About approval of the Instruction about order of interaction of the Ministry of emergency situations of Ukraine and Administration of the State Border Service of Ukraine concerning prevention and emergency response of technogenic and natural nature

According to article 5 of the Law of Ukraine "About the legal basis of civil protection", Item of 1 part two of Article 4 and part two of article 20 of the Law of Ukraine "About legal regime of emergency state", Item 6 parts three of Article 5, Article parts one 11, parts two of article 23 of the Law of Ukraine "About border control", Items 4, 23 articles 19 of the Law of Ukraine "About the State Border Service of Ukraine", item 4 of the Regulations on single state system of prevention and emergency response of the technogenic and natural nature approved by the resolution of the Cabinet of Ministers of Ukraine of 03.08.98 No. 1198, for the purpose of prevention of emergence of emergency situations of technogenic and natural nature operational exchange of reliable information about their emergence and the organization of collateral actions of governing bodies and divisions of the Ministry of emergency situations of Ukraine and the State Border Service of Ukraine during emergency response we ORDER:

1. Approve the Instruction about order of interaction of the Ministry of emergency situations of Ukraine and Administration of the State Border Service of Ukraine concerning prevention and emergency response of technogenic and natural nature (further - the Instruction) which is applied.

2. To chiefs of head departments (managements) of the Ministry of Emergency Situations of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, to chiefs of regional governments, bodies of protection of frontier, educational institutions, bodies of providing, mobile boundary group, commanders of groups and separate divisions of Sea protection of the State Border Service of Ukraine to organize interaction of subordinate divisions according to requirements of this Instruction.

3. To chiefs of head departments (managements) of the Ministry of Emergency Situations of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol together with chiefs of regional governments of the State Border Service to specify and modify plans of interaction during emergence of emergency situations of technogenic and natural nature taking into account requirements of this order.

4. Declare invalid the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash and Administration of the State Border Service of Ukraine of 26.03.2007 No. 182/220, "About approval of the Instruction about order of interaction of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash and the State Border Service of Ukraine concerning prevention and emergency response of technogenic and natural nature", registered in the Ministry of Justice of Ukraine 16.04.2007 for No. 370/13637.

5. (Povoroznik R. R.) to provide to department of management of rescue forces of the Ministry of Emergency Situations of Ukraine (Marchenko G. B.) together with Legal support division submission of this order on state registration in the Ministry of Justice of Ukraine.

6. This order becomes effective from the date of its official publication.

The instruction about order of interaction of the Ministry of emergency situations of Ukraine and Administration of the State Border Service of Ukraine concerning prevention and emergency response of technogenic and natural nature

I. General provisions

1.1. This Instruction is developed according to article 5 of the Law of Ukraine "About the legal basis of civil protection", Item of 1 part two of Article 4 and part two of article 20 of the Law of Ukraine "About legal regime of emergency state", Item 6 parts three of Article 5, Article part one 11, part two of article 23 of the Law of Ukraine "About border control", Items 4, 23 articles 19 of the Law of Ukraine "About the State Border Service of Ukraine", item 4 of the Regulations on single state system of prevention and emergency response of the technogenic and natural nature approved by the resolution of the Cabinet of Ministers of Ukraine of 03.08.98 No. 1198.

1.2. This Instruction determines the purpose and order of interaction of the Ministry of Emergency Situations of Ukraine and Administration of State frontier service of Ukraine during execution of joint tasks by emergency response of technogenic and natural nature and liquidation of their effects (further - emergency situations) within boundary, controlled frontier areas, internal waters of Ukraine, on bases, warehouses, objects of the State Border Service of Ukraine (dalshegospogransluzhb of Ukraine) and around them (further - within responsibility of bodies (divisions) of State frontier service of Ukraine).

1.3. Forms of interaction are:

exchange of information about threat or emergence of emergency situations within responsibility of bodies (divisions) of State frontier service of Ukraine;

holding the joint operational meetings of administrative board of the Ministry of Emergency Situations of Ukraine, head departments (managements) of the Ministry of Emergency Situations of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol and their structural divisions with administrative board of Administration of State frontier service of Ukraine, regional governments, bodies of protection of frontier, educational institutions, bodies of providing, groups of Sea protection and separate divisions, nauchnoissledovatelsky organizations of State frontier service of Ukraine;

implementation of joint actions in case of threat or emergence of emergency situations and liquidation of their effects within responsibility of bodies (divisions) of State frontier service of Ukraine, in particular during search and rescue on water objects, in water areas of the Black and Azov seas, suppressions of the fires in forests in border areas of Ukraine;

joint summing up the performed actions, and in case of neobkhodimostiprovedeny doctrines, trainings and occupations;

implementation of other actions provided by the current legislation.

