For the purpose of implementation of article 6 of the Agreement on questions free (special, special) economic zones on customs area of the Customs union and customs procedure of free customs zone made in the city of St. Petersburg on June 18, 2010 and the Law of the Republic of Kazakhstan of July 21, 2011 "About special economic zones in the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Instruction for maintaining the unified register of participants of special economic zone.

2. To committee on investments of the Ministry of the industry and new technologies of the Republic of Kazakhstan (to Serikov A. Zh.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) after state registration of this order its official publication;

3) placement of this order on the Internet resource of the Ministry of the industry and new technologies of the Republic of Kazakhstan.

3. To impose control of execution of this order on the first vice-minister of the industry and new Pay technologies of the Republic of Kazakhstan A.P.

4. This order becomes effective from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan.

Instruction for maintaining the unified register of participants of special economic zone

1. General provisions

1. This Instruction for maintaining the unified register of participants of special economic zone (further - the Instruction) is developed according to article 6 of the Agreement on questions free (special, special) economic zones on customs area of the Customs union and customs procedure of free customs zone made in the city of St. Petersburg on June 18, 2010 and the Law of the Republic of Kazakhstan of July 21, 2011 "About special economic zones in the Republic of Kazakhstan" and disaggregates maintaining the unified register of participants of special economic zone (further - the Register), and also issues of the certificate certifying registration of person as the participant of special economic zone.

2. Maintaining Register

2. The Register joins participants of the special economic zones (further - SEZ) created in the territory of the Republic of Kazakhstan.

3. The register is created and kept by structural division of authorized state body in the field of creation, functioning and abolition of SEZ (further - responsible division) in electronic format in the state and Russian languages in form, according to appendix 1 to this Instruction.

4. The responsible division enters in the Register data within five working days from the date of receipt of notices on the conclusion or agreement cancelation about implementation of activities as the participant of SEZ represented by governing bodies of SEZ.

Date of entering into the Register of data on registration of person as the participant of SEZ is day of the conclusion of the agreement on activities implementation.

5. Maintaining the Register includes:

1) introduction (inclusion) of information about participants of SEZ;

2) updating (updating) of information about participants of SEZ.

6. The register contains the following data:

1) in column 1 number of record is specified serial;

2) full name of the participant of SEZ with indication of organizationally - legal form based on the registration certificate of the legal entity for residents, based on the legalized statement from the trade register or other legalized document certifying that the foreign legal entity is legal entity by the legislation of foreign state for nonresidents is brought in column 2;

3) the abbreviated name of the participant of SEZ is introduced in column 3;

4) the trade name of the participant of SEZ is brought in column 4 (in the presence);

5) the legal address of the participant of SEZ is brought in column 5;

6) registration number or business and identification number of the participant of SEZ is introduced in column 6;

7) the name SEZ in the territory of which the participant of SEZ performs priority types of activity is introduced in column 7;

8) the name of the project performed by the participant of SEZ according to the signed agreement on implementation of activities as the participant of SEZ in the territory of SEZ is introduced in column 8.

9) in column 9 date of entering of record into the Register about registration of person as the participant of SEZ or about deprivation of person of participant status of SEZ is specified.

10) are brought certificate number about registration of person as the participant of SEZ in column 10;

11) in column 11 it is specified other data.

7. Information containing in the Register is provided on requests of interested persons, is public and is placed on the Internet resource of authorized state body in the field of creation, functioning and abolition of SEZ.

3. Issue of the certificate certifying registration of person as the participant of special economic zone

8. The certificate certifying registration of person as the participant of SEZ (further - the Certificate), is drawn up by responsible division in the state and Russian languages, in form according to appendix 2 to this Instruction.

9. In the Certificate the following data are specified:

1) the name of authorized state body in the field of creation, functioning and abolition of SEZ;

2) registration number and date of entering into the Register of data on registration of person as the participant of SEZ;

3) date of issue of the Certificate;

4) name SEZ;

5) name of the participant of SEZ;

6) location of the participant of SEZ;

7) surname, name, middle name (in case of its availability), the signature of the head and seal of responsible division.

10. The certificate within five working days goes to governing body of SEZ for its subsequent issue to the participant of SEZ after entering of information about the participant of SEZ into the Register.

11. The governing body of SEZ grants the Certificate within five working days after its receipt by the method fixing its obtaining.

12. Execution of the duplicate of the Certificate is made by responsible division based on the statement of the participant of SEZ in cases of spoil or loss.

13. To the participant of SEZ the new certificate in case of one of the below-stated cases is granted:

1) change of the name SEZ;

2) change of the name of the participant of SEZ;

3) change of the location of the participant of SEZ.

14. The duplicate and the new Certificate are issued to the participant of SEZ according to Items 10, of the 11th this Instruction.

In case of issue of the duplicate or new Certificate registration number and date of entering into the Register of data on registration of person as the participant of SEZ do not change.

15. The granted Certificates return participants SEZ and the corresponding data is entered in the Register:

1) in case of abolition of SEZ;

2) after term or early agreement cancelation about activities implementation.
