About approval of the instruction for forming, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management of state bodies

According to the Law of the Republic of Kazakhstan "About the electronic document and the digital signature" and the subitem 9) of article 6 of the Law of the Republic of Kazakhstan "About informatization", I ORDER:

1. Approve the enclosed Instruction for forming, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management of state bodies.

2. To department of state policy in the field of information technologies of the Ministry of Communications and information of the Republic of Kazakhstan (Eleusizova K. B.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan its official publication in mass media and placement on Internet resource of the Ministry of Communications and information of the Republic of Kazakhstan, finishing it to data of state bodies of the Republic of Kazakhstan - participants of the Single system of electronic document management.

3. To impose control of execution of this order on the vice-Minister of Communications and information of the Republic of Kazakhstan Sarsenova S. S.

4. This order becomes effective after ten calendar days from the date of its first official publication.

The instruction for forming, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management of state bodies

1. General provisions

1. This Instruction for forming, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management" (further - the Instruction) is developed according to the laws of the Republic of Kazakhstan "About procedure for consideration of appeals of physical persons and legal entities", "About the electronic document and the digital signature", "About informatization".

2. This Instruction disaggregates forming conditions, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management.

3. Forming, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management is performed by means of interaction of the web portal of "the electronic government", the Single system of electronic document management of state bodies, Certification center of state bodies and National certification center of the Republic of Kazakhstan with ensuring information security (information security) of the state information systems and information resources.

4. Participants of system of forming, acceptance and processing of electronic appeals of the physical persons and legal entities sent with use of the web portal of "the electronic government" to single system of electronic document management are the physical persons and legal entities which are residents of the Republic of Kazakhstan, state bodies, the National operator.

5. The basic concepts used in this Instruction:

1) authentication - confirmation of authenticity of the subject or access object by determination of compliance of the shown details of access available in system;

2) authorized body in the field of informatization (further - authorized body) the state body performing management in the field of informatization and "the electronic government";

3) the national operator in the field of informatization (further - the national operator) the legal entity created according to the decision of the Government of the Republic of Kazakhstan to which tasks on integration of the state information systems and state electronic information resources, on participation in realization of single technical policy in the field of informatization, function of the project integrator of infrastructure of "the electronic government" are assigned;

4) virtual reception - the service placed on the web portal of "the electronic government", intended for transfer of appeals of citizens to state bodies;

5) certification center of state bodies of the Republic of Kazakhstan (further - UTs GO) the certification center servicing participants of single system of electronic document management of state bodies of the Republic of Kazakhstan;

6) national certification center of the Republic of Kazakhstan (further - NUTs RK) the certification center servicing members of "the electronic government", the state and non-state information systems;

7) single system of electronic document management of state bodies (далееЕСЭДО) - the electronic document management system intended for exchange of electronic documents between state bodies of the Republic of Kazakhstan and officials of the relevant state body;

8) the electronic address - the appeal, to the sent subject considering the address, or the official individual or collective in electronic form, certified by the digital signature, the offer, the statement, the claim, request or response;

9) the digital signature (further - the EDS) is set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

10) the web portal of "the electronic government" (further - the Portal) - the information system representing single window of access to all consolidated government information including the regulatory legal base, and to electronic state services.

2. Forming of electronic addresses by physical persons and legal entities

6. It is necessary for physical persons and legal entities for forming of electronic addresses:

1) to have access to the computer connected to the Internet;

To receive 2) in the center of registration the registration certificate EDS NUTs RK, created with use of the closed key of the registration certificate EDS;

3) to establish software for work with the Portal;

4) to be registered on the Portal;

5) to undergo authentication on the Portal;

6) before sending the message to sign the electronic document EDS.

7. Forming, acceptance and processing of electronic appeals of physical persons and legal entities consists of three stages:

1) forming of the electronic address by physical person or legal entity on the Portal and sending the electronic appeal to state body;

2) acceptance and processing by state bodies of the electronic address received by means of ESEDO;

3) receipt of the answer by physical person or legal entity from state body on the address by means of the Portal.

