Some questions of advisory councils concerning conducting examination of dissertation works of the Ministry of Education and Science, youth and sport of Ukraine

According to the subitem 26 of item 4 of the Regulations on the Ministry of Education and Science, youth and the sport of Ukraine approved by the Presidential decree of Ukraine of 08.04.2011 No. 410, and Item 29 of the Procedure for award of scientific degrees and assignment of academic status of the senior research associate approved by the resolution of the Cabinet of Ministers of Ukraine of 07.03.2007 No. 423, I ORDER:

1. Approve enclosed:

Regulations on advisory council concerning conducting examination of dissertation works of the Ministry of Education and Science, youth and sport of Ukraine;

The list of advisory councils concerning conducting examination of dissertation works of the Ministry of Education and Science, youth and sport of Ukraine.

2. Determine that the advisory councils formed by the Highest certifying commission of Ukraine stop the activities from the date of entry into force of this order.

3. Declare invalid the order of the Highest certifying commission of Ukraine of 23.03.2010 No. 170 "About approval of the Regulations on advisory council of the Highest certifying commission of Ukraine" (with changes).

4. To provide to the director of the department of certification of personnel (V. D. Bondarenko) entering of the corresponding marks into cases of archive.

5. To impose control over the implementation of this order on the first deputy Minister E.M.Sulima.

6. This order becomes effective from the date of its official publication.

Regulations on advisory council concerning conducting examination of dissertation works

Ministries of Education and Science, youth and sport of Ukraine

1. The advisory council concerning conducting examination of dissertation works of the Ministry of Education and Science, youth and sport of Ukraine (further - advisory council) is advisory body of Monmolodezhsport which is formed for conducting examination of theses for the purpose of control of their scientific level, scientific and practical value, work of the specialized academic councils and observance of single requirements to job seekers of scientific degrees.

2. The advisory council in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, normative legal acts of Monmolodezhsport, including this Provision.

3. Advisory councils are formed by Monmolodezhsport on the fields of science or on groups of specialties.

Advisory councils are created by Monmolodezhsport of the leading scientists of certain branch of science who have experience of training of job seekers of scientific degrees and participate in process of certification of scientific personnel, according to offers of national academies of Sciences, central executive bodies in the field of which management there are higher educational institutions III-IV of level of accreditation and scientific institutions, and also the higher educational institutions III-IV of level of accreditation and scientific institutions, belong to the sphere of management of Monmolodezhsport.

4. The higher educational institution III-IV of level of accreditation, scientific institution which scientist is entered into structure of advisory council provides its participation in meetings of advisory council.

5. The advisory council is formed as a part of the chairman of advisory council, his deputy (deputies), the scientific secretary and members of advisory council - experts who are doctors of science, except the scientific secretary of council who can be candidate of science.

The personal and quantitative structure of advisory council affirms Monmolodezhsport.

The chairman and the scientific secretary of advisory council are responsible for storage of the theses, certification cases and petitions submitted to advisory council, their timely consideration record works of experts.

The scientific secretary of advisory council takes the minutes of advisory council.

6. The chairman of advisory council and its deputy (deputies) cannot be workers of the same higher educational institution III-IV of level of accreditation, scientific institution or their separate divisions.

The member of advisory council cannot be the chairman of the specialized academic council and be part of two or more advisory councils.

The expert can be the member only of one specialized academic council.

7. The main task of advisory council is participation in:

conducting examination of the defended dissertations;

consideration of documents of certification cases;

consideration of petitions for education of the specialized academic councils and carrying out one-time protection;

consideration of questions concerning award of scientific degrees.

8. The advisory council according to the tasks assigned to it participates in:

1) conducting examination of the defended dissertations, if:

the thesis contains secret information;

the thesis arrived in Monmolodezhsport according to the procedure of recertification;

the thesis according to Monmolodezhsport's decision was sent to other specialized academic council for additional consideration (collective reviewing);

the job seeker of scientific candidate's degree has no complete higher education in industry in which the thesis is prepared (with the invitation of the job seeker);

the job seeker of scientific degree on principle place of employment is not the scientific or scientific and pedagogical worker (with the invitation of the job seeker);

2) consideration of documents of certification cases of job seekers of scientific degrees which theses are considered by advisory council;

3) consideration of petitions for education of the specialized academic councils and carrying out one-time protection;

4) consideration of questions relatively:

forming of the list of scientific specialties;

preparation of passports of scientific specialties;

entering of printing and electronic scientific publications into the list of scientific professional publications of Ukraine in which publications are set off in number of the main publications on thesis;

determinations of the specialized academic councils for additional consideration, carrying out recertification of scientists which awards scientific degrees in other states, and nostrifications of diplomas about the scientific degrees issued in other states.

