About adoption of the technical regulation of the Customs union "About safety of pyrotechnic products"

According to article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 the Commission of the Customs union (further - the Commission) solved:

1. Accept the technical regulation of the Customs union "About safety of pyrotechnic products" (TR CU 00_/2011) (is applied).

2. Ceased to be valid according to the Decision of Board of the Evrazayisky economic commission of 25.12.2018 No. 217

3. Establish:

3.1. the technical regulation of the Customs union "About safety of pyrotechnic products" (further - the Technical regulation) becomes effective since February 15, 2012;

3.2. the documents on assessment (confirmation) of compliance to the mandatory requirements established by the legislation of state members of the Customs union or regulatory legal acts of the Customs union, issued or accepted concerning products which are object of technical regulation of the Technical regulation (further - products), are valid before the termination of term of their action, but no later than August 15, 2013, except for such documents issued or accepted about day of official publication of this Decision which are valid before the termination of term of their action.

From the date of entry into force of the Technical regulation issue or adoption of documents on assessment (confirmation) of compliance to the mandatory requirements which are earlier established by the legislation of state members of the Customs union or regulatory legal acts of the Customs union is not allowed;

3.3. till August 15, 2013 production and release into the stream of commerce of products according to the mandatory requirements which are earlier established by the legislation of the gosudarstvchlen of the Customs union or regulatory legal acts of the Customs union in the presence of the documents on assessment (confirmation) of compliance of products specified to mandatory requirements, issued or accepted before entry into force of the Technical regulation is allowed.

The specified products are marked by national mark of conformity (market access mark) according to the legislation of state members of the Customs union.

Marking of such products single market circulation mark of gosudarstvchlen of the Customs union is not allowed.

3.4. the product circulation, released during action of the documents on assessment (confirmation) of compliance specified in subitem 3.2 of this Decision is allowed during expiration date (service life) of products established according to the legislation of state members of the Customs union.

4. To the secretariat of the Commission jointly with the Parties to prepare the draft of the Actions plan, necessary for implementation of the Technical regulation, and in three-months time from the date of entry into force of this Decision to provide representation it on approval of the Commission in accordance with the established procedure.

5. To provide to the Russian side with participation of the Parties based on monitoring of results of application of standards preparation of offers on updating of Lists of the standards specified in Item 2 of this Decision and representation at least once a year from the date of entry into force of the Technical regulation in the Secretariat of the Commission for approval in accordance with the established procedure.

Preface

This technical regulation is developed on the basis of the national technical regulations "About Safety of Pyrotechnic Structures and the Products Containing Them" of the Republic of Kazakhstan and the Russian Federation.

Article 1. Scope

1. This technical regulation extends to the pyrotechnic products released on customs area of the Customs union irrespective of country of source.

Requirements of this technical regulation extend to pyrotechnic products according to the list according to appendix 1 to this technical regulation.

2. This technical regulation establishes obligatory for application and execution on customs area of the Customs union of the requirement to pyrotechnic products and the related production processes, transportations, storages, realization, operation, utilization and the rule of their identification for the purpose of protection of life and/or health of the person, property, and also the prevention of actions misleading consumers (users) concerning their appointment and safety.

Article 2. Determinations

In this technical regulation the following terms and their determinations are applied:

"safety" - lack of the unacceptable risk connected with possibility of damnification and (or) causing damage;

"identification of pyrotechnic products" - the procedure of reference of pyrotechnic products to scope of this technical regulation and establishment of compliance of these pyrotechnic products of technical documentation (including to operational documents) to them;

"importer" - the resident of state member of the Customs union who concluded with the nonresident of state member of the Customs union the agreement in foreign trade on transfer of pyrotechnic products for the purpose of the subsequent realization in the territory of state member of the Customs union which resident he is and bears responsibility for their compliance to requirements of this technical regulation;

"handling instructions" - the images specifying address methods with load;

"the address of pyrotechnic products" - realization, storage, operation, transportation, import to customs area of the Customs union and export from customs area of the Customs union of pyrotechnic products;

"danger area" - part of space which surrounds the working pyrotechnic structure and the product containing it and in which at least one dangerous factor reaches dangerous level;

"dangerous factor" - the specific effect created by pyrotechnic structures and products containing them which in case of achievement of dangerous level by it creates health hazard of people and causes damage to property and the environment;

"wholesale warehouse" - the separate construction (building) of the corresponding category on fire and explosive risk equipped with means of the fire alarm and fire extinguishing according to regulations, intended for storage of wholesale batches of pyrotechnic products in packaging of the manufacturing organization and allowing to carry out works on receiving and delivery of products without its repacking;

"pyrotechnic product" - the product intended for receipt of the required effect by means of burning (explosion) of pyrotechnic structure. Depending on properties of pyrotechnic structures and nature of the processes proceeding in case of their chemical transformations, pyrotechnic products are subdivided on fire-dangerous and explosive. To destination pyrotechnic products are subdivided into pyrotechnic products of household purpose and pyrotechnic products of technical appointment. Pyrotechnic products do not require carrying out maintenance in the course of storage and energy costs in case of operation;

"pyrotechnic product of household purpose" - pyrotechnic product which is intended for application by the population and whose exploitation according to the instruction for application ensures safety of people, property and the environment;

"pyrotechnic product of technical appointment" - pyrotechnic product for which application special knowledge and adaptation (device) is required;
