ukraine of April 24, 1999 No. 696" (The Official Bulletin of Ukraine, 2001, No. 3, the Art. 63).

Rules of sanitary protection of the territory of Ukraine

General part

1. These rules determine conditions and procedure for holding medical and sanitary actions in all territory of Ukraine and at check points through frontier for the purpose of prevention of drift and spread of the diseases having the international value, localizations and liquidations of their cases, flashes and epidemics by acceptance of adequate measures of reaction from line item of public health which are commensurable with risks for health of the population and are limited by them and do not create excess obstacles (barriers) to the international trips of persons, international carriages and trade.

2. In these rules terms are used in the following value:

1) responsible bodies Ministries of Economics, State Customs Service, Administration of State frontier service, other central executive bodies, their companies, organizations and the organizations providing accomplishment of the tasks determined by these rules within the powers provide holding medical and sanitary actions, inspection and certain measures of the state supervision (control);

2) certain check point through frontier (further - certain check point) - the check point (control Item) through frontier (further - the check point) or the checkpoint of entrance departure working in Ukraine in which fulfillment of requirements of the Section "B" appendices 1 to the International medical and sanitary rules which list is approved by the Cabinet of Ministers of Ukraine according to the proposals submitted by the Ministry of Health is provided;

3) epidemiological surveillance (observation) - the systematic and continuously operating collection, accounting, creation and the analysis, interpretation, distribution of data of medical and sanitary appointment, epidemic wellbeing of the population and indicators of living environment for assessment and implementation of the necessary relevant activities in the field of public health;

4) epidemic indications - indications to carrying out the state control of observance of requirements of the legislation on foodstuff, sterns, by-products of animal origin, health and wellbeing of animals and medical (sanitary) examination of persons by representatives of competent authority in case of adverse epidemic situation or threat of its origin, and also in case of possible risk of infection of person with the disease having the international value, issued the legislation;

5) means of transportation - the airplane, the vessel, the train, road and transport means or other vehicles making the international trip;

6) competent authorities - Ministry of Health and Gosprodpotrebsluzhba;

7) contamination - pollution of surface of any object (the soil, water, means of transportation, loads, goods, body of the person or animal and other objects) causative agents of the diseases having the international value or chemical, biological, radioactive agents, unhealthy people, animals, plants and the environment;

8) the checkpoint of entrance - departure (further - the checkpoint) - specially allocated territory along the line means of transportation with complex of buildings, special, engineering, fortification constructions and technical means where the relevant divisions exercise the state control of movement of temporarily uncontrollable territory and from such territory of persons, means of transportation and loads;

9) medical and sanitary observation - implementation of medical control of the state of health of persons concerning whom there are data of their rather possible infection with causative agents of especially dangerous and dangerous infectious diseases or stay in zone of possible negative impact of chemical, biological, radioactive materials, unhealthy the person for the purpose of timely identification of clinical signs of disease and prevention of its distribution (the term of such observation in case of infectious disease proceeds during its incubatory period);

10) medical (sanitary) examination - survey of drivers, crew members (crews) and passengers according to kliniko-epidemiological indications and their poll that can include studying of medical and sanitary documentation and carrying out noninvasive researches;

11) the operator of transportations - the physical person or legal entity created in one of the countries according to the law of this country and authorized by the same country to perform domestic and/or international carriages of loads and/or people with commercial purpose for employment, for a fee or at own expense by transportation or their combinations;

12) sanitary and quarantine division - the compatible division of representatives of competent authorities exercising epidemiological surveillance, medical (sanitary) examination and holding medical and sanitary events at the check point or on boundary inspection post (in particular isolated);

13) subjects of managing in the territory of which check points - the subjects of managing belonging to the sphere of management of the Agency of recovery and also the companies and the organizations irrespective of pattern of ownership in the territory of which check points are located are located;

14) accompanying medical and sanitary documentation (further - the accompanying documentation) - medical and sanitary documentation according to appendices 3-6;
