1. Approve the enclosed Rules of implementation of monitoring of production and realization of oil products.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of implementation of monitoring of production and realization of oil products

1. General provisions

1. These rules of implementation of monitoring of production and realization of oil products (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 20, 2011 "About state regulation of production and turnover of separate types of oil products" and establish procedure of monitoring of production and realization of oil products.

2. In these rules the following concepts are used:

1) authorized body in the field of production of oil products - the central executive body performing management in the field of state regulation of production of oil products;

2) authorized body concerning customs affairs - the state body performing state regulation in the field of customs affairs;

3) authorized body in the field of the state statistics - the state body performing management, and also cross-industry coordination in the field of the state statistics within the competence;

4) oil products - separate types of oil products: gasoline, aviation and diesel fuel, fuel oil;

5) producer of oil products - the physical person or legal entity which is performing production of oil products and having the passport of production;

6) the producer of low power - the producer of oil products performing production of oil products on technological installations which design capacity provides amount of conversion of crude oil and (or) gas condensate less than eight hundred thousand tons per year;

7) the wholesale supplier of oil products - the physical person or legal entity enabling wholesale of oil products.

3. Monitoring of production and turnover of oil products is performed by authorized body in the field of production of oil products and includes:

1) monitoring of the made amounts in the Republic of Kazakhstan of oil products by their types;

2) monitoring of realization of oil products in the Republic of Kazakhstan, including export and import of oil products;

3) monitoring of wholesale and retail prices on the oil products made in the Republic of Kazakhstan;

4) monitoring of needs of areas, the cities of republican value and the capital in oil products.

4. Information on monitoring of production and realization of oil products is created by authorized body in the field of production of oil products based on data of the low power provided by producers, producers, wholesale suppliers of oil products, local executive bodies, authorized body concerning customs affairs.

2. Procedure for monitoring of the made and realized oil products

5. Producers of oil products provide in authorized body in the field of production of oil products:

1) daily till 04:00 o'clock the Astana time of the day following for reporting, daily information on movement of oil and oil products according to appendix 1 to these rules;

2) daily till 11:00 o'clock the Astana time of the day following for reporting, information on shipment of oil products according to appendix 2 to these rules;

3) daily till 11:00 o'clock the Astana time of the day following for reporting, information on shipment of socially important oil products according to appendix 3 to these rules;

4) monthly to the 5th following for reporting, information on production of oil products according to appendix 4 to these rules;

5) monthly to the 5th following for reporting, monthly information on shipment of oil products according to appendix 5 to these rules.

6. Producers of oil products of low power provide in authorized body in the field of production of oil products:

1) monthly to the 5th following for reporting, monthly information on movement of oil and oil products according to appendix 6 to these rules;

2) monthly to the 5th following for reporting, information on shipment of oil products on the domestic market and export according to appendix 7 to these rules.

7. Wholesale suppliers of oil products provide in authorized body in the field of production of oil products:

1) daily till 13:00 o'clock the Astana time of the day following for reporting, information on shipment of oil products according to appendix 8 to these rules;

2) daily till 13:00 o'clock the Astana time of the day following for reporting, information on shipment of diesel fuel for producers of agricultural products during agrotechnical works according to appendix 9 to these rules;

3) daily till 13:00 o'clock the Astana time of the day following for reporting, information on shipment of fuel oil for social production facilities and organizations during heating season according to appendix 10 to these rules;

4) ezhedekadno till 13:00 o'clock the Astana time of the day following reporting decade, information on shipment of aviation fuel for the airports according to appendix 11 to these rules.

5) daily till 13:00 o'clock the Astana time information on wholesale prices according to appendix 12;

6) daily till 13:00 o'clock the Astana time information on import of oil products according to appendix 13.

3. Procedure for monitoring of needs of regions for oil products

8. Information on monitoring of needs of regions for oil products is created by authorized body in the field of production of oil products based on the information provided by local executive bodies.

9. Local executive bodies of areas, cities of republican value and the capital annually represent to authorized body in the field of production of oil products the forecast for consumption of oil products:

1) on which retail sale state regulation of the prices is established;

2) the heatsupplying organizations for the heating period.

4. Procedure for monitoring of retail prices on oil products

10. Information on monitoring of retail prices in regions is created by authorized body in the field of production of oil products based on the data provided by local executive bodies.

11. Local executive bodies daily the Astana time represent till 13:00 to authorized body in the field of production of oil products of the data on retail prices by areas and the cities according to appendix 14 and data on retail prices by gas stations of the cities according to appendix 15.

5. Procedure for monitoring of export and import of oil products

12. Information on monitoring of export and import of oil products is created by authorized body in the field of production of oil products based on the data provided by authorized body concerning customs affairs.

13. The authorized body concerning customs affairs monthly to the 15th represents to authorized body in the field of production of oil products of the data on export and import of oil products according to the established forms of authorized body in the field of customs control, the reflecting invoice costs and amounts of the exported or imported oil products by countries of source and the companies.

6. Procedure for systematization of summary information

14. The authorized body in the field of production of oil products analyzes the provided information on production and turnover of oil products.

15. Following the results of the analysis the authorized body in the field of production of oil products systematizes the provided information and constitutes:

1) daily till 09:00 o'clock Astana time summary daily information on movement of oil and oil products on producers of oil products;

2) daily till 13:00 o'clock Astana time summary information on shipment of oil products on producers of oil products;

3) daily till 13:00 o'clock Astana time summary information on shipment of socially important oil products on producers of oil products;

4) monthly to the 10th following for reporting, summary information on production of oil products on producers of oil products;

5) monthly to the 10th following for reporting, summary information on shipment of oil products on producers of oil products;

6) monthly to the 12th following for reporting, summary information on movement of oil and oil products on producers of oil products of low power;

7) monthly to the 12th following for reporting, summary information on shipment of oil products on producers of oil products of low power;

8) daily till 16:00 o'clock Astana time summary information on shipment of oil products on wholesale suppliers of oil products;

9) daily till 16:00 o'clock the Astana time summary information on shipment of diesel fuel for producers of agricultural products during agrotechnical works on wholesale suppliers of oil products;

10) daily till 16:00 o'clock the Astana time summary information on shipment of fuel oil for social production facilities and organizations during heating season on wholesale suppliers of oil products;

11) ezhedekadno summary information on shipment of aviation fuel for the airports on wholesale suppliers of oil products;

12) weekly on Mondays information on wholesale prices on wholesale suppliers of oil products;

13) monthly to 1 date of the data on need of regions on local executive bodies;

14) daily till 16:00 o'clock the Astana time summary data on retail prices in the Republic of Kazakhstan;

15) monthly to the 20th of the data on export and import of oil products.

16. The authorized body in the field of production of oil products monthly to the 10th day of every month following reporting represents to authorized body in the field of the state statistics summary information on production of oil products by producers of oil products and types of products.

The authorized body in the field of production of oil products sends the facts of marginal exceeding of price of retail sale of oil products to the authorized body performing management in spheres of natural monopolies and in the controlled markets by results of monitoring of retail prices on oil products for reaction taking measures.