1.4. Interaction is performed:

at the level of the central executive bodies - between the Ministry of Emergency Situations of Ukraine and Administration of State frontier service of Ukraine;

at the regional level - between head departments (managements) of the Ministry of Emergency Situations of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol and regional governments, managements of bodies of protection of frontier, groups of sea protection, bodies of providing, educational institutions and nauchnoissledovatelsky organizations of State frontier service of Ukraine;

at the local level - between divisions of the Ministry of Emergency Situations of Ukraine at the district and object level and the bodies (divisions) of State frontier service of Ukraine located in their place of dislocation.

II. Methods of the organization and implementation of joint actions

2.1. According to forms of interaction of action concerning prevention, emergency response and liquidation of their effects within responsibility of bodies (divisions) of State frontier service of Ukraine are performed by divisions of head departments (managements) of the Ministry of Emergency Situations of Ukraine in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol, and if necessary - with attraction of forces and means of bodies (divisions) of State frontier service of Ukraine according to the approved plans of interaction and plans (the ordering documents) which determine joint actions during emergency response.

In case of especially difficult emergency situations and introduction of emergency state according to the Presidential decree of Ukraine about introduction of emergency state also bodies and divisions of State frontier service of Ukraine can be involved in accomplishment of rescue and recovery work. Conditions of involvement of bodies (divisions) of State frontier service of Ukraine to mitigation of consequences of emergency situations are determined by the President of Ukraine according to the Constitution of Ukraine and the Law of Ukraine "About legal regime of emergency state".

2.2. Exchange of information about threat or emergence of emergency situations is performed constantly through service Ministry of Emergency Situations of Ukraine operational and on duty, State frontier service of Ukraine and their structural bodies of managements (divisions) of regional and local levels with use of telephone communication and e-mail.

2.3. Mutually informing and the organization of interaction in case of threat or emergence of catastrophic crashes, accidents, natural disaster and ecological pollution within responsibility of bodies (divisions) of State frontier service of Ukraine is performed according to telephone numbers:

2.4. The joint operational meetings of administrative board are held in planned procedure, and in case of threat or origin extraordinary situatsiynemedlenno at the initiative of heads of the bodies determined in Item 1.4 of the Section I of this Instruction. At joint meetings questions are considered:

conditions of interaction and ways of its enhancement;

approvals of joint actions in case of emergency situations;

amendments of the planning and ordering documents which determine joint actions during emergency response.

2.5. The organization of holding joint actions consists of stages of preliminary and direct (operational) preparation.

2.5.1. The stage of preliminary preparation contains:

plan development of interaction at the regional and local levels;

joint determination of the locations, meetings of staff, divisions and procedure for holding joint actions concerning prevention, emergency response and liquidation of their effects within responsibility of bodies (divisions) of State frontier service of Ukraine;

determination of amounts and the sequence of collateral actions concerning prevention, emergency response and liquidation of their effects;

approval of procedure for management of divisions which are involved in prevention and emergency response, liquidation of their effects, and also the solution of questions of their material logistics;

development and implementation of actions for training of staff and the equipment (technical means) of divisions to collateral actions concerning prevention, emergency response and liquidation of their effects.

2.5.2. The stage of direct (operational) preparation contains:

assessment of situation, condition and opportunities of the available forces and means;

determination by the head of liquidation of emergency situation (the head of joint actions) on condition of approval of the head of body (division) of State frontier service of Ukraine possibilities of attraction of forces and means of bodies (divisions) of State frontier service of Ukraine to participation in actions concerning prevention and emergency response and liquidation of their effects (participation in other joint actions);

determination of time of the beginning and completion, and also sequence of mitigation of consequences of emergency situation (implementation of joint actions);

allocation (obtaining) for liquidation of emergency situation (implementation of joint actions) of the necessary equipment and material means.

