For the purpose of agreement performance between the Government of the Russian Federation and the Government of the Azerbaijan Republic about production and scientific and technical cooperation of the companies of defense industries of December 25, 1993, the Government of the Russian Federation and the Government of the Republic of Armenia about production and scientific and technical cooperation of the companies of defense industries of March 30, 1994, the Government of the Russian Federation and the Government of the Republic Georgia about production and nauchnotekhnichesky cooperation of the companies of defense industries of December 24, 1993, the Government of the Russian Federation and the Government of the Kyrgyz Republic about production and scientific and technical cooperation of the companies of defense industries of January 18, 1994, The government of the Russian Federation and the Government of the Republic of Moldova about production and scientific and technical cooperation of the companies of defense industries of February 18, 1994, the Government of the Russian Federation and the Government of the Republic of Tajikistan about production and scientific and technical cooperation of the companies of defense industries of June 9, 1994, the Government of the Russian Federation and the Government of the Republic of Uzbekistan about production and scientific and technical cooperation of the companies of defense industries of January 26, 1994, the Government of the Russian Federation and the Government of the Republic of Uzbekistan about ensuring further cooperation in the field of joint creation, serial production and deliveries of the airplanes Il114 and Il-114T of March 12, 1997, the Government of the Russian Federation and the Government of the Republic of Uzbekistan about further cooperation in the field of joint creation, serial production and deliveries to operation of the Il-76MF and Il-76TF airplanes, and also ensuring operation and upgrade of the Il-78 Il-76, airplanes and their modifications of May 6, 1998, the Government of the Russian Federation and the Government of Ukraine about production and nauchnotekhnichesky cooperation of the companies of defense industries of November 18, 1993, the Government of the Russian Federation and the Government of Ukraine about cooperation in the field of ship gas-turbine construction of November 18, 1993, the Government of the Russian Federation and the Government of Ukraine about cooperation in the field of development, production, deliveries and operation of the aircraft equipment of August 20, 1997 (further - intergovernmental agreements), and also according to part 4 of article 224 of the Federal Law of November 27, 2010 N 311-FZ "About customs regulation in the Russian Federation" (The Russian Federation Code, 2010, N 48, Art. 6252; 2011, N 27, 3873, N 29, of the Art. 4291, N 50, of the Art. 7351) I order to the Art.:

1. Approve the Procedure for making of customs transactions and customs control of the goods imported into the Russian Federation and exported from the Russian Federation within intergovernmental agreements (appendix).

2. To head department of the federal customs income and tariff regulation (O. N. Komarov) to exercise control and registration of the inventories represented by Minpromtorg of Russia moved according to intergovernmental agreements.

3. Recognize invalid:

1) the order of the State Customs Committee of Russia of September 8, 2003 N 999 "About features of customs clearance of the goods moved through customs border of the Russian Federation within intergovernmental agreements about production and scientific and technical cooperation of the companies of defense industries" (it is registered by the Ministry of Justice of the Russian Federation 10.10. 2003, рег. N 5167);

2) the order of FCS of Russia of August 9, 2006 N 751 "About introduction of amendments to orders of the State Customs Committee of Russia of 24.12.1998 N 870 and of 08.09.2003 N 999" (it is registered by the Ministry of Justice of the Russian Federation 14.09. 2006, рег. N 8267) in the part concerning the order of the State Customs Committee of Russia of September 8, 2003 N 999 "About features of customs clearance of the goods moved through customs border of the Russian Federation within intergovernmental agreements about production and scientific and technical cooperation of the companies of defense industries" (it is registered by the Ministry of Justice of the Russian Federation 10.10. 2003, рег. N 5167).

4. To impose control of execution of this order on the first deputy head of FCS of Russia V. M. Malinin.

This order becomes effective after 30 days after day of its official publication.

Appendix

to the Order of the Federal Customs Service of the Russian Federation of March 5, 2012 No. 407

Procedure for making of customs transactions and customs control of the goods imported into the Russian Federation and exported from the Russian Federation according to intergovernmental agreements

1. Making of customs transactions and customs control of the goods necessary for the arms production and military equipment, aircraft equipment of military and civil appointment, ship gas-turbine construction, including materials, components, semifinished products, educational and auxiliary property (further - goods), is made according to the lists registered and sent to FCS of Russia to the customs authority making customs transactions and customs control.

