About refugees

This Law determines procedure and conditions of recognition of persons by refugees, their legal status, establishes legal, economic and social protection of the rights of guarantees of refugees.

Chapter I. General provisions

Article 1. Concept about the refugee

The refugee - person who owing to quite reasonable concerns to fall victim of prosecutions on the basis of race, religions, nationality, belonging to certain social group or political convictions is in Turkmenistan and cannot use protection of the country or does not wish to use such protection owing to such concerns; or, without having certain nationality and being out of the country of the former regular residence as a result of similar events, cannot or does not wish to return to it owing to such concerns.

Article 2. Legislation on refugees

The legislation on refugees is based on the Constitution of Turkmenistan, the conventional principles and rules of international law, consists of this Law and other regulatory legal acts of Turkmenistan regulating the questions relating to refugees.

If the international treaty of Turkmenistan establishes other rules than provided by this Law, then rules of the international treaty are applied.

Article 3. Guarantees of the rights of the refugee

Person is exempted from liability for illegal entrance and illegal stay in the territory of Turkmenistan if having arrived directly from the territory in which his life or freedom were endangered, immediately will independently be to representatives of authorities of Turkmenistan with request for recognition by his refugee.
