About approval of the Procedure for maintaining the State register of appraisers and subjects of estimative activities

According to Item 5 parts one of article 5 of the Law of Ukraine "About Fund of state-owned property of Ukraine", the Law of Ukraine of January 13, 2012 "About introduction of amendments to some laws of Ukraine concerning privatization concerning realization of provisions of the State program of privatization for 2012 - 2014" ORDER to No. 4336-VI:

1. Approve the Procedure for maintaining the State register of appraisers and subjects of estimative activities it (is applied).

2. Recognize invalid orders of Fund of state-owned property of Ukraine: of May 25, 2004 No. 995 "About approval of the Procedure for maintaining the State register of subjects of estimative activities and provision of references from it", No. 1594 registered in the Ministry of Justice of Ukraine on June 10, 2004 for No. 715/9314, of September 09, 2002 "About approval of the Procedure for maintaining the State register of appraisers", No. 2355 registered in the Ministry of Justice of Ukraine on September 16, 2002 for No. 752/7040, of December 19, 2001 "About approval of the Order of registration of physical persons (appraisers) in the State register of appraisers", registered in the Ministry of Justice of Ukraine on December 28, 2001 for No. 1092/6283.

3. Determine that the appraisers included in the State register of appraisers, and the subjects of estimative activities included in the State register of subjects of estimative activities automatically join in the State register of appraisers and subjects of estimative activities for the same directions and specializations within such directions in which they were included in the State register of appraisers and the State register of subjects of estimative activities respectively.

4. Documents of appraisers (subjects of estimative activities) specified in Item 3 of this order do not need reduction in compliance with the requirements established by the Section V of the Procedure for maintaining the State register of appraisers and subjects of estimative activities.

5. To provide to the head of department concerning estimative activities state registration of this order in the Ministry of Justice of Ukraine.

6. To impose control over the implementation of this order on the director of the department of coordination of development and accomplishment of program documents, assessment and the order objects of state-owned property.

7. This order becomes effective from the date of its official publication.

Procedure for maintaining the State register of appraisers and subjects of estimative activities

І. General provisions

1.1. This Procedure determines legal principles and organizational procedures of collection, accumulating, processing and receipt of information from the State register of appraisers and subjects of estimative activities (further - the Register), establishes requirements and procedure for inclusion (exception) for information on appraisers and subjects of estimative activities in (from) the Register (and).

1.2. The register is the automated system of collection, accumulating and information processing about appraisers in Ukraine who received certificates of competency of appraisers, and subjects of estimative activities - subjects of managing which received certificates of subjects of estimative activities.

1.3. The register is system which is created with observance of requirements of the Law of Ukraine "About personal data protection" and is effective for the purpose of ensuring informing society concerning assessment of property, property rights and professional estimative activity in Ukraine.

1.4. The purpose of maintaining the Register is:

ensuring the complete automated accounting of appraisers who in accordance with the established procedure received certificates of competency (documents) of appraisers, and subjects of managing which in accordance with the established procedure received the certificate of the subject of estimative activities;

monitoring of development of infrastructure of assessment of property in Ukraine and creation of competitive environment among appraisers and subjects of estimative activities;

ensuring availability of information on appraisers and subjects of estimative activities within the legislation for subjects of managing and physical persons, and also public authorities, local government bodies, public organizations, their associations, other interested persons;

generalization of information on appraisers and subjects of estimative activities, including on the directions of grade and specializations within such directions;

ensuring monitoring of observance by appraisers and subjects of estimative activities of requirements of the legislation concerning assessment of property, property rights and professional estimative activity, including observance of external control system of quality.

1.5. Subjects of the Register are:

Fund of state-owned property of Ukraine (further - Fund);

appraisers;

subjects of estimative activities;

administrator Reestra;

users information of the Register.

1.6. The fund is the owner and manager Reestra, Reestr conducts, performs the ordering powers concerning it, including:

determines the organizational and methodological principles of maintaining the Register, and also procedure for technical functioning of its automated computer system, preserving and information security which contains in it;

will organize creation of system of collection and accumulating of information on appraisers and subjects of estimative activities for filling by information of the Register;

controls representation by appraisers and subjects of estimative activities of information in the Register;