2. Rules of submission to customs authorities of the Russian Federation of the inventories imported into the Russian Federation and exported from the Russian Federation within intergovernmental agreements are given in appendix to this Procedure.

3. Customs transactions and customs control of the goods imported into the Russian Federation and exported from the Russian Federation are performed according to the procedure established by the Customs Code of the Customs Union, the legislation of the Russian Federation on customs affairs and regulatory legal acts of FCS of Russia taking into account the following features established according to intergovernmental agreements.

4. Goods are not subject to quoting and licensing and in case of their import to the Russian Federation submission of certificates of conformity is not required.

5. Goods are exempted from payment of customs duties.

6. Movement of goods is made according to the customs procedures established by the Customs Code of the Customs Union and within the current calendar year specified in the list.

7. Customs transactions with goods are made according to the nomenclature and quantity specified in lists.

8. During two weeks after release of all goods specified in the list or after the termination of the calendar year specified in the list, customs represents to FCS of Russia of the copy of lists with marks about release of goods for the subsequent transfer them in Minpromtorg of Russia.

Appendix

to the Procedure for making of customs transactions and customs control of the goods imported into the Russian Federation and exported from the Russian Federation according to intergovernmental agreements

Rules of submission to customs authorities of the Russian Federation of the inventories imported into the Russian Federation and exported from the Russian Federation within intergovernmental agreements

1. Movement within intergovernmental agreements of the goods necessary for the arms production and military equipment, the aircraft equipment of military and civil appointment, ship gas-turbine construction, including materials, components, semifinished products, educational and auxiliary property (further - goods), is performed based on inventories (further - lists).

2. The lists constituted by Minpromtorg of Russia in pursuance of intergovernmental agreements are represented to FCS of Russia on the samples given in appendix to these rules.

3. The lists represented in duplicate by Minpromtorg of Russia shall answer the following conditions:

a) contain names of goods with which customs transactions will be performed in the region of activities of one customs, with indication of the state under the agreement with which goods move;

b) contain names of goods which will move within one calendar year;

c) not contain corrections and erasures.

4. Each leaf of the list shall be signed by the authorized officer of Minpromtorg of Russia with indication of date of the signature and putting down of impress of a seal of the established sample of the specified ministry. Specimen signatures of authorized officers and impress of a seal are represented by Minpromtorg of Russia to FCS of Russia and are brought to the attention of customs authorities.

5. FCS of Russia accepts the provided lists and checks them for compliance of stipulated in Item 3 these rules to conditions. In the absence of violations of FCS of Russia within 10 days from the date of representation registers lists in the following procedure.

Registration of lists is performed according to the magazine of registration of lists which procedure for maintaining is established by FCS of Russia.

On each leaf of the list registration number according to the following scheme is put down:

element 1 - alphabetic code of the direction of movement of goods (And - in case of commodity importation; Э - in case of commodity exportation);

element 2 - code of FCS of Russia according to the Qualifier of customs authorities;

element 3 - registration date of the list (day, month, two last figures of year);

element 4 - the sequence number of the list assigned according to the magazine of registration of lists (begins with unit every calendar year).

Each leaf of the list is signed by the chief of Head department of the federal customs income and tariff regulation or its deputy supervising questions of control of application of charge of customs payments. The signature is certified seal of FCS of Russia.

6. FCS of Russia can refuse registration of lists in case of non-compliance with the conditions established by intergovernmental agreements, the customs legislation of the Customs union and the legislation of the Russian Federation on customs affairs, regulatory legal acts of FCS of Russia and these rules.

In registration of FCS of Russia in writing notifies Minpromtorg of Russia with indication of causes of failure within 15 days from the date of receipt of lists in FCS of Russia on refusal.

7. FCS of Russia after registration returns one copy of the list with the cover letter in Minpromtorg of Russia.

The second copy of the list remains in FCS of Russia which in the scanned type goes on electronic communication channels to the relevant customs authority making customs transactions with goods within two days from the date of registration of the list. About date of the direction of the list in customs authority the log entry of registration of lists is made.

8. Modification or cancellation of separate or all line items in the lists registered by FCS of Russia is made based on the written appeal of Minpromtorg of Russia signed by the authorized officer with indication of registration number of the list, changeable line items which shall be cancelled or cancelled and changed with appendix of additional lists which include changeable line items, drawn up according to these rules.

Modification of already registered lists does not stop their execution, the line items except for cancelled or changed.
