According to articles 36 and 47 of the Law of Ukraine "About state registration of legal entities and physical persons -" (with changes) and Item 11 of the Regulations on the Pension fund of Ukraine approved by the Presidential decree of Ukraine of 06.04.2011 No. 384, board of the Pension fund of Ukraine DECIDES: entrepreneurs
1. Approve forms of messages on the beginning of carrying out the unscheduled inspection appointed in connection with the decision on the termination of the legal entity as a result of its liquidation or about the termination of business activity of the physical person - the entrepreneur according to its decision, about impossibility of carrying out the unscheduled inspection appointed in connection with the decision on the termination of the legal entity as a result of its liquidation or about the termination of business activity of the physical person - the entrepreneur according to its decision, about availability of the objections against carrying out state registration of the termination of the legal entity as a result of its liquidation provided to body of the Pension fund of Ukraine about availability of the objections against carrying out state registration of the termination of the legal entity as a result of its liquidation provided to the state registrar about withdrawal of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation, which are applied.
2. Approve the Procedure for filling and provision to the state registrar of forms of messages on the beginning of carrying out unscheduled inspection, about impossibility of carrying out unscheduled inspection, about availability of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation which is applied.
3. To department of receipt of the income (Litvinenko V. V.) and legal management (Ryabtseva T. B.) submit this resolution for state registration to the Ministry of Justice of Ukraine.
4. To impose control over the implementation of this resolution on the First Deputy Chairman of the board V. O. Kravchuk.
5. This resolution becomes effective on December 18, 2011.

1.1. This Procedure determines the mechanism of filling and representation of forms of messages to the state registrar: about the beginning of carrying out the unscheduled inspection appointed in connection with the decision on the termination of the legal entity as a result of its liquidation (further - the message on the beginning of carrying out unscheduled inspection), about impossibility of carrying out the unscheduled inspection appointed in connection with the decision on the termination of the legal entity as a result of its liquidation (further - the message on impossibility of carrying out unscheduled inspection), about availability of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation provided to body of the Pension fund of Ukraine (further - the message on availability of objections which is provided to body of the Pension fund of Ukraine), about availability of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation that is provided to the state registrar (further - the message on availability of objections which is provided to the state registrar), about withdrawal of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation (further - the message on withdrawal of objections), the stipulated in Article 36 Laws of Ukraine "About state registration of legal entities and physical persons - entrepreneurs".
1.2. Introduction of the messages this in forms is performed based on accounting these cards of personal accounts of payers of insurance premiums for obligatory national pension insurance, orders of bodies of the Pension fund of Ukraine on carrying out unscheduled inspections, establishment of other circumstances concerning impossibility of carrying out unscheduled inspection of the payer, and concerning outstanding amounts of the payer in Social Insurance Funds - based on references of working bodies of executive directorates of Social Insurance Fund for temporary disability, Fund of obligatory national social insurance of Ukraine on case of unemployment, Social Insurance Fund from labor accidents and occupational diseases of Ukraine (further - working bodies of executive directorates of Social Insurance Funds).
1.3. Copies of the messages sent to the state registrar are filed the payer.
2.1. In case of obtaining from the state registrar of the message on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity body of the Pension fund of Ukraine in 10 - dnevny term from the date of receipt of such message carries out documentary unscheduled inspection of the payer of insurance premiums for obligatory national pension insurance.
2.2. The next working day from the date of receipt of the specified message the body of the Pension fund of Ukraine informs on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity the relevant working organs of executive directorates of Social Insurance Funds in electronic form according to procedure for exchange of information.
2.3. About the beginning of carrying out unscheduled inspection the body of the Pension fund of Ukraine sends electronically and on paper to the state registrar the message on the beginning of carrying out unscheduled inspection in the established form. The specified message is sent within ten working days from the date of the publication of the message on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity.
2.4. In case of impossibility of carrying out unscheduled inspection (failure to provide documents of the legal entity by liquidation commission (liquidator) (its branches, representations), including ledgers, reports, estimates and other documents on charge, calculation and payment of insurance premiums for obligatory national pension insurance or for other reasons) the body of the Pension fund of Ukraine sends electronically and on paper to the state registrar the message on impossibility of carrying out unscheduled inspection in the established form. The specified message is sent within ten working days from the date of the publication of the message on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity.
2.5. In case of posylaniye to the state registrar of the message on impossibility of carrying out unscheduled inspection, such message no later than two months from the date of the publication of the message on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity shall be replaced with relevant organ of the Pension fund of Ukraine the message on carrying out unscheduled inspection or on availability of objections which is provided to the state registrar in the established form.
If unscheduled inspection is carried out, however the payer did not perfrom final settlements with the Pension fund, or did not submit the reporting for the period before approval of the liquidation balance sheet by liquidation commission (liquidator), or in case of provision of information on availability of objections from the relevant working bodies of executive directorates of Social Insurance Funds for the established form, the body of the Pension fund of Ukraine no later than two months from the date of the publication of the message on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity sends to the state registrar the message on availability of objections which is provided to the state registrar in the established form.
The relevant working organs of executive directorates of Social Insurance Funds send the message on availability of objections which is provided to body of the Pension fund of Ukraine to bodies of the Pension fund of Ukraine electronically and on paper with indication of all reasonable circumstances.
2.6. The message on availability of objections which is provided to the state registrar are sent by bodies of the Pension fund of Ukraine to the state registrar electronically and on paper with indication of the reasonable circumstances confirming conducting check or impossibility of its carrying out, availability of monetary commitments or debt on payment of insurance means in the Pension fund of Ukraine and Social Insurance Funds or availability of other circumstances on which the legal entity cannot be stopped.
2.7. If within two months from the date of the publication of the message on the decision of founders (participants) of the legal entity or the body authorized by them concerning the termination of the legal entity information on availability of objections which is provided to bodies of the Pension fund of Ukraine from working bodies of executive directorates of Social Insurance Funds did not arrive, in the message on availability of objections which is provided to the state registrar, the corresponding record is made.
2.8. Bodies of the Pension fund of Ukraine shall no later than ten working days from date when they learned about elimination of all circumstances which were the basis of objections against carrying out state registration of the termination of the legal entity as a result of its liquidation, including according to the relevant working bodies of executive directorates of Social Insurance Funds, to withdraw the message on availability of objections which is provided to the state registrar, by the direction to the state registrar of the message on withdrawal of objections in the established form.