8. In case of the address physical persons and legal entities fill the details in card of the appeal of physical persons and legal entities in form according to appendices 1 and 2 to this Instruction.

Forming of the electronic address by physical person or legal entity on the Portal and sending the electronic appeal to state body includes:

1) filling, preserving form of card of the appeal of physical person or legal entity on the Portal, its signing of the EDS of physical person or legal entity, and also prepared by physical person or legal entity of the electronic document (investments if necessary);

2) sending the electronic appeal to state body.

9. Acceptance and processing by state bodies of the electronic address received by means of ESEDO includes:

1) receipt of the electronic address;

2) verification of the address on compliance to Standard rules of documentation and management of documentation in the state and non-state organizations approved by the order of the acting minister of culture and information of the Republic of Kazakhstan of September 25, 2009 No. 128 (registered in the register of regulatory legal acts for No. 5834, No. 177 published in "The legal newspaper" of 19.11.2009 (1774)) (further - Standard rules) and the Instruction about procedure for consideration of appeals of physical persons and legal entities and control of their execution approved by the order of the Government of the Republic of Kazakhstan of January 31, 2001 No. 168 (further - Instructions), including verification of the EDS and receipt of confirmation of positive result of verification of the EDS of physical person and legal entity - the author of the address;

3) registration and consideration of the address according to the legislation in the field of consideration of appeals of physical persons and legal entities, to Standard rules and the Instruction;

4) sending the notification to physical person or legal entity about the direction of the address for consideration to other state bodies according to their competence;

5) sending the answer by means of the Portal to the address to physical person or legal entity about result of consideration of the address and the taken measures in format of the electronic document signed by the EDS of the head of state body and the employee of service of documentary providing.

10. After sending the electronic appeal to state body the physical person or legal entity obtains notifications or information:

1) the notification on delivery of the document (the receipt in format of the electronic document) in state body which is confirmation of successful sending and receipt of the electronic address in state body;

2) the notification on refusal in registration of the address with indication of the reason: negative result of verification of the EDS, in case of not acceptance by the EDS system;

3) the notice of registration of the address with indication of the contractor and the registration number assigned in state body;

4) the notification of shipping on execution;

5) information on the results of consideration of the address with indication of completion date yielded about the contractor and results of consideration of the address or information on transfer of the address by state body to the central and local executive bodies and other bodies according to their competence.

11. Physical persons or legal entities for forming of the electronic address on the Portal and its sendings to state body perform:

1. forming on the Portal of the address (with investment if necessary) in which the question essence, and sending the electronic appeal to state body which competence permission of the questions posed enters is stated;

2. release by the user of information resource "Virtual Reception" from irrelevant addresses, without preserving investments and notifications on passing of the document.

12. The authorized body for the organization of works on provision of acceptance and processing of electronic appeals of physical persons and legal entities performs:

1) coordination of works on telecommunication, hardware and licensed equipment of the software of the Portal, NUTs RK and UTs GO;

2) control of works on technical supply of information security of the information systems performed by authorized organization in the field of informatization according to the contract for accomplishment of joint operations on ensuring information security;

3) development and control over the implementation of requirements by state bodies for the organization of works on acceptance and processing of electronic appeals of physical persons and legal entities.