III. Main objectives of divisions of the Ministry of Emergency Situations of Ukraine and bodies (divisions) of State frontier service of Ukraine

3.1. Divisions of the Ministry of Emergency Situations of Ukraine:

perform actions for localization and mitigation of consequences of emergency situations, carrying out search and rescue works in the struck territories, to provision of first aid by the victim and their evacuation out of limits of the danger area for further transportation in health care institutions;

perform in coordination with the corresponding heads of bodies (divisions) of State frontier service of Ukraine actions for liquidation of specific effects of emergency situations on vehicles, buildings, other constructions which belong to State frontier service of Ukraine what according to plans of response to specific types of emergency situations attract special divisions of others central and local executive bodies in their consent to;

inform managements of bodies (divisions) of State frontier service of Ukraine on threat of origin or emergence of emergency situations in case of which the staff and objects of State frontier service of Ukraine can get to zone of their negative impact.

3.2. Bodies (division) of State frontier service of Ukraine:

inform divisions of the Ministry of Emergency Situations of Ukraine on signs of threat of origin or emergence of emergency situations within responsibility of bodies (divisions) of State frontier service of Ukraine;

perform actions for the notification, urgent evacuation of staff of bodies (divisions) of State frontier service of Ukraine, arms and ammunition, documents and material values out of limits of the area of influence of dangerous factors which result from emergency situations, within responsibility of bodies (divisions) of State frontier service of Ukraine;

take part in carrying out search and rescue and other urgent works during localization and liquidation of emergency situations;

during joint actions accompany divisions of the Ministry of Emergency Situations of Ukraine to the place (area) of emergence of emergency situation within responsibility of bodies (divisions) of State frontier service of Ukraine;

in case of approval of the head of liquidation of emergency situation if it does not threaten life and health of staff, introduce additional temporary restrictions according to the competence on entrance and work of boundary and the controlled frontier area within which there is area of localization of emergency situations;

give help to divisions of the Ministry of Emergency Situations of Ukraine in carrying out evacuation of injured persons, animals, documents and material values from areas of emergency situations within responsibility of bodies (divisions) of State frontier service of Ukraine;

participate in accomplishment of the actions directed to observance of legal regime of state of emergency imposed in Ukraine or in its certain areas in case of emergency situations of technogenic or natural nature;

make decisions concerning provision of permission to crossing of frontier of Ukraine in the simplified or priority (extraordinary) procedure by persons, vehicles and loads of rescue and rescue and fire fighting divisions of the Ministry of Emergency Situations of Ukraine who go for assistance to foreign states in localization and mitigation of consequences of emergency situations, carrying out search and rescue works;

provide in case of the consent of customs authorities of Ukraine and competent authorities of the adjacent states permission to crossing by persons of frontier of Ukraine, movement of vehicles, loads out of check points through frontier of Ukraine in the presence of the immediate circumstances connected with liquidation of emergency situations of technogenic and natural nature and their effects, threats of human life and in the absence of threat of homeland security of Ukraine;

by forces and means of divisions of departmental fire protection, rescue services are directly involved in liquidation (localization) of emergency situations of natural and technogenic nature and their effects within responsibility of bodies (divisions) of State frontier service of Ukraine;

by forces and means of the specialized object rescue services (SORS) of groups (separate divisions) of Sea protection are directly involved in carrying out wrecking on water within the fixed responsibility zones;

perform as well other powers in the cases provided by the current legislation.

IV. Final provisions

4.1. After completion of mitigation of consequences of emergency situations (holding joint actions) within responsibility of bodies (divisions) of State frontier service of Ukraine heads of territorial authorities of department of the Ministry of Emergency Measures of Ukraine who performed these actions inform managements of bodies (divisions) of State frontier service of Ukraine on the performed actions and their results.

4.2. Heads of bodies (divisions) of State frontier service of Ukraine in case of emergency situations within responsibility of subordinate divisions submit proposals to divisions of the Ministry of Emergency Situations of Ukraine of rather possible participation in mitigation of consequences of the specified emergency situations of forces and means of the divisions subordinated to them. After the end of the relevant activities inform heads of governing bodies (divisions) of the Ministry of Emergency Situations of Ukraine on the performed actions.
