About approval of the Procedure for creation and giving of requests for receipt of public information, forms of giving of request for receipt of the public information which is in ownership of the State Tax Administration of Ukraine

According to the Law of Ukraine "About access to public information", the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information" and the resolution of the Cabinet of Ministers of Ukraine of May 25, 2011 to No. 583 "Questions of accomplishment of the Law of Ukraine "On access to public information" in the Secretariat of the Cabinet of Ministers of Ukraine, central and local executive bodies" I ORDER:

1. Approve the Procedure for creation and provision of requests for receipt of the public information which is in ownership of the State Tax Administration of Ukraine which is applied.

2. Approve applied:

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from physical person in writing;

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from the legal entity in writing;

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from consolidation of citizens without the status of the legal entity in writing;

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from physical person by e-mail;

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from the legal entity by e-mail;

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from consolidation of citizens without the status of the legal entity by e-mail;

Form of giving of request for receipt of public information which is in ownership of the State Tax Administration of Ukraine, from requester by phone.

3. To department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Chmeruk M. O.), to Department of servicing of taxpayers of the State Tax Administration of Ukraine (G.M.'s Titmouse) to provide:

provision of this order in the procedure established by the legislation on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and vice-chairman of the State Tax Administration of Ukraine Doctor S. I.

Procedure for creation and giving of requests for receipt of the public information which is in ownership of the State Tax Administration of Ukraine

I. General provisions

1.1. This Procedure is developed according to the Law of Ukraine "About access to public information" (further - the Law), the Presidential decree of Ukraine of May 5, 2011 No. 547 "Questions of ensuring with executive bodies of access to public information" and the resolution of the Cabinet of Ministers of Ukraine of May 25, 2011 No. 583 "Questions of accomplishment of the Law of Ukraine "On access to public information" in the Secretariat of the Cabinet of Ministers of Ukraine, central and local executive bodies" for the purpose of creation of mechanisms of realization of the right of everyone to access to public information which is in ownership of the State Tax Administration of Ukraine (further - GNS of Ukraine), and to the maximum simplification of the procedure of representation of request, on receipt of public information.

1.2. The request for information which is in ownership of GNS of Ukraine (further - the Request for information) moves physical person or legal entity, consolidation of citizens without the status of the legal entity (further - requester) GNS of Ukraine in oral or written form during personal acceptance or by the message by mail, e-mail, by fax or by phone at the choice of requester.

1.3. Public control over providing GNS of Ukraine access to public information is exercised according to the Law.

II. Creation and giving of requests for receipt of public information

2.1. The requester has the right to make in GNS of Ukraine Inquiry for information irrespective of, this information concerns it personally, or not, without explanation of the reason of giving of the Request for information.

2.2. The request for information is sent in any form.

2.3. The request for information shall contain:

surname, name, middle name (name) of requester, the postal address or the e-mail address, and also number of the means of communication (if such is);

the general description of information or type, the name, details or contents of the document concerning which the request is made if the requester knows it;

the signature and date on condition of provision of the written request.
