About approval of Methodological regulations of the organization and carrying out professional training of the unemployed
Due to the made changes in the Law No. 102-XV of March 13, 2003 on employment of the population and social protection of persons which are in job search (Monitorul Oficial al Republicii Moldova, 2005, No. 95-97, St. 444) and execution of the Order of the Government No. 1080 of September 5, 2003 "About approval of the Regulations on procedure for the organization of professional training of the unemployed" (it is changed by the Order of the Government No. 676 of 12:09. 2011, Monitorul Oficial al Republicii Moldova 152-155/747 of 16:09. 2011) the Ministry of Labour, Social Protection and Family together with the Ministry of Public Education ORDER:
1. Approve Methodological regulations of the organization and carrying out professional training of the unemployed (are applied).
2. To national employment agency of the population:
provide employment agencies of the population of areas, municipiums, ATO Gagauzia and educational institutions, service providers on professional training of the unemployed with these Methodological regulations;
organize, as necessary, with the specialists of territorial agencies responsible for professional training of the unemployed, zone instructive seminars on effective implementation of these Methodological regulations.
3. Provide to the Ministry of Public Education educational institutions (service providers on professional training of the unemployed) with curricula and programs with the reduced training terms, according to professional standards and standards on employment.
4. Cancel the joint order of the Ministry of Economy and Trade No. 89 of 13.12.2007 and the Ministry of Education and youth No. 869 of 13.12.2007 "About approval of Methodological regulations of the organization and carrying out professional training of the unemployed".
5. To vozozhit control of execution of this order on Mr. Ion Holban, the CEO of National employment agency of the population.

