About implementation of the state types of control
Due to the receipt in State Customs Service of Ukraine of requests of customs and subjects of foreign economic activity concerning implementation of the state types of control for goods which are located in customs regime of duty-free shop, report.
According to Article 225 of the Customs code of Ukraine duty-free shop - customs regime according to which the goods and also accompanying goods of work, which are not intended for consumption on customs area of Ukraine are and implemented under customs control at check points on customs border of Ukraine, open for the international message, other customs control zones determined by customs authorities of Ukraine without collection of duty, the taxes established for export and import of such goods and without application of measures of non-tariff regulation.
By part one of Article 27 of the Customs code of Ukraine it is determined that goods which move through customs border of Ukraine except customs control can be subject to the state sanitary and epidemiologic, veterinary sanitary, phytosanitary, environmental, radiological control, control of movement of cultural values and other stipulated by the legislation types of control.
Thus, according to provisions of the Customs code of Ukraine and the Procedure for application of customs regime of the duty-free shop approved by the order of State Customs Service of 07.04.2011 No. 287, customs clearance of goods in the mode of duty-free shop it can be complete only after implementation of the types of control, established the legislation of Ukraine necessary for these goods, specified in part one of Article 27 of the Customs code of Ukraine.
