About modification and amendments in some legal acts
The Parliament adopts this organic law.
Art. I. - In the Law on judicial system No. 514-XIII of July 6, 1995 (Official monitor of the Republic of Moldova, 1995, No. 58, of the Art. 641), with subsequent changes, to make the following changes and addition:
1. Part (Article 15 to state 2) in the following edition:
"(2) For separate categories of legal cases specialized courts can be effective. In degrees of jurisdiction specialized boards or structures of court can be effective.".
2. State Chapter 5 in the following edition: "Chapter 5 Specialized courts
Article 41. Specialized courts
(1) Specialized courts are component of judicial system.
(2) treat specialized freighters:
a) Military court;
b) District commercial court.
(3) the Military court and District commercial court consider the cases referred to their competence by the law.
Article 42. Military court
(1) the Military court functions in municipium of Chisinau.
(2) the district of Military court includes all regions, the cities, municipiums of the Republic of Moldova.
(3) the Structure and the staff list of the office of Military court are established by the Ministry of Justice in coordination with the Ministry of Defence.
(4) Creation of conditions for proper activities of military degrees of jurisdiction, their material and financial provision are performed by the Ministry of Defence in coordination with the Ministry of Justice.
(5) the Military court has the military protection which is free of charge provided in its maintaining by the Ministry of Defence. The number of necessary personnel of military protection is established by the Ministry of Justice and the Ministry of Defence under approval.
Article 421. District commercial court
(1) the District commercial court performs justice in case of the dispute resolution, carried to its competence by the Code of civil procedure.
(2) the district of District commercial court includes all regions, the cities, municipiums of the Republic of Moldova.".