Appendix
to Orders of the Ministry of Labour, Social Protection and Family No. 42/1 of March 13, 2012 and the Ministry of Public Education No. 135 of March 13, 2012
1. According to the Law of the Republic of Moldova No. 102-XV of March 13, 2003 "O of employment of the population and social protection of persons which are in job search" (it is changed by the Law No. 56 of 9:06. 11, Monitorul Oficial al Republicii Moldova 107-109/1.07.11 of the Art. 280) and the Order of the Government No. 1080 of September 5, 2003. "About approval of the Regulations on procedure for the organization of professional training of the unemployed" (it is changed No. 676 software of 12:09. 2011, Monitorul Oficial al Republicii Moldova 152-155/747 of 16:09. 2011) the National employment agency of the population (further - the National agency) will organize rates of preparation, retraining and advanced training of the unemployed (further - professional training) for the purpose of increase in their competitiveness in the labor market.
2. (1) the National agency offers the Ministry of Labour, Social Protection and Family the list of crafts/professions for training of the unemployed on average vocational training and the list of programs of professional training for specialties for training of the unemployed who finished postsecondary professional and higher education:
a) according to requests of economic agents with the subsequent employment of the unemployed;
b) based on results of studying of demand in the labor market and determinations of need for personnel at the moment or on perspective (up to one year) in this territory.
c) at requests of the unemployed who wish to be engaged in business activity.
(2) Studying of market demand of work (subitem b) is performed by specialists district, municipal and ATO Gagauzia of employment agencies of the population (in dalneyshemagentstva).
3. Services in professional training are rendered for the purpose of training and employment of the greatest number of persons which are in search of workplace.
4. Persons go to rates of professional training or other forms of education not more young 16 years registered in the agencies which own (do not own) profession (craft) and cannot be employed due to the lack of suitable work.
Persons aged up to 18 years registered in territorial agencies which own or not craft/profession also cannot be employed due to the lack of suitable work, have no access to training in the direction of professional training "713 Electrician and power", and also by crafts / professions on which, depending on their complexity, the base of training of the lyceum or secondary general education is required.
Graduates of boarding schools, orphan children, children without parental support, and the children who are under guardianship, children from large families, children from single-parent families and also the victims of human trafficking, disabled people, veterans of all categories and persons exempted from places of detention or from organizations of social resettlement go to rates of professional training mainly.
The unemployed use free services in professional training only once for each case of registration as the unemployed.
5. (1) Rates of professional training of the unemployed will be organized by the National agency by means of:
educational institutions of the Ministry of Education;
educational institutions and centers of course training of other ministries, departments, patronage and labor unions;
state and private economic agents;
commercial associations and non-profit organizations.
Service providers on professional training shall be authorized according to the current legislation.
(2) Rates of professional training in the cases provided by item 5 (1), are carried out based on agreements (appendix No. 1) concluded between the National agency (agencies) and educational institutions which won tender about public procurements on rendering services in professional training of the unemployed. Training in non-state private educational institutions will be organized and carried out on state standards.
In areas in which between service providers for training of the unemployed by certain profession / craft there is no corresponding competition employment agencies of the population sign direct direct service provision agreements on training between the parties.
In areas where there are no educational institutions - service providers on professional training, employment agencies of the population can sign direct service provision agreements on training with educational institutions from the neighboring area.
For persons directed to rates of professional training according to requests of economic agents, the agency signs the tripartite agreement (the agency, educational institution, the economic agent) on the subsequent employment of graduates (appendix 6).
(3) Rates of professional training of the unemployed will be organized:
a) if all conditions provided by item 2 for this profession, craft, occupation, activities or specialization are complied;
b) if the material and didactic base for professional training which is determined is created:
availability of well equipped educational audiences equipped with methodical material and educational visual aids;
teachers with high professional and pedagogical training;
availability of places for passing of work practice of all cadets.
6. For participation in tender of public procurements on rendering services in professional training of the unemployed the educational institution submits to the agency set of the documents submitted in the tender documentation according to the legislation on public procurements.
Educational institutions will submit in addition to set of documents:
a) educational and thematic plans and programs for theoretical disciplines and inservice training;
b) expense budgets on professional training and provision of housing (appendices 2 and 4);
c) the agreement on provision of housing to the unemployed directed to training (appendix 3) if the educational institution has the hostel;
d) the developed data on the faculty participating in process of professional training of the unemployed (appendix 5);
e) contracts with economic agents on provision of places for passing of work practice.
7. Professions and crafts on which courses of professional training of the unemployed are conducted shall correspond to the List of the directions of professional training and crafts/professions developed based on the Qualifier of occupations of the Republic of Moldova. The list of crafts/professions for training of the unemployed on average vocational training and programs of professional training for specialties for training of the unemployed who finished postsecondary professional and higher education, and also training duration proceeding from courses types affirm the Ministry of Labour, Social Protection and Family together with the Ministry of Public Education depending on situation in the labor market.
8. (1) Duration of rates of professional training is established differentially, depending on degree of complexity of profession or craft, courses are conducted according to plans and programs of preparation which shall not exceed 9 months.
(2) For retraining of persons having certain knowledge and practical skills in this profession the program of professional training in the specialty terms of training can be cut by educational institutions by half.
9. The management and control of the organization and carrying out rates of professional training are performed by specialists of the National agency (agencies).
10. The direction on rates of professional training is performed by specialists of the agency who make the corresponding entry in accounting card of the unemployed. For this purpose the unemployed shall submit the following documents:
education document;
the medical certificate about the state of health corresponding to this profession;
the service record (for persons with working life);
conclusion of the specialist about professional suitability.
Personal records of the unemployed remain in the agencies.
11. Go the unemployed who to rates of professional training:
have the complete or incomplete secondary education or other education necessary for development of the corresponding rate;
by some simple professions (crafts) the direction for study and those persons who have no incomplete secondary education is allowed, but have necessary minimum of knowledge for development of the corresponding profession (craft) of activities or occupation;
are able-bodied or have the conclusion of VTEK for this profession (craft), for persons with limited opportunities; correspond to other conditions of professional selection, including results of testing of the capabilities provided for this profession (craft) or type of activity.
12. (1) the Unemployed directed to rates of professional training sign with the agency the agreement of the corresponding sample (appendix 7) with the subsequent issue of the direction on rates of professional training (appendix 8).
(2) the Information about the unemployed enlisted on rates is introduced in the corresponding register enlisted / ended rates of professional training which is stored in electronic form in territorial agencies.
(3) transportation expenses (to the place of study and back or daily expenses are refunded to the Unemployed directed to training to other area), expenses in hostels of educational institution and are partially compensated expenses on housing in case of lack of hostels in educational institution where the unemployed is enlisted for accommodation.
(4) Daily expenses for transport within a month shall not exceed the average monthly expenses for accommodation out of hostels of educational institutions established by the order of the National agency.
(5) the Educational institution enlists the unemployed on rates based on the direction of the agency (appendix 8) which is valid within two months - the maximum term for replenishment of groups on training.
(6) not the taxable monthly grant in the amount of 10 percent of the average salary on economy for previous year according to the submitted application is provided to the Unemployed studying at rates of professional training and not going on the dole or benefit on employment for training.
(7) Payment of grant stops for the following reasons:
a) termination of rates
b) assignment
c) provision of unemployment benefit or benefit on employment
d) employment
e) study suspension
f) removal from accounting
g) end of the period of training.
A. Plans and training programs
13. (1) the Professional program of professional training in the specialty, preparation provides theoretical and skills training which is provided according to curricula and programs (for 36 hours a week).
(2) Theoretical training is provided consistently with practical preparation depending on the available conditions.
14. Curricula and programs for professional training of the unemployed are developed by educational institutions, affirm the Ministry of Public Education and are approved with the Ministry of Labour, Social Protection and Family.
15. (1) theoretical and practical hours on each discipline for each profession (craft) the program of professional training in the specialty are provided In the curriculum.

B. Theoretical and practical preparation
16. (1) Theoretical preparation is performed in groups till 15-25 of cadets. Individual training or training in quantity to 15 people in group is in certain cases allowed.

(3) Educational institutions can create groups, having combined as the unemployed directed by employment agencies of the population and persons based on the joint contract with educational institution.
17. The educational institution fills in the magazine of the established sample approved by the Ministry of Public Education for each group.
18. (1) the Unemployed who are not advanced at subject matters, allowed gross violations of internal rules and procedures of educational institution or unreasonably missed more than 15% of total quantity of the hours provided by the training program are deducted from rates without the right directed further to similar rates to be free.

