About approval of the Regulations on the commission on questions of determination of the list and ceiling prices for the machinery and equipment of national production for agro-industrial complex which purchase is financed by means of the government budget

According to Item 2 of the Procedure for use of funds of the government budget which are allocated for acquisition of the domestic machinery and equipment for agro-industrial complex on the terms of financial leasing and action for transactions of the financial leasing approved by the resolution of the Cabinet of Ministers of Ukraine of December 10, 2003 No. 1904 (with changes), Item 2 of the Procedure for use of the means provided in the government budget for partial compensation of cost of difficult agricultural machinery of the national production approved by the resolution of the Cabinet of Ministers of Ukraine of July 28, 2010 No. 647 (with changes), Item 31 of the Procedure for use of the means provided in the government budget for implementation of financial support of subjects of managing of agro-industrial complex via the mechanism of reduction in cost of the credits and compensation of leasing payments the Cabinet of Ministers of Ukraine approved by the resolution of August 11, 2010 to No. 794 (with changes), I ORDER:

1. Approve Regulations on the commission on questions of determination of the list and ceiling prices for the machinery and equipment of national production for agro-industrial complex which purchase is financed by means of the government budget which is applied.

2. In accordance with the established procedure to submit to department of engineering facilities and agricultural mechanical engineering (Grinko P. V.) the order on state registration to the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of the order on the deputy minister Senya O. V.

1. This Provision determines procedure for the organization and activities of the commission on questions of determination of the list and ceiling prices for the machinery and equipment of national production for agro-industrial complex which purchase is financed by means of the government budget (further - the Commission) which is formed under the Ministry of Agricultural Policy and Food of Ukraine.

2. The main task of the Commission is determination of the list and ceiling prices for the machinery and equipment of national production for agro-industrial complex which purchase is financed by means of the government budget (further - the List).

3. The commission is effective as a part of at least 5 persons which part the deputy minister of agrarian policy and food of Ukraine, heads of structural divisions of the ministry are.

The commission is headed by the deputy minister of agrarian policy and food of Ukraine.

The structure of the Commission affirms Minagropolitiki's order of Ukraine.

For participation in work of the Commission heads of industry scientific institutions and representatives of public organizations of agro-industrial complex of Ukraine can be attracted (in consent).

4. Form of work of the Commission are meetings which are held according to the decision of the commission chairman or vice-chairman of the Commission, but at least once in half a year.

Commission session is conducted by the chairman, and in case of its otsutstviyazamestitel of the chairman.

5. The list is determined by results of consideration served the manufacturing plants and/or dealers selling the domestic machinery and equipment for agro-industrial complex - residents (further - suppliers), requests concerning inclusion in the list and ceiling prices for the machinery and equipment of national production for agro-industrial complex which purchase is financed by means of the government budget, in form according to appendix 1 and the list of documents which are provided to the commission on questions of determination of the list and ceiling prices for the machinery and equipment of national production for agro-industrial complex which purchase is financed by means of the government budget, according to appendix 2 to this Provision.

6. The announcement of the beginning of documents acceptance is posted on Minagropolitiki's website of Ukraine (www. minagro.gov.ua) not later than a month before the beginning of new fiscal year.

7. The documents filed to the Commission by suppliers are confidential and are not subject to disclosure, except cases, stipulated by the legislation Ukraine.

8. During consideration of documents by the Commission such indicators are taken into account:

cost of the equipment, UAH;

term of warranty period, years;

availability of service network.

9. Decisions of the Commission are made at meetings at presence at least than two thirds of its structure by open voting by a simple majority vote.

In case of equal number of votes the chairman's voice at meeting is decisive.

The decision of the Commission is drawn up by the protocol which is signed by all members who are present at meeting.

Based on the decision of the Commission the secretary of the Commission prepares the corresponding draft of the order of Minagropolitiki of Ukraine, provides its approval and representation for the signature to the Minister of Agricultural Policy and Food of Ukraine.

10. The order is carried to permission of the Ministry of Agricultural Policy and Food of the Autonomous Republic of Crimea, head departments of agro-industrial development of regional public administrations, management of the industry and agro-industrial development of the Sevastopol city public administration, National joint stock company "Ukragroleasing" and will be promulgated on Minagropolitiki's website of Ukraine (www. minagro.gov.ua).