13. State bodies when implementing acceptance and processing of electronic appeals of physical persons and legal entities perform:

1) ensuring timeliness, completeness of registration by means of ESEDO of electronic appeals of physical persons or legal entities according to terms and procedures, the established legislation in the field of consideration of appeals of physical persons and legal entities;

2) ensuring timeliness of consideration of electronic appeals of physical persons and legal entities with officials of state body according to the procedure and terms, equivalent to addresses on papers;

3) creation of statistic reports according to appeals of the physical persons and legal entities created for delivery in the Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan according to the order of the Attorney-General of the Republic of Kazakhstan of May 30, 2007 No. 20 "About approval of Rules of calls accounting of physical persons and legal entities, the statistic report No. 1-OL "About consideration of appeals of physical persons and legal entities" and Instructions for its creation" (registered in the register of regulatory legal acts for No. 4699, No. published in "The legal newspaper" of 27.07.2007 114);

4) sending the notification - the electronic document to the author of the address about not adoption of the electronic address with indication of the reason;

5) connection to the Single transport circle of state bodies and providing specifications of functioning of ESEDO;

6) connection of local area network of state body to UTs GO and NUTs RK.

14. The employee of division of documentary providing state body by means of ESEDO carries out the following transactions:

1) verification of the EDS and receipt of confirmation of positive result of verification of the EDS of physical person and legal entity in the Addresses of Persons database in representation "Arrived";

2) registration and sending for consideration of the arrived address;

3) sending the notification - electronic documents for the Portal to the author about registration of the address automatically, or about refusal in registration of the address with indication of the reason (negative result of verification of the EDS, in case of not acceptance by the EDS system);

4) registration and signing of the answer to the author of the address using the EDS;

5) sending the answer to the author of the address by means of the Portal;

6) forming of reporting data on appeals of physical persons and legal entities.

15. The contractor of state body by means of ESEDO carries out the following transactions:

1) consideration and filling of card of execution about course of execution of the address;

2) consideration or readdress of the address to appropriate subject according to the legislation in the field of consideration of appeals of physical persons and legal entities;

3) preparation of the answer to the author of the address and its signing using the EDS of the head of state body;

4) preparation and transfer of appeals of physical persons and legal entities to departmental archive of state body.

16. Within implementation of forming, acceptance and processing of electronic appeals of physical persons and legal entities the National operator provides functioning of the following information systems (except for financial information systems and resources):

1) the portal in the mode twenty four hours a day, seven days a week, three hundred sixty five days in year;

2) the ESEDO center in the mode twenty two hours a day, seven days a week, three hundred sixty five days in year;

3) UTs GO in the mode from 9:00 till 18:30 o'clock in the working days, on Saturday from 10:00 till 13:00 o'clock time of Astana;

4) NUTs RK in the mode twenty four hours a day, seven days a week, three hundred sixty five days in year.

17. The national operator by means of the Portal gives sales opportunity the user of all transactions connected using this information system:

1) provides sending the electronic appeals signed by the EDS of the user. In case of lack of the EDS the precautionary message for the user on impossibility of sending the address without EDS is displayed;

2) is provided by storage of all addresses of the user before exceeding of limit of space on the Portal. In case of exceeding of limit, work with service is blocked before release by the user of information resource "Virtual Reception" from irrelevant addresses for the purpose of release of space on the Portal. Removal of addresses is carried out directly by the author of the address.

In case of not operability of the Portal, service of technical support of the Portal notify on it users by placement of announcements on the portal: www.egov.kz.

18. The national operator by means of NUTs RK when functioning acceptance and processing of electronic appeals of physical persons and legal entities performs:

1) release and withdrawal of the closed key and the appropriate registration certificate NUTs RK;

2) ensuring integrity of information containing in electronic appeals of physical persons and legal entities;

3) timely updating and provision it is normative - technical documentation on setup and installation of the software of the closed key and the appropriate registration certificate NUTs RK on the information website www.pki.gov.kz.

19. The national operator by means of UTs GO carries out the following:

1) registration, release, withdrawal (cancellation) of registration certificates of the participant of ESEDO according to form of the established sample;

2) storage of registration certificates of the participant of ESEDO in the register of registration certificates, maintaining the register of registration certificates;

3) creation of the opened and closed EDS keys according to the address of members of electronic document management system according to regulating legal documents in the field of functioning of certification centers;

4) accounting of the existing and withdrawn (cancelled) registration certificates;

5) confirmation of accessory, authenticity and reality of open key of the EDS.
