About the legal basis of civil protection

This Law determines legal and organizational basis in the field of civil protection of the population and the territories against emergency situations of technogenic, natural and military nature, power of executive bodies and other governing bodies, procedure for creation and use of forces, their completing, service, and also guarantee of social and legal protection of staff of bodies and divisions of civil protection.

Section I GENERAL PROVISIONS

Article 1. Determination of terms

In this Law the stated below terms are used in the following value:

civil protection - system of the organizational, technical, sanitary and hygienic, anti-epidemic and other measures performed central and the local executive bodies, local government bodies subordinated to them by forces and means, the companies, organizations and the organizations irrespective of pattern of ownership, the voluntary rescue forming providing accomplishment of these measures for the purpose of prevention and liquidation of emergency situations, life-threatening and to human health, causing loss of property in peace time and during the special period;

single state system of civil protection of the population and the territories (further - single system of civil protection) - set of governing bodies, forces and means central and local executive bodies, local government bodies to which realization of state policy in the field of civil protection is assigned;

subsystems of single system of civil protection - set of the functional and territorial authorities of management subordinated to specially authorized central executive body to which the tasks determined by the law in specific spheres of civil protection are assigned;

service of civil protection - the public service of special nature connected with ensuring fire safety, prevention and response to other emergency situations of technogenic, natural and military nature, liquidation of their effects, protection of the population and the territories from their negative impact;

Operational rescue service of civil protection - special paramilitary force to which protection of the population and the territories against emergency situations of technogenic, natural and military nature, participation in actions of territorial defense, and also the international rescue and other humanitarian operations is assigned;

forces and means of civil protection - staff and employees of bodies and divisions of civil protection, voluntary rescue forming, the fire fighting and rescue equipment, fire and technical and crash equipment, fire extinguishing means and individual protection, other property intended for suppression of the fires, mitigation of consequences of accidents, floods, earthquakes and other catastrophic crashes of technogenic, biological, radiation, chemical or ecological and military nature, minimization of effects of the Chernobyl catastrophic crash;

zone of possible defeat - the separate territory or object in which as a result of emergency situation of technogenic, natural or military nature there is threat of life or to human health or causings material losses;

mitigation of consequences of emergency situations - carrying out package of measures, including the rescue and other urgent works which are carried out in case of emergency situations of technogenic, natural and military nature (further - emergency situations), and the dangerous factors directed to cancellation, rescue of life and preserving human health, and also on localization of zones of emergency situations;

wrecking - the works sent to search, rescue and protection of people (including rendering emergency medical service to them), protection of material and cultural values and the environment in case of mitigation of consequences of emergency situations, with employees engagement, having special preparation, individual protection equipment and the equipment;

first-priority measures for mitigation of consequences of emergency situation - operational implementation of the organizational and technical and other urgent measures aimed at providing the minimum requirements of life support of the population injured with emergency situation;

technogenic safety - condition of security of the population, the territory, objects from negative effects of emergency situations of technogenic nature;

adverse everyday or unusual situations - the situations arising in life, the non-productive sphere which did not assume scale of emergency situation, but represent threat of life and to human health or causings loss of property.

Article 2. Legal basis of civil protection

The legal basis of civil protection are the Constitution of Ukraine, this Law, the laws of Ukraine "About protection of the population and the territories against emergency situations of technogenic and natural nature", "About Civil defense of Ukraine", "About legal regime of emergency state", "About legal regime of warlike situation", "About rescue services", "About fire safety", "About objects of the increased danger", "About use of nuclear energy and radiation safety", "About ensuring sanitary and epidemic wellbeing of the population", "About legal regime of the territory which underwent to radioactive pollution as a result of the Chernobyl catastrophic crash", the international agreements of Ukraine which consent to be bound is this the Verkhovna Rada of Ukraine, and other acts of the legislation.

Article 3. Purpose of civil protection

Civil protection is performed for the purpose of:

realization of the state policy aimed at safety and protection of the population and the territories, material and cultural values and the environment from negative effects of emergency situations in peace time and during the special period;

overcomings effects of emergency situations, including effects of emergency situations in the territories of foreign states according to international treaties of Ukraine which consent to be bound is this the Verkhovna Rada of Ukraine.

Article 4. Principles of civil protection

Civil protection is performed on the principles:

guaranteeing by the state to citizens of constitutional right on protection of life, health and their property, and to legal entities - the rights to safe functioning;

voluntariness in case of involvement of people to implementation of the measures in the field of civil protection connected with risk for life and health;

integrated approach to the solution of tasks of civil protection;

creations of system of rational preventive safety for the purpose of the greatest possible, economically reasonable reduction of probability of emergence of emergency situations and minimization of their effects;

territoriality and functionality of single system of civil protection;

damnification minimization to the environment;

publicity, open entry of the population to information in the field of civil protection according to the legislation.

Article 5. Tasks of civil protection

The main objectives of civil protection are:

collection and analytical information processing about emergency situations;

forecasting and assessment of social and economic effects of emergency situations;

implementation of supervision and control in the field of civil protection;

development and execution of legal and other regulatory legal acts, observance of regulations and standards in the field of civil protection;

development and implementation of preventive measures in the field of civil protection;

creation, preserving and rational use of the material resources necessary for prevention of emergency situations;

development and accomplishment of the scientific and technical programs directed to prevention of emergency situations;

ensuring functioning of system of the emergency help to the population according to single telephone number 112;

the operational notification of the population about origin or threat of emergence of emergency situation, timely reliable informing on the developing situation and measures taken for prevention of emergency situations and overcoming their effects;

the organization of protection of the population and the territories from emergency situations, rendering emergency psychological, medical and other aid by the victim;

carrying out urgent works on mitigation of consequences of emergency situations and organization of life support of affected population;

ensuring permanent readiness of forces and means of civil protection to prevention of emergency situations and liquidation of their effects;

rendering with use of means of civil protection of the operational help to the population in case of adverse everyday or unusual situations;

training of the population in methods of protection in case of emergency, adverse everyday or unusual situations and the organization of trainings;

international cooperation in the field of civil protection.