22. (1) Practical preparation is carried out to masterful economic agents by masters or other persons who direct groups, according to number of hours according to the program.
(2) In case of the direction on work practice the following conditions are considered:
accomplishment of the transactions or other works provided by the program of work practice the program of professional training in the specialty with observance of regulations of labor protection;
complexity of work depending on increase in level of training;
possibility of cadets to work independently, carrying out different transactions.
Control of work practice is exercised responsible for rates or other person approved as the director of educational institution.
23. (1) Practice is carried out to the first and second changes.
(2) during practice cadets fill in the diary on practice in which the description of the performed works is daily kept. Periodically cadets shall perform test works which are estimated by masters.
(3) Cadets can be directed to practice at the place of residence only in exceptional cases on presentation of the agreement signed with the company.

24. (1) Control of knowledge and abilities of cadets is carried out at least two times during the entire period of theoretical and practical preparation. Check is performed in written or oral form or in the form of practical works.
(2) the Cadets who skipped classes in reasonable excuses which according to these Methodological regulations are not deducted shall be interviewed by the teacher of the passed subjects.

32. Protocols of qualification examinations, documents and the book of accounting of issue of certificates on the termination of rates are filled in according to the existing instruction and stored in archive of educational institution within 75 years, except for magazines which are stored within 5 years.
33. Issue of certificates on the termination of rates is made according to the regulations established by the Ministry of Public Education. Forms of certificates of competency are standard documents of the strict reporting and are issued only based on data of the magazine of group and the minutes of the qualification commission. They are signed by the head of educational institution and the chairman of the qualification commission.
34. Certificates are filled in with paste of dark color, legible handwriting, without corrections. The surname and name of the graduate are written without reducings and shall correspond to the identity document.
35. (1) Certificates of competency are granted by the unemployed free of charge within 30 days from the date of passing an examination. The graduate who received the document undersigns for register of the received and issued education documents.

the other expenses which are directly connected with the organization of professional training of the unemployed, provided by agreements on cooperation between the National agency (agencies) and educational institutions;
expenses on payment of grants.
The expenses connected with journey to the place of study and back (one-time or daily), provide payment of transport for the passable way from the residence to the location of educational institution.
Transfer and payment of the expenses connected with journey to the place of study and back (one-time or daily), are performed based on detachable coupons of the direction on rates or the order on attendance of the lessons issued by educational institution according to limited rates in vehicles for the suburban and long-distance routes (for the passenger/km) approved by the order of the Ministry of Transports and Road Infrastructure taking into account distance from the residence of the unemployed to the location of educational institution. The expenses connected with daily journey to the place of study and back will not exceed the limits set in item 12 (4) this Regulations.
In case of determination of daily costs for journey in case the unemployed visited educational institution incomplete month, calculation is made by division of the average monthly size into number of the working days this month and multiplication on the number of days when the unemployed was present at occupations.
Ezhednevny Proyezd for incomplete month, at the beginning and at the end of rate, is paid totally as for all month, but no more provided average monthly amount, on condition of visit by the unemployed of all working days in this period. If these expenses there is less average monthly size, actual expenses are paid.
Expenses for accommodation in hostels of educational institution are paid by the agencies and paid by directly educational institution based on the joint agreement (appendix 3).
Expenses on housing partially are compensated to the enlisted unemployed in case of lack of hostels in educational institution by the agencies and paid directly jobless according to orders of educational institutions (the order on the transfer/termination of rates of professional training and on the direction on work practice). The monthly size concerning compensation of expenses on accommodation of the unemployed during training is determined by annually National employment agency of the population and will not exceed the minimum limit on accommodation provided by the Order of the Government No. 10 of January 5, 2012 about approval of the Regulations on sending out on business of workers of subjects of the Republic of Moldova.
38. The expenses on payment of grant provided by the item of 37 presents of Methodological regulations are costs for covering of expenses on training of the unemployed. Expenses on payment of grants are not assessed with tax and are provided monthly during training in the amount of 10 percent of the average salary on economy for previous year at the time of payment establishment.
The grant is paid in full if the unemployed had the right to its obtaining within a month.
The grant for part of month is calculated by division of the established monthly size on the number of days of this month, and the result is multiplied on the number of days of month for which the unemployed goes on the dole.

39. (1) the Pedagogical personnel performing theoretical training of the unemployed shall have good professional training and experience of teaching work.
(2) the Work practice is held in educational institutions and economic units and is provided with training officers - instructors of the corresponding institutions.
(3) the following tasks are assigned To the organizer of rates:
enhancement of the corresponding documentation for the organization of rate and matching of pedagogical personnel;
providing with audio-and video equipment and required didactic materials;
observance of the schedule and daily schedule of rate;
observance of the signed contracts with economic units where the work practice is held.
40. Appendices 1-9 are component of these Methodological regulations.
