1. Approve the enclosed Technique of determination of payment for environmental pollution in the Kyrgyz Republic.

2. Recognize to invalid:

- the order of the Government of the Kyrgyz Republic "About approval of Instructive-methodological instructions for determination of payment for environmental pollution in the Kyrgyz Republic" of November 10, 2004 No. 823;

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of November 10, 2004 No. 823 "About approval of Instructive-methodological instructions for determination of payment for environmental pollution in the Kyrgyz Republic" of February 18, 2006 No. 107;

- Item 3 of the order of the Government of the Kyrgyz Republic "About modification and amendments and recognition voided some decisions of the Government of the Kyrgyz Republic regulating questions of environmental protection and forestry" of September 27, 2006 No. 696.

Technique of determination of payment for environmental pollution in the Kyrgyz Republic

1. General provisions

1. This Technique of determination of payment for environmental pollution in the Kyrgyz Republic (further - the Technique) is developed according to the laws of the Kyrgyz Republic "About environmental protection", "The general technical regulation on providing ecological safety in the Kyrgyz Republic" and "About rate of payment for environmental pollution (emissions, dumpings of pollutants, placement of waste)".

2. The payment for environmental pollution is levied from legal entities and physical persons, irrespective of legal forms and patterns of ownership on which they are founded, including joint businesses with participation of foreign legal entities and physical persons which are granted the right of conducting economic activity which attracts the impact on the environment specified in Item 3 of this Technique (further - business entity), except for of the organizations and the organizations financed from republican or local budgets, and also cases, 31 these Technique provided by Items 13, of 22,.

3. The payment for environmental pollution is levied for the following types of impact on the environment:

- emissions of pollutants in atmospheric air from stationary and portable sources;

- dumpings of pollutants with the sewage (purified and crude) to the environment (water objects of natural and artificial origin, superficial and underground, collector and drainage systems, fields of irrigation, filtering and evaporation; land relief (beams, ravines, ditches, dry beds of the rivers, etc.);

- placement of waste and mountain dumps in the environment, including places (objects) which are specially intended and (or) equipped for warehousing (storage, burial) all types of waste.

4. Adjustment of the amount of payment for environmental pollution (further - payment for pollution) taking into account change of price level is made by authorized body of environmental protection. Coefficients of indexation of payment quarterly are accepted by republican body of environmental protection and its territorial authorities according to official figures of National Statistical Committee of the Kyrgyz Republic. In III quarter 2015 the coefficient of indexation is accepted basic and equal 1.

6. Business entities represent basic data for calculation of payments quarterly to territorial authorities of environmental protection to the 15th following reporting quarter.
