WE ORDER:
1. Approve "Temporary procedure for control of import to the territory of the Kyrgyz Republic of products (goods) which are subject to obligatory certification" (Appendix No. 1).
2. To heads of territorial authorities of the State customs inspection and Kyrgyzstandart:
- accept to execution "Temporary procedure" and issue joint orders on interaction of control of the imported products (goods);
- hold joint seminars meetings on studying of fundamental documents on obligatory certification.
3. Enact the following document forms: The direction on certification of products (Appendix No. 2); The Obligation statement about compliance of batch of the imported products to safety requirements (Appendix No. 3); The Instruction about prohibition of realization (use) of products (Appendix No. 4); Permission to realization (use) of products (Appendix No. 5).
4. To impose control of implementation of this order on the deputy director of GTI in case of the Ministry of Finance of the Kyrgyz Republic Zakirov K. A. and deputy director Kyrgyzstandart Dyusheev T. S.

This Procedure is developed in pursuance of the laws of the Kyrgyz Republic "About consumer protection", "About certification of products and services" and determines release conditions on the territory of the Kyrgyz Republic of products (goods) which are subject to obligatory certification according to legal acts of the Kyrgyz Republic.
1.1. Products (goods) imported on the territory of the Kyrgyz Republic by all subjects of foreign economic activity (foreign trade activities) irrespective of patterns of ownership and departmental subordination, nationality and also the products (goods) arriving through the humanitarian assistance and imported for holding exhibitions sales are subject to control.
1.2. The product range (goods), the Kyrgyz Republic imported on the territory which is subject to obligatory certification is determined by the State inspectorate for standardization and metrology under the Government of the Kyrgyz Republic (Kyrgyzstandart) in coordination with the State customs inspection under the Ministry of Finance of the Kyrgyz Republic (GTI), based on the List approved by the Government of the Kyrgyz Republic (The order of the Government of the Kyrgyz Republic No. 260 of 28.04.94, No. 857 of 19.12.94 and No. 146 of 05.04.96).
1.3. Products (goods) are subject to release on the territory of the Kyrgyz Republic on condition of its compliance to the requirements of obligatory certification established in the Kyrgyz Republic.
1.4. The document confirming compliance to safety requirements of the Kyrgyz Republic of products (goods) imported on the territory is the Certificate of conformity (Appendices No. 6, 7, 8), protected by holographic brand, issued by Kyrgyzstandart or the body accredited by rules of National system of certification.
1.5. The obligation statement - is the document confirming the sole responsibility of the subject of foreign trade activities about compliance of the imported lot of products (goods) to the safety requirements provided by the current legislation of the Kyrgyz Republic and carrying out certified works, further the Obligation statement (Appendix No. 3).
1.6. Realization (use) of the imported products (goods) is made only in the presence of the permission issued by Kyrgyzstandart or the body accredited by rules of National system of certification after receipt of the Certificate of conformity.
2.1. Products (goods) which are subject to obligatory certification are subject to release (conditional release) only on condition of provision in customs authorities of the Kyrgyz Republic of the Certificate of conformity (Obligation statement) in case of the statement of the following customs regimes:
- release for free circulation;
- reimport;
- duty-free shop;
- conversion under customs control (in case of product output of conversion in free circulation);
- outward processing (in the part concerning import of products of conversion);
- refusal of goods for benefit of the state.
2.2. Are issued without condition of provision of the Certificate of conformity or the Obligation statement the following products (goods), irrespective of customs regimes under which they are located:
- products (goods) intended for official use of representations of foreign states and international intergovernmental organizations and also for their personnel;
- the products (goods) imported by physical persons and which are not intended for productive or other business activity (except as specified import of such products (goods) over the established cost and quantitative quotas);
- the products (goods) imported in single quantities and intended for consumption it is exclusive persons importing them. In case of alienation of the specified products (goods), it is subject to certification in accordance with the established procedure.