9. The advisory council has the right:

receive in accordance with the established procedure from the specialized academic council the additional documents and materials necessary for accomplishment of the tasks assigned to it;

invite to the meetings and hear job seekers, heads of the specialized academic councils, official opponents, research supervisors and scientific consultants;

make offers to Monmolodezhsport concerning attraction to work of doctors of science - the corresponding specialties specialists.

10. The meeting of advisory council is held by its chairman, and in case of it отсутствииодин from his deputies. The meeting of advisory council is considered competent if at it there is more than a half of its structure.

The meeting is held on condition of compulsory attendance of representatives of Monmolodezhsport who participate in meeting of advisory council without voting power.

The meeting of advisory council is held according to the schedule approved by Monmolodezhsport.

11. For consideration of the thesis and documents of certification case which arrive in advisory council the chairman of advisory council (in case of its otsutstviizamestitel) in coordination with Monmolodezhsport appoints the expert (experts).

Experts cannot be appointed:

coauthors of scientific works of the job seeker;

employees of the same division of one organization (department, sector, laboratory, department and so forth);

close faces of the job seeker;

members of the specialized academic council in which the thesis of the job seeker was considered;

official opponents of the job seeker;

scientific consultant (head) of the job seeker.

Experts receive the thesis, its electronic copy and certification case at meeting of advisory council or routinely.

12. Expert:

analyzes quality of training of documents of certification case (responses of official opponents, responses on the abstract, the conclusion of the specialized academic council, the publication);

determines depth of discussion of the thesis during protection;

analyzes quality of training of dissertation work and the abstract concerning work content compliance to requirements to qualification scientific works of level of the candidate or the doctor of science, compliance to the passport of scientific specialty on which the dissertation, and also on availability of text borrowings is defended;

estimates the scientific and practical value of the thesis, and also degree of novelty of the received results, reliability of its conclusions and recommendations.

By results of examination the expert prepares the draft of the certification conclusion.

If the certification conclusion of advisory council positive, then advisory council brings Monmolodezhsporta of the offer concerning approval of the solution of the specialized academic council and issue of the diploma on scientific degree.

If it is determined that expertize of the thesis in the specialized academic council is carried out poor, the conclusion of the specified council is insufficiently reasoned, then the advisory council brings Monmolodezhsporta of the offer concerning cancellation of the solution of the specialized academic council and refusal in issue of the diploma about scientific degree.

In case of need the advisory council brings Monmolodezhsporta of the offer concerning the invitation to meeting of advisory council of the job seeker, the research supervisor (consultant), the chairman of the specialized academic council in which defense of a thesis, or the directions of the thesis and certification case of the job seeker of scientific degree for additional consideration, and also conducting repeated examination is carried out.

13. By consideration of the doctoral dissertation experts shall determine in what measure in it materials of the master's thesis of the job seeker which can be used only in survey part of the doctoral dissertation are used.

14. Examination of the doctoral dissertations executed on two specialties is carried out on each of them.

15. Members of advisory council who are official opponents, and also the research supervisor (consultant) and coauthors of the job seeker cannot participate in discussion of the thesis and in vote.

16. Certification conclusions of advisory council are made by open voting by a majority vote. According to the proposal at least of one of members of advisory council secret vote is taken.

17. The chairman of advisory council, his deputies and the scientific secretary cannot be official opponents.

Appointment of the member of advisory council the official opponent perhaps only under exceptional circumstances with the permission of Monmolodezhsport.

18. The protocol, the certification conclusions of the established sample signed by the chairman at meeting, the expert and the scientific secretary of advisory council within five days after the meeting are transferred to Monmolodezhsport for approval.

19. Consideration term in advisory council shall not exceed:

the thesis and certification case of the job seeker of scientific doctor's degree - three months;

thesis and certification case of the job seeker of scientific degree of the candidate наукдвух months;

questions concerning the list and passports of scientific specialties, scientific professional publications and other questions of process of certification scientific kadrovodny month.

20. Information connected with consideration of theses and certification cases is not subject to disclosure.

In case of violation of this requirement, low-quality examination of theses and certification cases, violations of the Procedure for award of scientific degrees and assignment of academic status of the senior research associate approved by the resolution of the Cabinet of Ministers of Ukraine of 07.03.2007 No. 423, and this Provision Monmolodezhsport can make the decision on removal of the expert from structure of advisory council.
